1.4 SYNOPSIS OF CONTRACT WORK
A. Basic Work Items include, but are not limited to the following:
1. Replacement of existing ambient lighting, emergency lighting, exit signs, lighting controls, and associated power and controls wiring as indicated in the project plans and further specified.
2. Disposal of demolished components including proper disposal of lamps and ballasts. Assume a 50 percent contamination rate of demolished ballasts with PCB material. See E001, Note 2.
3. Ceiling tile replacement and ceiling/wall patch and paint work.
1.5 GOVERNMENT OCCUPANCY
A. The Government will occupy premises during entire period of construction for the conduct of its normal operations.
B. The Contractor shall perform the work under this contract in such a manner that adjacent Air Force activities may proceed unhindered. Prior to beginning on‐site work the Contractor shall meet with the Contracting Officer and technical representatives from Base Civil Engineering to schedule the work of this contract.
C. Cooperate with Government to minimize conflict and to facilitate its operations. In case of conflict accept Contracting Officer's direction as final and adjust use of premises accordingly.
D. Maintain IBC complying access to and through corridors, stairways, and building exits at all times.
E. Coordinate Work in and use of premises with the Government.
1.6 CONTRACTOR USE OF PREMISES
A. Limit use of premises for Work and for construction operations only.
B. Limit on site storage of materials to government authorized staging areas. Contractor is responsible for security of stored materials and equipment.
C. Contractor shall take reasonable and adequate precautions to protect government property from damage during demolition, construction, clean‐up, and exposure to the elements. Protect systems susceptible to freezing. Protect existing utility and communication systems while working in utilidors. Damaged items shall be repaired or replaced prior to final inspection.

D. Smoking is prohibited in all base facilities.
E. Limit construction access to the location indicated.
F. Move owner tools, equipment, shelving, stored materials, etc., as required to accomplish Work.
G. Return to original location as soon as possible.
H. Protect Owner tools, equipment, shelving, stored materials, and equipment, etc., from Work.
1.7 FIELD ENGINEERING
A. Provide field‐engineering services; establish grades, lines, and levels, by use of recognized engineering survey practices.
B. Control datum for survey is that indicated. Locate and protect control and reference points.
C. Field engineering required to locate existing floor mounted equipment.
1.8 REFERENCE STANDARDS
A. For products specified by association or trade standards, comply with requirements of the standard, except when more rigid requirements are specified or are required by applicable codes or military requirements.
B. Obtain a copy of standards referenced. Maintain a copy at the jobsite during execution of Work to which the standard applies.
C. The date of the standard is that in effect as of the project advertisement date, or effective date of the contract when there was no advertisement, except when a specific date is specified.
1.9 WORK BY OTHERS
A. The Contracting Officer may undertake additional work or award other contracts for additional work for this Project Site and during this Contract Period. The Contractor shall fully cooperate with Government personnel and the other contractors. He shall carefully fit his own work to the additional work as he may be directed by the Contracting Officer.

B. The Contractor shall not commit, nor permit, any act by his personnel which would interfere with the performance of work by any other contractor or by Government employees.
1.10 COORDINATION
A. The Contractor shall not commit, nor permit, any act by his personnel which would interfere with the performance of work by any other contractor or by Government.
B. Coordinate Work of the various Sections of Specifications prior to ordering materials and fabrication to assure efficient and orderly sequence of installation of construction elements, with provisions for accommodating items installed later. Notify Contracting Officer of conflicts between elements prior to installation of any element.
C. Verify characteristics of elements of interrelated operating equipment are compatible;
coordinate Work of various Sections having interdependent responsibilities for installing, connecting to, and placing in service, such equipment.
D. Coordinate space requirements and installation of mechanical and electrical Work, which is indicated diagrammatically on Drawings. Follow routing shown for ducts and conduits as closely as practical. Make piping, duct, and conduit runs parallel with lines of building. Utilize spaces efficiently to maximize accessibility for other installations, for maintenance, and for repairs.
E. In finished areas, unless otherwise indicated, conceal wiring in the construction.
Coordinate locations of fixtures with finish elements.
F. After Owner acceptance of Work, coordinate access to site by various trades for correction of defective Work and Work not in accordance with Contract Documents, to minimize disruption of Owner and provide access to the Owner for this Work.
G. After Substantial Completion, the Owner may install equipment and furnishings.
Cooperate with the Owner and provide access to Owner for this work.
1.11 NOTIFICATION OF COMMENCEMENT OF WORK
A. Prior to excavation on‐site, the contractor shall coordinate with all of the organizations listed on AF Form 103, Base Civil Engineering Work Clearance Request. The completed form shall be submitted to the Contracting Officer and a copy shall be kept at the work site at all times.
B. The Contractor shall notify the Contracting Officer that work will begin a minimum of seven (7) days prior to commencing work.

