UNDER MULTIPLE AWARD CONTRACTS
1. Fair Opportunity
Price competition will be made at the time of award. To comply with FAR Part 16.505(b)(1) Orders under multiple award contacts – Fair opportunity, a placement procedure that will provide each awardee a fair opportunity to be considered for each task order is developed herein and monitored throughout the life of the contract. Basis for Yen Equivalent Amount: The yen equivalent amount to the dollar amount specified herein will be calculated using the U.S. Government fiscal year’s Foreign Currency Exchange Rate provided by the U.S. Government Defense Finance and Accounting Service (DFAS) throughout this ordering procedure. The Contracting Officer will provide the Contractors of the exchange rate upon request when it becomes available.
2.2. Task Orders not in excess of a yen equivalent amount of $250,000: The Ordering Officer will place a task order to the Contractor who provides a lower price by a total amount for the order unless circumstances warrant an exception that qualifies under FAR Part 16.505(b)(2) such as:
(1) Only one multiple-award contractor is capable of providing the service required; or
(2) The service required is so urgent that providing a fair opportunity would result in unacceptable delays.
2.3. Task Orders in excess of a yen equivalent amount of $250,000: The Contracting Officer does not anticipate such orders through the life of the contracts. In the event such a requirement arises, the following procedure will apply:
(1) The Contracting Officer, upon notification by the Ordering Officer of such requirements, will provide a fair notice of the intent to make a purchase in writing through e-mail or fax, including clear description of the services to be performed meeting the Advance Notification at PWS 1.4.2.5.
(2) Basis for selecting a task order awardee: Price. The Contracting Officer will place a task order to the Contractor who provides the lower price by a total amount for the order unless circumstances warrant an exception that qualifies under FAR Part 16.505(b)(2) such as:
A. Only one multiple-award contractor is capable of providing the service required; or
B. The service required is so urgent that providing a fair opportunity would result in unacceptable delays.
