Combined Synopsis/Solicitation

Regulated Garbage Removal and Disposal

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.

This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

(ii) The solicitation number FA5000-19-R-A020 is issued as a request for proposal (RFP).

(iii) This solicitation document and its incorporated FAR provisions and clauses are those in effect through Federal Acquisition Circular 2019-03, effective 12 Jul 2019. All incorporated DFARS provisions and clauses are those in effect through DPN 20190628, effective 28 June 2018. All incorporated AFFARS provisions and clauses are those in effect through AFAC 2018-0525, effective 25 May 2018.

(iv) This unrestricted requirement falls under the North America Industrial Classification System (NAICS) code 562219, Other Nonhazardous Waste Treatment and Disposal, with a small business size standard of $38.5M in annual receipts.

(vi) This requirement is for the procurement of Service for Regulated Waste Removal and Disposal in support of 732 Air Mobility Squadron, Joint Base-Elmendorf-Richardson, Alaska. The service shall provide all personnel, equipment, tools, materials, supervision, and other items and services necessary to collect, package and transport regulated garbage as defined by law and required by the Performance Work Statement (PWS). Attachment 1 – Performance Work Statement.

(vii) All items shall be delivered FOB destination and the Period of Performance will be from 1 October 2019 through 30 September 2024 as follows:

(viii) FAR 52.212-1, Instructions to Offerors—Commercial Items (Oct 2018) is hereby incorporated by reference with the same force and effect as if it were given in full text. The following items have been tailored to this procurement and are included via addendum:

1. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.

2. Specific Instructions: The response shall consist of two (2) separate parts:

a. Part 1 Technical Acceptability - Submit a one (1) page of narrative detailing how the offeror will meet the criteria and specifications in Attachment 1 paragraph’s 2.2, 2.3 and 2.4.

b. Part 2 Price - Submit one (1) copy of price schedule (Attachment 2).

3. Award will be made to the offeror whose proposal is conforming to the solicitation and is determined to be the lowest price technically acceptable. Technical Acceptability, at a

FA5000-19-R-A020 Page 3 of 14 6 August 2019 minimum, is defined as meeting all of the criteria and specifications in Attachment 1 paragraph’s 2.2, 2.3 and 2.4. Price and technical acceptability will be considered.

(ix) FAR 52.212-2, Evaluation—Commercial Items (Oct 2014) is hereby incorporated by reference with the same force and effect as if it were given in full text. The following items have been tailored to this procurement and are included via addendum:

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose proposal conforming to the solicitation will be most advantageous to the Government. The following factors shall be used to evaluate offers:

1. Factor I – Technical capability

2. Factor II – Price

(b) Price and technical acceptability will be considered. The Government intends to evaluate proposals and award without discussion, but reserves the right to conduct discussions.

Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a price and technical standpoint. The lowest priced proposal will be evaluated for technical acceptability. If the proposal is found technically acceptable, award will be made without further consideration. If it is found technically unacceptable, the Government will evaluate the next lowest proposal for technical acceptability until award can be made to the lowest priced technically acceptable offerors. Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. Proposals that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) This will be a lowest priced, technically acceptable purchase. Technical acceptability – at a minimum, is defined as meeting following criteria:

Minimum Qualifications: Contractor must be able to meet all of the criteria and specifications in Attachment 1 paragraph’s 2.2,

2.3 and 2.4.

(d) A written notice of award or acceptance of a proposal mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the proposal, shall result in a binding contract without further action by either party. Before the proposal’s specified expiration time, the Government may accept a proposal (or part of a proposal), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

DFARS 252.232-7006, WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (DEC 2018) is hereby incorporated by full text below:

(a) Definitions. As used in this clause-

“Department of Defense Activity Address Code (DoDAAC)”is a six position code that uniquely identifies a unit, activity, or organization.

“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.

“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall-

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the Web Based Training link on the WAWF home page at https://wawf.eb.mil/

(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:

(1) Document type. The Contractor shall submit payment requests using the following document type(s):

(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.

(ii) For fixed price line items

(A) That require shipment of a deliverable, submit the invoice and receiving report specified by the Contracting Officer. _N/A__

(3) Document routing. The Contractor shall use the information in the Routing Data Table below only to fill in applicable fields in WAWF when creating payment requests and receiving reports in the system.

(4) Payment request. The Contractor shall ensure a payment request includes documentation appropriate to the type of payment request in accordance with the payment clause, contract financing clause, or Federal Acquisition Regulation 52.216-7, Allowable Cost and Payment, as applicable.

(5) Receiving report. The Contractor shall ensure a receiving report meets the requirements of DFARS Appendix F.