A. The Contractor shall comply with all Eielson AFB security and access to controlled area procedures and requirements when and if necessary access is absolutely necessary.
Initial procedures and requirements will be provided to the Contractor at the Pre‐ Construction Conference.

2.1 PRODUCTS FOR PATCHING AND EXTENDING WORK
A. New Materials: As specified in individual Specification Sections.
B. Match existing products and work for patching and extending Work.
C. Determine type and quality of existing products by inspection and any necessary testing.
Determine quality of workmanship by use of existing as a standard. Patching, extending, or matching shall be performed as necessary to make Work complete and consistent with existing products, materials and workmanship.
PART 3 EXECUTION
3.1 GENERAL
A. Remove existing work, materials and items as indicated on the Drawings, as required by job site conditions, as scheduled, and as specified herein, to accomplish new Work and alteration in the existing building.
B. Remove work carefully and only to the extent required for the final Work. Minimize damage to adjacent materials.
C. When portions of existing conditions are shown, it is not meant to indicate that all existing conditions are shown.

D. Patch existing surfaces which are made defective in appearance or function by the execution of Work.
E. Take reasonable and adequate precautions to protect the Government’s property from damage during demolition Work, removal of debris, and damage by the elements.
Repair any damage to Government property due to the aforesaid work or replace in a manner satisfactory to the Contracting Officer.
F. Provide and maintain suitable barricades, shelters, lights, and danger signals during the progress of the Work. Provide barricades meeting the requirements of the applicable building codes. Assume the responsibility of barriers to completion of Contract and remove at completion of Contract.
3.2 INSPECTION
A. Verify that demolition is complete, and areas are ready for installation of new Work.
B. Beginning of restoration Work means acceptance of existing conditions.
3.3 PREPARATION
A. Plan all work in advance.
B. Verify existing conditions affecting Work including existing sizes and materials indicated prior to beginning Work or ordering materials that are affected by existing conditions.
Notify Contracting Officer of conflicts in writing.
C. Where openings are to be cut in existing structures cut such openings with care. Where materials, equipment, frames, etc., are to be removed, remove such items with care to minimize damage to adjacent materials.
D. Cut, move, or remove items as necessary for access to alterations and renovations Work; replace and restore at completion.
E. Cut pockets, openings, chases, depressions, etc., to install or allow for installation of materials or equipment.
F. Remove from site unsuitable material not marked for salvage, such as rotted wood, rusted metals, and deteriorated masonry and concrete; replace materials as specified for finished Work.
G. Remove from site, including concealed spaces, debris and abandoned items resulting from demolition operations from the site promptly. No accumulation of debris is permitted.

H. Prepare surfaces and remove surface finishes to provide for proper installation of new Work and new finishes.
I. Close openings in exterior surfaces to protect existing work and salvage items from weather and extremes of temperature and humidity. Insulate ductwork and piping to prevent condensation in exposed areas.
3.4 INSTALLATION
A. Coordinate Work of alterations and renovations to expedite completion and to accommodate Government occupancy.
B. Remove, cut, and patch Work in a manner to minimize damage and to provide means of restoring products and finishes to original condition.
C. In addition to specified replacement of equipment restore existing mechanical and electrical systems to full operational condition.
D. Install products as specified in individual Specification Sections.
3.5 REPAIR OF DAMAGED SURFACES
A. Patch or replace portions of existing surfaces which are disturbed, damaged, or otherwise made defective in appearance or function by the execution of Work under this Contract. Restore to original condition.
B. Repair substrate prior to patching finish.
3.6 FINISHES
A. Finish surfaces as specified in individual Sections.

