Section L.8.10 requests offerors to address Adverse Past Performance, however Section L.8.1 does not include an Adverse Past Performance section or a required page limitation. Will the Government please add the Adverse Past Performance section, as well as its page limitation, to Section L.8.1, Past Performance Volume Contents?

Page # 9 and 10, Para. 8.1 and 8.10 Only adverse past performance to which an offeror HAS NOT been given the opportunity to address is affected by this section. Adverse past performance from systems such as CPARS, in which offerors are given an opportunity to review and respond to inputs, should not be addressed in the proposal. If submitting adverse past performance not previously addressed, offerors must address within the current page limitations of section L.8.10. The Government will revise Section L to further clarify the intent of section L.8.10.

Section L.8.6.e, PPI Contents, lists SAM Unique Entity ID (UEI), CAGE Code & DUNS Number. Since the Federal Government replaced the DUNS Number with the UEI, will the Government please remove the requirement for DUNS Number in Section L.8.6.e?

Section L.7.2.5: In order to ensure that all offerors are pricing to the same requirements, we recommend that each offeror be required to provide an explanation of how they intend to address compliance with host country labor laws. This will also ensure the Government is able to confirm compliance within the technical to properly assess risk.

7.2.5.2, 7.2.5.3 Section L, Para 9.6, requires offerors to comply with Host Nation (HN) Laws. The

Government does not anticipate changing these sections.

Discussion:

RFP 7.2.6.4 requires offerors to provide “The company’s retention rates and fill rates on Federal contracts for the past three years to demonstrate its experience in retaining personnel.”

Concerns:

1. There is no way for the Government to standardize or validate the rates provided by offerors. These metrics are measured, calculated, and captured across industry differently by each company. There is no way for the Government to verify accuracy or fairly evaluate one offeror’s numbers against another’s.

2.There are significant differences between a company’s ability to fill positions and retain employees for CONUS

vs. OCONUS sites and, in some instances, between OCONUS sites of varying quality of life (Germany vs. Iraq).

Companies with more extensive experience in the AFCENT AOR are likely to have lower retention/fill rates than companies who primarily operate on CONUS contracts. We believe that an evaluation based purely on retention and fill rates will negatively impact offerors with the most experience in the AFCENT AOR.

Recommendation:

Request the Government consider these influencing factors when determining the solicitation requirement for retention and fill rates. Recommend the following change to the Section L.7.2.6.4 requirement:

“Discuss the company’s historical ability to retain employees on Federal OCONUS contracts (preferably within the AFCENT AOR) and success at backfilling positions when vacancies occur."

SAM.gov posting mentioned a tentative timeline for Final RFP release in December. Is this still an accurate projection?

N/A General Timeline The Governments intent is to release the RFP in Dec, however, many factors may require adjustment. Changes to the timeline will not be posted to SAM.gov, however, offerors should monitor the system to ensure they don't miss the posting of the RFP.

Previous Section L from the last RFP stated: “This solicitation will not permit foreign contractor participation.

Foreign contractors will not be permitted as the prime contractor due to the required security classifications. A non- US company cannot receive the required Secret Facility Clearance for this contract and thus are prohibited from submitting proposals.”

Does this restriction still apply?

2018 Final RFP pg. 92 of 110, Section L

No. Foreign contractors with an approved/active agency National Interest Determination (NID) at time of submittal of proposal will be considered. Proposals with NID actions pending approval will not be considered for evaluation.

Does the Government plan to conduct a site visit? If so, does the Government have dates scheduled? N/A General Timeline Based on feedback from the Industry Day, the Government is considering a Virtual Site

N/A General Timeline The Government is considering a 30 day RFP response timeline, however, the response period may be adjusted if in the best interest of the Government.
