SUMMARY OF CHANGES
SECTION SF 30 - BLOCK 14 CONTINUATION PAGE
The following have been added by full text:
Q&AS - Q10 TO Q15
No. Question Answer 10 Is there a requirement only US Citizens/green card holders can work or will you allow foreign staff to work in these positions? If so will you sponsor visas or provide the necessary documentation to apply for work visas?
There are no citizenship requirements to perform the services as long as the individual possesses the requirement experience, licenses, and certifications. All personnel must have a legal residency or immigration status in Japan.
Civilian personnel with US Nationality who are not ordinarily resident in Japan may be invited by USFJ for recognition as “members of the civilian component” and afforded privileges under the Status of Forces Agreement. Non-US nationals must possess legal residency in Japan either as a Japanese citizen or as a legal alien resident of Japan.
Contractors are responsible for ensuring the legal immigration status of their personnel while in Japan, to include obtaining necessary work visas for their employees.
Pursuant to USFJ Instruction 31-204, entry onto USFJ installations/areas by non-SOFA personnel from certain designated third countries is not authorized without prior coordination with the installation counterintelligence agency and approval from the installation commander. More information about these policies can be provided upon request.
11 Will you accept Nursing Licenses/Certification from a foreign country equivalent to the Japanese or American Nursing License?
No, in accordance with paragraph 4.1. of AFI
44-119, MEDICAL QUALITY OPERATIONS
(16 AUGUST 2011), only Nursing Licenses/ Certifications from a US jurisdiction are acceptable.
12 The quantities for the nurses are not the same as indicated on the PWS. For example, "Exhibit A-Basic" has EST quantity for Kadena Registered Nurse, Case Manager as "4" when the PWS has "2" as the number needed.
I attempted to just change the numbers myself, but the spreadsheet is locked and password protected.
The Government contemplates award of an Indefinite Delivery and Indefinite Quantity (IDIQ) contract; the exhibit is included estimated maximum quantities. The paragraph 1 of PWS (dated 16 FEB 2018) indicates the specific number of units that the Government may order to the Contractor during the basic period. Since this requirement would be an IDIQ contract, quantity and unit of month would change based on the nature of demand within the designated dollar value range described on the solicitation.
Based on the aforementioned, please use the revised Excel sheet. Fields “Unit Price” under column E of Tabs A thought E are editable.
Once all tabs are completed, “Cover Sheet Summary” tab will be completed automatically.
13 Are we to require to submit the spreadsheet with our 1449? If so, could you please advise as to how to input our unit prices and confirm the correct EST Quantity for each location?
Yes. The SF1449 should have the total amount of each Contract Line Item Number (CLIN).
Each CLIN is calculated based on each Exhibit Line Item Number (ELIN). Please submit the revised excel spreadsheet since the pricing evaluation would require not only CLINs information but also ELINs information.
The EST Quantity for each location is set as maximum unit that the Government may require during the contract period. Please insert only unit price for each position so that other information will be computed automatically.
14 Does EO 13706 apply to these positions?
Contractors are responsible for determining the applicability of federal laws and regulations and ensuring compliance during the contract performance.
Executive Order 13706, “Establishing Paid Sick Leave for Federal Contractors” applies to covered contracts, to include those covered by the Service Contract Labor Standards Act (formerly the McNamara-O'Hara Service Contract Act of 1965). The Service Contract Labor Standards Act has a limited geographic scope, see Title 29, Part 4 of the Code of Federal Regulations, Section 4.123(d), and generally does not apply to service contracts performed entirely outside of the United States.
Information of the application of EO 13706, can be found at:
https://www.dol.gov/whd/govcontracts/eo13706/ See also: FAR 22.1003-2 and FAR 22.2103.
15 Are there specific taxes/fringe that will apply to this contract because performance takes place on US bases in Japan?
Tax implications for SOFA status personnel are addressed in SOFA Articles XI and XIII. Tax implications for contractors performing services are addressed in Articles XI, XII and XIII and USFJ Instructions 51-5 and 91-205.