1.3 REFERENCE STANDARDS
A. Comply with all applicable laws, building and construction codes and applicable requirements of any governmental agency under whose jurisdiction this Work is being performed.
B. Federal, state and local codes and ordinances take precedence over these specifications and drawings where conflicts occur, unless the drawings or specifications call for more stringent requirements. Notify the Contracting Officer in writing of conflicts.

1.4 LICENSES AND PERMITS
A. The contractor shall obtain and maintain current for the duration of this contract, all required federal, state, and local licenses and permits. All associated fees and taxes shall be paid by the contractor without additional cost to the government.
B. The contractor shall obtain any additional Eielson AFB required permits. Current base permit requirements shall be provided to the contractor at the preconstruction conference.
1.5 SAFETY
A. Comply with all Federal and State regulations concerning safety of personnel and equipment.
Contractors are responsible to provide and ensure personnel have the appropriate personal protective equipment. All Contractor personnel shall wear hard hats and steel toe safety shoes while on the project site. All personnel shall wear hearing protection (ear muffs or ear plugs) when inside the power plant, excluding office areas, rest rooms, break rooms and other “quiet” areas. In addition, comply with the requirements of the U.S. Army Corps of Engineers’ manual, Safety and Health Requirements, EM 385-1-1 and applicable OSHA Standards.
B. [Include only if project is at CH&PP] Ensure that lock out, tag out procedures are established and used as directed by 29 CFR 1910.145. Comply with lock-out tag-out procedures in use by CH&PP personnel. Ensure that contractor’s personnel on-site are trained on the government’s procedures.
C. Comply with all safety, traffic and protection requirements in effect on Eielson AFB. The government shall brief the contractor on these requirements at the preconstruction conference.
D. Work areas in this Project may be classified as “permit-required confined spaces” or “non-permit required confined spaces.” The contractor’s certified industrial hygienist shall determine the confined space status of the project areas. Regulations and procedures for entry into “permit-required confined spaces” are contained in 29 CFR 1910.146 and 8 AAC 61.010.14. The contractor is responsible for ensuring the safety of his employees in confined spaces according to these regulations.
E. Confined Space Permit: (Include only if applicable.)
1. Provisions for confined space are outlined in 29CFR 1910.146 and ANSI Z117.1 1989 and shall be followed throughout Project.
2. Base Contact for information regarding confined Space issues is Ground Safety (354 FW/SEG, 377-4260). However, the Contractor shall process any permits required for confined space through his own safety Manager and Permit Space Program.
F. Provide safety barriers around open excavations, openings in floors and other hazards created by the contractor’s activities.
G. The Contracting Officer (CO), or the Contracting Officer’s designee may direct the contractor to cease activities which, in their opinion, are unsafe or which jeopardize operations. However, this

H. The contractor shall protect base residents and the general public from harm in the construction area.
1.6 CONSTRUCTION OPERATION AND SAFETY PLAN
A. Contractor shall provide a Construction Operation and Safety Plan (COSP) for all construction operations.
B. The COSP shall include the following:
1. Detailed construction schedule and work phasing with dates of operation for work elements.
2. Route maps to and from construction sites for workers and equipment and hazardous material transport routes. Route maps shall include FOD fence locations and requirements.
3. Accident Prevention Plan
4. Safety and Health Program documents.
5. The COSP shall be submitted to the Contracting Officer at least 30 days prior to start of construction.
1.7 ACCIDENT PREVENTION PLAN
A. Submit a comprehensive Accident Prevention Plan (APP). The APP shall be similar to the example given in Appendix A of the Corps of Engineers Safety and Health Requirements Manual, EM 385- 1-1.
B. The APP shall be job specific and should include work to be performed by subcontractors. The
APP shall address measures to be taken to control hazards associated with all operations, materials, services or equipment associated with the Work.
C. The Plan shall include the following sections, as applicable:
1. Name of plan preparer and approving company officer
2. Contractor, contract name & number
3. Copy of current company safety and health policy
4. Responsibilities and lines of authority. Explain who is responsible for site safety and for each specific operation, whether performed by the prime or a subcontractor. Discuss frequency of inspections and documentation.
5. List subcontractors and means of coordinating safety activities.
6. Describe initial new employee training, and periodic safety training. Any specific training

