(viii) 52.212-1 Instructions to Offerors—Commercial Products and Commercial Services (SEP 2023) is hereby incorporated by reference, with the same force and effect as if it were given in full text. In addition to the following addendum, all terms and conditions of FAR 52.212-1 remain in effect. The following have been tailored to this procurement and are hereby added via addendum:

1. To assure timely and equitable evaluation of the quote, the Vendors must follow the instructions contained herein.

The quote must be complete, self-sufficient, and respond directly to the requirements of this solicitation. A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

2. Specific Instructions: The response shall consist of the following:

Price – Submit one (1) completed copy of price schedule (Attachment IV). For the price section of your quote, you are required to fill out the green highlighted portions of the price schedule. Vendor will complete the “Bidder’s Guaranteed Daily Capability” (Column I, rows 1-74, for each tab). Then the vender will complete “Unit Price” (Column G, rows 88-1194) for each highlighted estimated annual quantity; vendor must take care to only complete the areas shaded in green. Pricing must include the surcharge as detailed in Attachment G7 of the PWS. The completed price schedule must be submitted with your quote.

This is a mandatory requirement for electronic submission of invoicing and payment for Direct Procurement Method (DPM) services via the DoD-approved Third-Party Payment System (TPPS) and associated processes outlined in Defense Transportation Regulation.

NOTE: Failure to include the completed price schedule, will deem your quote as non-conforming to the solicitation and the quote may not be considered for award. If a vendor does not provide services for a specified area, then ensure to input 0.

(ix) 52.212-2 Evaluation—Commercial Products and Commercial Services (Nov 2021) this provision has been tailored to this procurement and is provided in full-text below:

1. The Government will award firm fixed price Requirements contract(s) resulting from this solicitation to responsible vendors whose quotes conforming to the solicitation are acceptable and lowest price. Multiple awards will be made, if necessary, to meet the maximum estimated requirements detailed in the pricing schedule. The following factors shall be used to evaluate the quotes:

a. Price: The evaluation team will evaluate quotes by the “Total Evaluated Price (TEP)” as shown below in paragragh c. Attachment IV, Price Schedule, will be used to evaluate price. Vendors are required only to price the base and option CLINs. Vendors shall not submit a price for the potential six-month extension(s) of services. Government will calculate six-month extension of services as stated below.

b. In accordance with FAR Clause 52.217-8, Option to Extend Services, the contract may be extended, at the Government’s sole discretion, for a period of up to six (6) months, exercisable in increments of not less than one

(1) month. If the contract contains an unexercised option period, the Government may elect to exercise the option pursuant to FAR Clause 52.217-9, Option to Extend the Term of the Contract.

c. Total Evaluated Price (TEP) Calculation: The six-month extension of services will be calculated by determining a monthly rate (annual rate divided by number of months per option period) for each contract year, multiplying the monthly rate by six (6) to get the value of a fully exercised extension, and then adding each contract year and the value of the fully exercised extension for each schedule area. Each area's TEP will be evaluated separately, as a distinct entity.

Area I Within 50 miles from JBER Hospital Area II Between 51-175 miles from JBER Hospital Area III Between 176-375 miles from JBER Hospital Area IV Within 65 miles radius from North Pole Post Office (Fairbanks, AK area) Area V Between a 66-125 mile radius from North Pole Post Office (Clear AFB/Delta Junction/Fort Greely, AK.)

The Contracting Officer will make a determination of the conformity of the vendor quotes to the terms and conditions of the solicitation.

Pricing must include the surcharge as detailed in Attachment G7 of the PWS.

The Vendor’s separately priced line items or subline items may be analyzed to determine if the prices are unbalanced in accordance with FAR 15.404-1(g). The Government reserves the right to perform price realism analysis. If the Government elects to perform a price realism analysis, the Government reserves discretion over the method within which it performs its price realism analysis. If the Government elects to perform a price realism analysis and finds a quote unrealistic, the Government may withhold award to that vendor.

2. Vendors are cautioned to submit sufficient information, in the format specified in 52.212-1, Instructions to Offerors – Commercial Items, of this solicitation. Vendors may be asked to clarify certain aspects of their quotes.

Clarifications conducted to resolve minor or clerical errors will not constitute interchanges and the Contracting Officer reserves the right to award a contract without the opportunity for quote revision. The Government intends to award a contract without interchanges with respective vendors, however, reserves the right to conduct them if deemed in its best interest.

3. The Vendors shall submit complete pricing data for all highlighted items listed in the Price Schedule. The Government’s expectation is that these items will be per industry standard and priced accordingly. NOTE: Failure to include a price schedule, or failure to include pricing for any item in the price schedule, will render the quote non-conforming to the solicitation and the quote may not be considered for award. If a vendor does not provide services for a specified area, then ensure to input 0 so that pricing data is completed.

4. Proposed prices will become fixed prices on the contract. In the event the Government extends services under the authority of FAR 52.217-8, “Option to Extend Services”, unit pricing for the last option period exercised preceding the extension shall remain in effect. These prices are already determined to have been evaluated at time of contract award.

5. Multiple Award: Vendors' quotes will be ranked based on TEP from low to high for each schedule area. Starting with the low TEP, evaluations for award will be conducted to select vendor(s) until the sum of the vendor(s) maximum capacity reaches the Government's maximum estimated demand. Once maximum capacity is reached, no further evaluations will be conducted for that schedule area. Vendor with the lowest TEP will be awarded up to their guaranteed daily amount and then the remaining task order for that day will be awarded to the next lowest TEP, and this process will continue until the maximum government capacity is reached.

6. A vendor must be determined to be responsible by the Contracting Officer in order to be eligible for award.

Responsibility is described in Federal Acquisition Regulation (FAR) Subpart 9.1, “Responsible Prospective Contractors” and associated supplements. Award(s) will be made in accordance with paragraph (ix)5 to the responsible vendor(s) whose price(s) the Contracting Officer has determined fair and reasonable.

Initially quotes will be ranked according to Total Evaluated Price for each schedule area. The ranking will be based on the lowest price by each of the individual areas described above. By definition there is only one “lowest” price for each area outlined below:

(a) The Contractor shall comply with the following Federal Acquisition Regulation (FAR) clauses, which are incorporated in this contract by reference, to implement provisions of law or Executive orders applicable to acquisitions of commercial products and commercial services:
