COMBINED SYNOPSIS/SOLICIATION ‘COMBO’:

R11 Tanker Repairs 06L0078

This is a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

Solicitation FA500024Q0067 is issued as a Request for Quotation (RFQ). Only written offers will be accepted (oral offers will not be accepted). The Government intends to establish a single firm fixed priced contract resulting from this solicitation to the responsible contractor whose quote is most advantageous to the Government, price and other factors considered. All firms or individuals responding must be registered with the System for Award Management (SAM) IAW 52.204-7.

FAR clauses and provisions enclosed within this RFQ are those in effect through Federal Acquisition Circular (FAC) 2024-06, effective August 29, 2024, DFARS change August 15, 2024 and The DAFFARS provisions and clauses are those in effect to DAFAC 2024-0612, effective June 12, 2024, all are available in full text through http://www.acquisition.gov/far/.

Size Standard: $9M

Any changes to this solicitation and any resultant contract must be completed in writing by the Contracting Officer. Changes made that are not authorized by the Contracting Officer are done at the risk of the contractor, to include costs. The Contracting Officer is the only government representative authorized to change the terms and conditions of this requirement.

Purpose:

The Government intends to repair a damaged R11 Aviation Fuel Tanker on JBER, Ak in accordance with the Performance Work Statement (PWS).

Description of agreement:

The 673rd Contracting Squadron at Joint Base Elmendorf-Richardson, Alaska, will award a single contract resulting from this RFQ to the responsible offeror that is technically acceptable and is found to be the best value to the Government.

Invoices

An individual invoice shall be provided for delivery in WAWF.

WAWF is the primary method of payment and instructions are listed in the clause section below.

The government intends to establish a firm-fixed price contract for the following:

The Contractor shall provide all labor, tools, facilities, materials, and services needed to perform repairs on a R-11 Aviation Fuel Tanker in accordance with the PWS.

The Pricing Schedule is incorporated as Attachment 2. Contractors shall complete Attachment 2 in its entirety and return with any other documentation/data as required by this Combo to show breakdown of proposed pricing.

No additional contract requirements apply to this acquisition.

A Defense Priorities and Allocations System (DPAS) assigned rating does not apply to this acquisition.

Response Deadline

For a quote to be considered it must be emailed to the Contracting Officer, robert.briggs.13@us.af.mil and the Contract Specialist joseph.ford.21@us.af.mil, by the response time and date. Response time, regardless of time listed in sam.gov is 17 September 2024 at 1400 Alaska Standard Time (AST). Occasionally the system lists a different time or no time at all. Any quote received after 1400AST on 17 September 2024 will be late and could be considered nonresponsive.

Shipping & Delivery Requirements Delivery Hours: Normal operating hours are 7:00 A. M. through 4:00 P.M. Monday through Friday. A twenty-four (24) hour advance notice and coordination between the contractor and the government representative is required prior to any Saturday or Sunday deliveries.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. (a) Definitions. As used in this clause—

“Department of Defense Activity Address Code (DoDAAC)” is a six-position code that uniquely identifies a unit, activity, or organization.

“Document type” means the type of payment request or receiving report available for creation in Wide Area Workflow

(WAWF).

“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.

“Payment request” and “receiving report” are defined in the clause at 252.232-7003 , Electronic Submission of Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-7003 , Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall—

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov;

and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/

(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, http://www.acquisition.gov/ http://www.sam.gov/ or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:

(1) Document type. The Contractor shall submit payment requests using the following document type(s):

(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.

(ii) For fixed price line items—

(A) That require shipment of a deliverable, submit the invoice and receiving report specified by the Contracting Officer.

5352.201-9101 PACAF Ombudsman (JUL 2023)

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. (d) The ombudsman has no authority to render a decision that binds the agency.

(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the contracting officer.

5352.242-9000 Contractor Access to Air Force Installations (JUN 2024)

(a) The contractor shall obtain base identification and vehicle passes, if required, for all contractor personnel who make frequent visits to or perform work on the Department of the Air Force installation(s) cited in the contract. Contractor personnel are required to wear or prominently display installation identification badges or contractor-furnished, contractor identification badges while visiting or performing work on the installation.