Hazardous waste site cleanup operations require development and implementation of an SSHP (Site Safety and Health Plan) that shall be attached as an appendix to the APP. General information adequately covered in the APP need not be duplicated in the SSHP.

10. Risk management for specific project related activities. Provide an Activity Hazard Analysis (AHA) for project specific hazards and controls that are not covered or are not sufficiently covered by the plans and programs described above.
D. Before beginning each work activity involving a type of work presenting hazards not experienced in previous project operations or where a new work crew or subcontractor is to perform the work, the Contractors performing the work activity shall prepare an Activity Hazard Analysis (AHA).
E. Each AHA shall define the activities being performed, the work sequence, specific anticipated hazards and control measures to be implemented to eliminate or reduce each hazard to an acceptable level.
F. Work shall not begin until the AHA has been discussed with all engaged in the activity
G. AHAs shall be modified as necessary to address changing site conditions.
1.8 SAFETY AND HEALTH PROGRAM
A. The contractor shall have a developed and maintained written Safety and Health Program (SHP) in compliance with the requirements of OSHA standard 29 CFR 1910.120(b) (1) through (b) (4).
Relevant portions of 29 CFR 1910 Subpart Z – Toxic and Hazardous Substances; 29 CFR 1926 Subparts 21(b), 651(g), and 800(h) & (i); 8 AAC 61 Subchapter 10; 118 AAC 75; COE ER 385-1- 92; and COE EM 385-1-1. The level of detail provided in the SHP shall be tailored to the type of work, complexity of operations to be accomplished, and the hazards anticipated. The program shall be designed to identify, evaluate, and control safety and health hazards, and provide for emergency response for hazardous waste operations. The SHP shall be reviewed and signed by a Certified Industrial Hygienist or Certified Safety Professional. All subcontractors shall comply with the prime contractor’s SHP unless the subcontractor has submitted a separate SHP through the prime contractor. The SHP shall be updated as required. The SHP shall be submitted in its entirety to the contracting officer prior to any work on the site.
B. The SHP shall provide evidence of related safety and health training received by the supervisors and employees. Supervisors’ and employees’ qualifications shall be submitted to the Contracting Officer for review. At least one person certified in first aid and CPR by the Red Cross, or equivalent agency, shall be present on site during all field operations.
C. The Site Specific Safety and Health Plan part of the SHP shall be prominently displayed at the job site. Alaska Statutes 18.60.066 - .068 shall also be displayed at the same location.
D. NOTE: Safety and health programs developed and implemented to meet other federal, state, or local regulations are considered acceptable in meeting this requirement if they cover or are modified to cover the topics required in this paragraph. An additional or separate safety and health program

E. The written safety and health program shall incorporate the following:
1. An organizational structure;
2. A comprehensive work plan;
3. A site-specific safety and health plan which need not repeat the employer's standard operating procedures;
4. The safety and health training program;
5. The medical surveillance program;
6. The employer's standard operating procedures for safety and health; and
7. Any necessary interface between general program and site specific activities.
F. Site excavation. Site excavations created during initial site preparation or during hazardous waste operations shall be shored or sloped as appropriate to prevent accidental collapse in accordance with Subpart P of 29 CFR Part 1926.
G. Contractors and sub-contractors. An employer who retains contractor or sub-contractor services for work in hazardous waste operations shall inform those contractors, sub-contractors, or their representatives of the site emergency response procedures and any potential fire, explosion, health, safety or other hazards of the hazardous waste operation that have been identified by the employer's information program.
H. Program availability. The written safety and health program shall be made available to any contractor or subcontractor or their representative who will be involved with the hazardous waste operation;
to employees; to employee designated representatives; to OSHA personnel, and to personnel of other Federal, state, or local agencies with regulatory authority over the site.
I. Organizational structure part of the site program. –
1. The organizational structure part of the program shall establish the specific chain of command and specify the overall responsibilities of supervisors and employees. It shall include, at a minimum, the following elements:
a. A general supervisor who has the responsibility and authority to direct all hazardous waste operations.
b. A site safety and health supervisor who has the responsibility and authority to develop and implement the site safety and health plan and verify compliance.
c. All other personnel needed for hazardous waste site operations and emergency response and their general functions and responsibilities.
d. The lines of authority, responsibility, and communication.
2. The organizational structure shall be reviewed and updated as necessary to reflect the