FAR 52.217-8, Option to Extend Services (Nov 1999) is hereby incorporated by full text below:

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor not later than 15 days prior to contract expiration.

FAR 52.217-9, Option to Extend the Term of the Contract (Mar 2000) is hereby incorporated by full text below:

(a) The Government may extend the term of this contract by written notice to the Contractor not later than 15 days prior to contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 66 months.

(xiii) There are no financing arrangements or warranty items required.

(xiv) No Defense Priorities and Allocations System (DPAS) assigned rating applies to this acquisition.

PERFORMANCE WORK STATEMENT

FOR

REGULATED GARBAGE REMOVAL AND DISPOSAL

1 August 2019

1. INTRODUCTION

1.1 The purpose of this PWS is to obtain regulated garbage pickup from Joint Base Elmendorf Richardson to an off base facility for disposal.

2. SCOPE OF WORK

2.1 The Contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and services necessary to collect, package and transport regulated garbage as defined by law and required by this Performance Work Statement (PWS). The U.S. Department of Agriculture’s (USDA) Animal Health and Plant Health regulations are enforced by the Animal and Plant Health Inspection Service (APHIS), the Department of Homeland Security (DHS) and U.S. Customs and Border Protection (CBP).

2.2 The contractor shall transport regulated garbage to an appropriately licensed disposal facility;

licensing shall be in accordance with any and all laws, regulations and guidance (to include, but not limited to DHS, CBP, Environmental Protection Agency (EPA), USDA, APHIS, Alaska laws and regulations and any other governing body responsible for the management of regulated garbage cartage, handling, inspections, processing and disposal).

2.3 The contractor shall be capable of obtaining and maintaining unobstructed Joint Base Elmendorf- Richardson (JBER) access. The contractor shall be a registered and permitted regulated garbage hauler in accordance with all applicable regulations and laws which include but are not limited to DHS, CBP, EPA, USDA, APHIS, Alaska laws and regulations and any other governing body responsible for the management of regulated garbage cartage, handling, inspections, processing and disposal.

2.4 The Contractor shall first enter into a Compliance Agreement with APHIS before starting or performing any work required by this PWS. The Government requires a copy of this Compliance Agreement prior to starting any work required by this PWS.

2.5 All Contractor personnel are required to accomplish Antiterrorism Awareness Training for Contractors IAW DFARS Subpart 204.72 and implemented by DFARS Clause 252.204-7004.

2.5.1 In the event personnel cannot complete this training online, instructor-led training can be coordinated. The Contractor must coordinate with the CO and the COR to schedule a training for all required personnel with a base Antiterrorism officer. Upon completion of the training, the Contractor is required to submit the completed certificates with the base pass access request package.

3. GOVERNMENT FURNISHED SERVICES AND EQUIPMENT

3.1 Government furnished items will include regulated garbage, trash bags, weight tickets, inventory, origin of flight, and identification of regulated garbage.

3.2 Government services will include bagging and marking regulated garbage, transport of regulated garage from aircraft to 732d Air Mobility Squadron, Building 13272, regulated garbage storage facility, and weighing and storage of regulated garbage until picked up by contractor. The government is also responsible for notification to contractor of regulated garbage is ready for pickup. The 732d Air Mobility Squadron will maintain a log of all regulated garbage.

4. CONTRACTOR FURNISHED ITEMS AND SERVICES

4.1 Contractor furnished items will include vehicles and personnel required for pickup, transport, and disposal of regulated garbage picked up from 732d Air Mobility Squadron.

4.2 Contractor services will include everything required to perform this statement of work, including pickup of regulated garbage within 72 hours of notification of aircraft arrival with regulated garbage. The contractor is responsible for verifying, in writing, the 732d Air Mobility Squadron regulated garbage log which includes weight and number of bags of regulated garbage picked up from the 732d Air Mobility Squadron. The contractor is also responsible for transport and proper disposal of regulated garbage. The contractor must keep a log and/or any other documents per USDA, APHIS, and CBP requirements.

5. SPECIFIC TASKS

5.1 The contractor shall pick-up, transport, and dispose of Regulated Garbage from the operational area of the 732d Air Mobility Squadron, Fleet Services section located at 13272 Airlifter Dr, JBER, AK 99506.

6. DEFINITIONS

6.1 Waste to be disposed of include the following as defined by USDA APHIS.

6.1.1 Trash is refuse that neither contains nor is visually contaminated with regulated garbage.

Trash is not regulated by APHIS and is therefore unrestricted. For example, trash that solely contains empty soda cans would be unrestricted. Newspapers and magazines in the passenger cabin would also be unrestricted. An empty cardboard milk carton, sandwich, or fruit found in the passenger cabin, however, would be considered as regulated garbage as opposed to trash and would be restricted. AMC will dispose of all “Trash.”

