ADDENDUM TO 52.212-2

ADDENDA TO 52.212-2

EVALUATION CRITERIA

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

Technical and past performance, when combined, are approximately equal to cost or price.

This award selection will be conducted using the procedures (as specified herein) from the policies and procedures contained in the Federal Acquisition Regulation (FAR) LPTA-Lowest Price Technically Acceptable selection process shall be applied. Award will be made to the Offeror who is deemed responsible and responsive that reflects a complete understanding of the specifications for the Request for Proposal. Award shall be made to the technically acceptable offer with the lowest evaluated price. The Government reserves the right to refrain from awarding to any contractor in the event that all Offerors progressing beyond the technically acceptable evaluation are determined to have offered pricing that is not considered realistic, reasonable, or complete. To arrive at an award decision, the Contracting Officer (C.O.) will integrate the Technical Evaluation Team results based on the factors described in the paragraphs that follow. To be eligible for award, a proposal must meet all technical requirements, conform to all required terms and conditions, including FAR 52.212-1 Addendum, and include all information required.

If the lowest priced evaluated offer is judged to have an “Acceptable” technical rating, has an “Acceptable” performance rating and is determined to be responsible, that offer represents the best value for the government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers.

In the event that the government does not make an award pursuant to the paragraph above, the government reserves the right to award a contract to other than the lowest priced offer if that offeror is judged to have a technical or performance assessment rating of “Unacceptable”. In that event, the Technical Evaluation Team shall evaluate the next lowest priced offer until all criteria have an “Acceptable” rating.

The government intends to award a contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest.

The proposals will be evaluated on the basis of the evaluation factors listed below. The technical and past performance areas will be evaluated on an "acceptable" or "unacceptable" basis. Only those contractors determined to be technically acceptable will be evaluated on price. The following areas will be evaluated:

(a) Price - Total price reasonableness and completeness

(b) Technical - (acceptable/unacceptable)

(c) Past Performance - (acceptable/unacceptable)

A. PRICING

At a minimum, offerors shall fill out Pages 3 - 9 of the SF 1449 of this solicitation to be evaluated on price and to be considered for award. Initially offers shall be ranked according to price.

B. TECHNICAL ACCEPTABILITY

Part II, Technical Acceptability, will be evaluated on an acceptable or unacceptable basis. Offers shall be examined for their installation plan and -if necessary- the plan for modifying the Milnor Press to integrate with their new equipment.

a. If a contractor’s technical proposal is determined to be unacceptable, those offerors will be excluded from further consideration and will not be considered for award.

The Technical Evaluation Team will rate the technical proposals according to the table listed below:

Table A-1. Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

At a minimum, the following specific information shall be addressed in the offerors technical capability to demonstrate the offeror has a thorough understanding of the requirement:

1. To be deemed technically acceptable the proposed contractor shall demonstrate knowledge of the overall project and technical requirements to include full compliance with all elements and sections of the solicitation. The proposal must, at a minimum, meet specification and regulations stated in the solicitation, to include but not limited to commercial standards. Examples of demonstrating knowledge of project requirements include, but is not limited to: written narrative describing how the project will be accomplished, drawing outlining the contractor’s plan, other technical plans and specifications to complete the requirement, Milnor press modification plan (if necessary), and tunnel system design.

2. Provide a mobilization and installation schedule to identify how the offeror intends to meet the required installation timeframe. The schedule must be clearly outlined on an easily understandable document. To be considered minimally acceptable the schedule must not exceed 2 weeks (14 days) for overall installation to include maximum of 10 calendar days for mobilization.

C. PAST PERFORMANCE

The contracting officer shall seek relevant performance information based on (1) the references provided by the offeror, and (2) data independently obtained from other government and commercial sources. Relevant performance includes efforts involving the supply and installation of Batch Laundry Equipment that are similar or greater in scope, magnitude, and complexity than the effort described in this solicitation. Recent performance is contracts within the last three (3) years.

The Technical Evaluation Team will rate the past performance of contractors according to the table listed below:

Table A-2. Past Performance Evaluation Ratings

Rating Description Acceptable Based on the offeror’s performance record, the

Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “unacceptable.”

a. The assessment process will result in an overall performance confidence assessment rating of “Acceptable” or Unacceptable” as defined above. The purpose of the past performance evaluation is to allow the government to assess the offeror’s ability to perform the effort described in the solicitation, based on the offeror’s present and past performance. The government reserves the right to seek information on higher priced offerors if none of the lower priced offerors receive an “Acceptable” performance assessment rating. Past performance regarding predecessor companies, key personnel who have relevant experience, or sub-contractors that will perform major or critical aspects of the requirement will be considered as highly as past performance information for the principal offeror.

b. In evaluating past performance, the government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this solicitation.

c. Offerors are cautioned to submit sufficient information and in the format specified in the proposal preparation instructions to permit a meaningful assessment of past performance. Offerors may be asked to clarify certain aspects of their proposal or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revision.