J. Comprehensive work plan part of the site program. The comprehensive work plan part of the program shall address the tasks and objectives of the site operations and the logistics and resources required to reach those tasks and objectives.
1. Address anticipated clean-up activities as well as normal operating procedures which need not repeat the employer's procedures described elsewhere.
2. Define work tasks and objectives and identify the methods for accomplishing those tasks and objectives.
3. Establish personnel requirements for implementing the plan.
4. Provide for the implementation of the required training.
5. Provide for the implementation of the required informational programs.
6. Provide for the implementation of the medical surveillance program.
K. Site-specific Safety and Health Plan (SSHP) part of the program. -- The Site Safety and Health
Plan, which must be kept on site, shall address the safety and health hazards of each phase of site operation and include the requirements and procedures for employee protection. The site safety and health plan, as a minimum, shall address the following:
1. A safety and health risk or hazard analysis for each site task and operation found in the work plan.
2. Employee training assignments to assure compliance.
3. Personal protective equipment to be used by employees for each of the site tasks and operations being conducted as required by the personal protective equipment program.
4. Medical surveillance requirements in accordance with the program.
5. Frequency and types of air monitoring, personnel monitoring, and environmental sampling techniques and instrumentation to be used, including methods of maintenance and calibration of monitoring and sampling equipment to be used.
6. Site control measures in accordance with the site control program.
7. Decontamination procedures.
8. An emergency response plan for safe and effective responses to emergencies, including the necessary PPE and other equipment.
9. Confined space entry procedures.
10. A spill containment program.
L. Pre-entry briefing. The site specific safety and health plan shall provide for pre-entry briefings to be held prior to initiating any site activity, and at such other times as necessary to ensure that

Design Alaska, Inc. 01 14 00‐ 10 employees are apprised of the site safety and health plan and that this plan is being followed. The information and data obtained from site characterization and analysis shall be used to prepare and update the site safety and health plan.
M. Effectiveness of site safety and health plan. Inspections shall be conducted by the site safety and health supervisor or, in the absence of that individual, another individual who is knowledgeable in occupational safety and health, acting on behalf of the employer as necessary to determine the effectiveness of the site safety and health plan. Any deficiencies in the effectiveness of the site safety and health plan shall be corrected by the employer.
N. Written hazard communication program. Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:
1. A list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,
2. The methods the employer will use to inform employees of the hazards of non-routine tasks
(for example, the cleaning of reactor vessels), and the hazards associated with chemicals contained in unlabeled pipes in their work areas.
O. Multi-employer workplaces. Employers who produce, use, or store hazardous chemicals at a workplace in such a way that the employees of other employer(s) may be exposed (for example, employees of a construction contractor working on-site) shall additionally ensure that the hazard communication program includes the following:
1. The methods the employer will use to provide the other employer(s) on-site access to safety data sheets for each hazardous chemical the other employer(s)' employees may be exposed to while working;
2. The methods the employer will use to inform the other employer(s) of any precautionary measures that need to be taken to protect employees during the workplace's normal operating conditions and in foreseeable emergencies; and,
3. The methods the employer will use to inform the other employer(s) of the labeling system used in the workplace.
P. The employer may rely on an existing hazard communication program to comply with these
Q. The employer shall make the written hazard communication program available, upon request, to employees, in accordance with the requirements of 29 CFR 1910.1020 (e).
R. Where employees must travel between workplaces during a work shift, i.e., their work is carried out at more than one geographical location, the written hazard communication program may be kept at the primary workplace facility.
1.9 FIRE SAFETY
A. Comply with all fire safety and protection requirements in effect on Eielson AFB. The government