6.1.2 Garbage is all waste material that is derived in whole or in part from fruits, vegetables, meats, or other plant or animal (including poultry) material, and other refuse of any character

Garbage is regulated by APHIS when the garbage is on or removed from a means of conveyance, if the means of conveyance has been in any port outside the United States and Canada within the previous two-year period or to any port in Hawaii or any United States territory or possession in the last one- year period. Garbage regulated by APHIS is hereafter known as “regulated garbage.”

6.1.2.1 Garbage, trash or other material not regulated by APHIS that is or has been commingled with regulated garbage is also regulated garbage.

6.1.2.2 Regulated garbage includes but is not limited to food scraps, table refuse, galley refuse, food wrappers or packaging materials and other waste material from stores, food preparation areas, passengers’ or crews’ quarters, dining rooms or any other areas on means of conveyance.

6.1.2.3 Regulated garbage also means meals and other foods that were available for consumption by passengers or crew on an aircraft but were not consumed.

6.1.2.4 Other materials that may be handled as regulated garbage include but are not limited to rejected cargo (consisting of plant or animal origin materials), illegally imported agriculture commodities found in commerce, and quarantine materials seized during inspection.

7. TASK PERFORMANCE

7.1 In addition to any requirements of the Contractor’s Compliance Agreement, the Contractor shall at a minimum perform the following tasks:

7.1.1 Once a flight with regulated garbage arrives at JBER, the regulated garbage will be transported by the government from the aircraft to the government provided storage located in the operational side of the 732 AMS Fleet Services.

7.1.2 The contractor has 72 hours to remove the Regulated Garbage after it is moved from the aircraft to the government provided storage located in the operational side of 732 AMS Fleet Services, after which the contractor will be notified—it is incumbent upon the contractor to ask when the aircraft arrived if said information is not relayed.

7.1.3 Report to 732 AMS Fleet Service management, sign Regulated Garbage weight verification log, and remove bags from the storage area.

7.1.4 Place Regulated Garbage into a licensed/insured transport vehicle.

7.1.5 Take to a regulated garbage treatment facility holding an operating license.

7.1.6 The Contractor will sign the Regulated Garbage weight verification log sheet inside of 732 AMS Fleet Services holding facility prior to leaving JBER, and complete any forms/documents

The Contractor’s logs must match the Regulated Garbage weight verification log before invoices will be accepted in Wide Area Work Flow. The per pound weight calculation will be rounded to the nearest whole number: 0.5lbs and above will be rounded up to the nearest whole number and 0.4lbs and below will be rounded down to the nearest whole number. The Contractor shall forward all logs to the personnel designated by the Contracting Officer.

7.1.7 Complete all necessary documentation required per the Contractor’s Compliance Agreement.

7.1.8 Transport regulated garbage to an approved regulated garbage treatment facility, and treat/dispose of the Regulated Garbage per the Contractor’s Compliance Agreement.

7.1.9 If certification is required (per applicable laws, regulations and/or compliance agreements), the Contractor shall certify that the Regulated Garbage has been treated and disposed of per the Contractor’s Compliance Agreement.

7.1.10 The Contractor shall promptly disinfect transport vehicles and/or containers which have had untreated regulated garbage leaked or spilled onto them per the terms and conditions of the Contractor’s Compliance Agreement.

7.1.11 The Contractor will sign the Regulated Garbage weight verification log sheet inside of 732 AMS Fleet Services holding facility prior to leaving JBER, and complete any forms/documents listed in Contractor’s Compliance Agreement. The Contractor’s logs must match the Regulated Garbage weight verification log maintained by the 732d Air Mobility Squadron before invoices will be accepted in Wide Area Work Flow. The per pound weight calculation will be rounded to the nearest whole number: 0.5lbs and above will be rounded up to the nearest whole number and 0.4lbs and below will be rounded down to the nearest whole number. The Contractor shall forward all logs to the personnel designated by the Contracting Officer.

7.2 In the event the contractor is unable to perform the duties required, it is his/her responsibility to pay the difference between their cost and the alternate service provider cost, absorbing any and all cost associated with utilizing their alternate service provider as per their USDA compliance agreement. Contractor is responsible to pay the difference between their cost and the alternate service provider cost.

8. HOURS OF OPERATION

8.1 Operating hours of the 732d Air Mobility Squadron are 24 hours a day, 7 days a week.

8.2 Contractor is expected to be able to perform duties outlined in this PWS 24 hours a day, 7 days a week, to include holidays, to be able to meet the required 72 hour pickup timeline.