(b) The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. The letter will also specify the individual(s) authorized to sign for a request for base identification credentials or vehicle passes. The contracting officer will endorse the request and forward it to the issuing base pass and registration office or Security Forces for processing. When reporting to the registration office, the authorized contractor individual(s) should provide a valid driver's license, current vehicle registration, valid vehicle insurance certificate, and <<1> >to obtain a vehicle pass.

(c) During performance of t he contract, the contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials and vehicle passes for any employee who no longer requires access to the work site.

(d) When work under this contract requires unescorted entry to controlled or restricted areas, the contractor shall comply with <<2>> citing the appropriate paragraphs as applicable.

(e) Upon completion or termination of the contract or expiration of the identification passes, the prime contractor shall ensure that all base identification passes issued to employees and subcontractor employees are returned to the issuing office.

(f) The contractor shall provide an after-hours contact number or after-hours email in the Emergency Mass Notification System (EMNS) for each of their personnel, whose normal place of duty is on a DoD installation or within a DoD facility. The contractor shall comply with any additional requirements in DAFMAN 10-206 for emergency operational reporting. Foreign Nationals may participate and may remove themselves from the Emergency Mass Notification System at any time. To update information, personnel can access the globe icon on their system desktop screens and choose the "Access Self-Service" option.

(g) Failure to comply with these requirements may result in withholding of final payment.

FAR 52.212-1 Instructions to Offerors -- Commercial Products and Commercial Services (Sep 2023) Is hereby incorporated by reference, with the same force and effect as if it were given in full text. In addition to the following addendum, all terms and conditions of FAR 52.212-1 remain in effect. The following have been tailored to this procurement and are hereby added via addendum:

1. To assure timely and equitable evaluation of the quote, the vendors must follow the instructions contained herein. The quote must be complete, self-sufficient, and respond directly to the requirements of this solicitation.

2. Specific Instructions: The response shall consist of two (2) separate parts:

a. Part 1- Price – Submit one (1) copy of price schedule and any pertinent additional information.

b. Part 2- Technical Summary – Submit one (1) copy of the product(s) to be delivered with specifications that clearly demonstrate adherence to the specific characteristics.

3. Award will be made to the vendor whose quote is conforming to the solicitation and is determined to be the lowest price.

52.212-2 EVALUATION -- COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) Product Acceptability

(2) Price

Technical and past performance, when combined, are equal to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) Price will be considered. The Government intends to evaluate quotes and award without discussion but reserves the right to conduct discussions. The lowest priced quote will be evaluated first. Therefore, the vendor’s initial quote should contain the vendor’s best terms from a price standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. Quotes that fail to furnish required representations or information or reject the terms and conditions of the solicitation may be excluded from consideration.

(d) This will be a lowest price accepted. Minimal Qualifications –is defined as meeting all of the following criteria:

Minimum Qualifications: Contractor must be able to provide all the products described herein (see Attachment 1: Salient Characteristics).

(e) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The following is inserted as new paragraph (d) of the provision:

(f) Basis for Contract Award: This acquisition is conducted in accordance with Federal Acquisition Regulation (FAR) Parts 12, 13, 16, etc. and all applicable Department of Defense (DoD) FAR Supplement (DFARS) and Air Force FAR Supplement (AFFARS) references.

Award will be made to the lowest evaluated price that meets the acceptability standards for non-price factors. The Government will evaluate price factors and intends to make award without further interchanges with quoters but reserves the right to, if deemed in the best interest of the Government. Quotes that fail to conform to any of the solicitation terms and conditions may be excluded from contract award consideration. It is the Governments intent to award a 5-year definitive contract. The evaluation process will include the following:

A. Product Acceptability. The Government will evaluate the submissions on a pass/fail basis and assign an Acceptable or Unacceptable rating as described in Table 1 below.

(1) A description of all covered defense telecommunications equipment and services offered (include brand or manufacturer; product, such as model number, original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable).

(2) An explanation of the proposed use of covered defense telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition referenced in paragraph (b) of this provision.

(3) For services, the entity providing the covered defense telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known).

(4) For equipment, the entity that produced or provided the covered defense telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

252.225-7020 Trade Agreements Certificate - Basic. (Nov 2014)

(a) Definitions. “Designated country end product,” “no designated country end product,” “qualifying country end product,” and “U.S.-made end product” as used in this provision have the meanings given in the Trade Agreements—Basic clause of this solicitation.