B. Prior to beginning any welding, use of open flame device, or any activity that produces sparks, obtain a “hot work permit” (AF Form 592, USAF Welding, Cutting, and Brazing Permit) from base Fire Department. The permit shall be renewed each day welding or open flame devices shall be used.
1. If the contract work requires numerous days of hot work, the contractor may elect to have one of his on-site personnel designated as a Permit Authorizing Individual (PAI). The contractor’s PAI may issue hot work permits at the work site, thus avoiding the requirement for daily permits issued by the Fire Department.
2. The contractor’s PAI shall be the on-site superintendent, a foreman, the contractor’s safety manager, or other individual with sufficient knowledge and experience to recognize unsafe work practices or conditions and having authority to stop work immediately if such unsafe practices or conditions are observed. To be designated as a PAI, a person must schedule and successfully complete PAI certification training offered by the base Fire Department. The PAI certification training is estimated to last 60 to 90 minutes and will be valid for the duration of the contract.
3. Fire Department personnel may periodically visit the site to ensure the contractor is complying with fire safety requirements. A PAIs certification may be revoked if the PAI has failed to issue permits on days when hot work is performed, or if unsafe practices or conditions are observed.
4. Questions concerning these requirements may be directed to Fire Prevention Office, 354
CES/CEFT, Eielson AFB, 377-1293.
C. The contractor shall notify the Fire Department at 377-4156 and Fire Prevention Section at 377-1293 a minimum of 72 hours before, and again immediately prior to, temporarily closing any street or building access, interrupting water service to any fire hydrant or interrupting the operation of any fire detection, alarm or suppression system. The fire department shall be immediately notified upon reopening closed areas, restoration of water service to any fire hydrant, or reactivation of any detection, alarm or suppression system. Additionally any out of service hydrants will be covered and secured with a black bag to easily identify it is “out of service”. This notification requirement is in addition to other contract requirements.
D. Provide a 10 lb, ABC fire extinguisher at all work areas.
1.10 USE OF IONIZING RADIATION (IR)
A. Submit a written request for approval at least 30 calendar days before commencement of activities which require the use of IR generating devices.
B. Submit request to the Base Radiation Safety Officer (RSO) at the Bioenvironmental Engineering
Office (354 MDOS/SGOJ, Phone: 377-6687) with a courtesy copy to the Contracting Officer.
Request shall include:

1.12 RADIOACTIVE MATERIALS (RAM):
A. Prior to bringing RAM onto Eielson AFB property, the contractor shall obtain permission from the RSO. To obtain approval, forward an application to the RSO and a courtesy copy to the Contracting Officer at least 30 calendar days before the planned date for commencement of activities on the installation. Requests shall include:
1. A description of the proposed activities on NRC Form 241, Report of Proposed Activities in
Non-Agreement States, (the 180-day limitation on the form does not apply to organizations holding an NRC license). Contractors possessing Agreement State Licenses shall also submit an NRC Form 241 to NRC in compliance with 10 CFR 150.21. Contractors requiring more than 180 days of operation per calendar year on the installation shall possess an NRC license.
2. The procedures established to ensure radiological health and safety of Air Force personnel and the public while on Air Force installations on site and the name of the responsible contractor representative.
3. A current copy of the applicable NRC, or Agreement State license. Expired licenses are unacceptable. To be valid at the installation, the license must either specifically state the installation by name on the license or state approval for work at temporary job sites anywhere in the United States where the NRC or Agreement State maintains jurisdiction. DoE or DoE prime contractors must provide, in lieu of a license, written certification of their exemption from NRC licensing requirements and cite the applicable exemption of 10 CFR.
4. The part of the Air Force contract describing work to be done and the inclusive dates of such work.
5. An acknowledgment that the base RSO may make periodic checks to ensure the contractor is following applicable radiological health and safety practices which prevent unnecessary exposures to Air Force personnel and prevent potential contamination of government property.
1.13 USE OF RADIO FREQUENCY (RF) RADIATION
A. Prior to using equipment generating RF radiation in excess of seven watts peak power and a frequency of 1000 MHz or greater on Eielson AFB, the contractor shall submit a written request for approval at least 30 calendar days before commencement of activities, which require the use of the RF generating device.

A. Contractor shall notify the Contracting Officer and Bioenvironmental Engineering (BE) 10 working days prior to any industrial ventilation systems (systems which control a hazard) being evaluated for acceptance. BE may perform or observe all tests for any new or renovated system prior to initial startup to determine if the system shall control the hazard. BE may be present for the tests of fan speed and rotation, and fan motor load and may be present for or conduct tests of air flow in all fume hoods.

1.16 PROTECTION OF NESTING BIRDS
A. Federal law prohibits disturbing bird nests containing eggs or birds too young to fly. Harassment of birds to force them to abandon an occupied nest is also illegal. If the contractor removes nests or harasses birds in violation of federal and state law, the contractor is responsible for any charges filed by US Fish and Wildlife Service or State of Alaska Department of Public Safety and is the liable party.
B. If an occupied bird nest is discovered, the contractor shall cease activities in the vicinity of the bird nest until the young birds are able to fly and leave the nest under their own power.
C. Cliff swallow nests are usually the greatest threat to construction projects. As a general rule, cliff swallows can begin nest construction any time between 10 May and 21 July.
D. The contractor shall be responsible for control of new nest construction after issuance of Notice to Proceed (NTP). The contractor shall survey the work area daily for new nest construction. To avoid project delays, the contractor shall remove all nests discovered before the nests have been completed and occupied.
E. The contractor shall be responsible for any increased cost or delay resulting from a nest constructed and occupied in the work area after NTP has been issued.
1.17 DISCOVERY OF HISTORICAL OR CULTURAL ARTIFACTS
A. Should any historical artifacts or cultural resources be unearthed, stop excavating and immediately notify the Contracting Officer.
1.18 SUSTAINABLE PROCURMENT PROGRAM
A. The contractor is encouraged to recycle materials that shall be discarded as waste. Items that can be recycled in this community are asphalt, metals (including, but not limited to aluminum, tin, and steel), antifreeze, batteries, paper/cardboard, plastics, and used oil. This list is not all inclusive.
1. Sustainable Procurement is the purchase of sustainable and environmentally preferable products and services in accordance with federally mandated "green" procurement preference programs. The purpose of the SPP is to enhance and sustain mission readiness through cost effective acquisition that achieves compliance and sound management of the AF’s financial, natural, and energy resources. Through the P2 methodology outlined below, all AF organizations making purchases or product specifications for purchases will use the SPP as a routine part of day-to-day purchasing activities to reduce resource consumption and solid and HW generation. (T-1). 6.5. P2 Methodology.
B. These standards apply to all new construction, demolition, rehabilitation, alteration, modification, repair, and maintenance of existing facilities.
1. In an effort to comply with the sustainable procurement requirements of Section 6002 of the Resource Conservation Recovery Act (RCRA) and Executive Order 13693 in addition to EO 13101, the government strongly promotes the use of the recycled and recovered materials and products identified in the Environmental Protection Agency’s Comprehensive Procurement Guidelines.

2. Recycled and recovered materials and products shall be considered first before any other materials and products shall be accepted. Recycled and recovered materials and products shall be used throughout the project unless they either do not meet the requirements of this specification, delay the progress of the work, or are cost prohibitive.
3. Detailed below are examples of some materials and products. These are recommended quantities and represent minimum compliance. The actual requirement is to use the maximum amount of recycled material possible, while meeting the performance specifications. Under the Comprehensive Procurement Guidelines (CPG) program, the Environmental Protection Agency (EPA) designates products that are or can be made with recovered materials, and recommends practices for buying these products. Any designated product that is being offered or supplied under this contract shall meet the minimum recommended content levels as identified under the CPG program.
