1Solicitation144In reference to Mentor-Protege Joint Ventures, CFR § 125.8(e) states:

Capabilities, past performance and experience. When evaluating the capabilities, past performance, experience, business systems and certifications of an entity submitting an offer for a contract set aside or reserved for small business as a joint venture established pursuant to this section, a procuring activity must consider work done and qualifications held individually by each partner to the joint venture as well as any work done by the joint venture itself previously. A procuring activity may not require the protégé firm to individually meet the same evaluation or responsibility criteria as that required of other offerors generally. The partners to the joint venture in the aggregate must demonstrate the past performance, experience, business systems and certifications necessary to perform the contract.

Question:

Will the government please confirm that proteges in a Joint Venture (JV) under the All-Small Mentor/Protégé Program (ASMPP) are exempt from submitting PPI and it is allowable for the mentor to submit all three performance references?

A suggested edit is below:

(4) Joint Ventures. In the case of a Joint Venture, the offeror must provide a max of (3) performance references (finalized CPARS are requested) on the Joint Venture itself as the Prime. If the Joint Venture itself has no recent/relevant performance history as a Prime, then the offeror must submit at least one finalized CPARS for each JV member (except mentor/protege joint ventures covered under 13 CFR § 125.9 in which case the mentor PPI will suffice). The government will also accept past/present performance information from each JV member where they performed as a major subcontractor if the portion of the work completed was similar in size/scope to this requirement.

3PWS61.4.2.8States a Quality Control Plan (QCP) shall be formulated and submitted concurrently with the proposal, and Question 13 of 3 Feb Q&A states QCP is part of the ISD Management Plan (ISDMP). As a QCP can be up to 25 pages all by itself, industry requests that the QCP be submitted separately from the ISDMP, and as Appendix C to the technical proposal, not included in page count, and that this information be added to the Solicitation Instructions to Offerors. This will allow the submittal of a valid plan with the proposal that is executable upon contract award.Revised PWS to direct ISDMP be submitted within 10 business days of contract award. Page count increased to 50 pages.

As the ITCP can be up to 25 pages alone, Industry requests that the ITCP be submitted as Appendix D to the technical proposal and not be included in the page count, and that this information be added to the Solicitation Instructions to Offerors. 6Q&As, PWSQ&A#1Questions: 1.4.2 - "…provide an ISD Management Plan to the Contracting Officer concurrently within 10 business days of contract award." Appendix 4 identifies the ISDMP as being submitted with the proposal. Will the Government please clarify if the ISDMP is to be submitted with the proposal or not?

Govt Answer: Please see revised PWS. ISDMP shall be provided with proposal.

Please clarify: Within the revised Solicitation of the amendment 0003, there are no provisions within Section L (Instructions) or Section M (evaluation criteria) to address providing the ISDMP. If the ISDMP is to be provided within the propsoal, we respectfully request be incorporated into the Section L Instruction requirements and the ISMDP not be counted in the 25 page limit of the technical volume.Revised PWS to direct ISDMP be submitted within 10 business days of contract award. 7Q&As, PWSQ&A#5, Q&A#23,
Q&A#35, Q&A#36, Q&A#37The only requirements defined in the Solicitation Section L are to provide 1) Manning Anaylsis, and 2) TWMP. There are no requirements specificed in the Section L or M to provide an ISDMP, QCP, Phase-in/out plan, and ITCP, though these are requirements fo the PWS. The page limit for the technical volume is currently 25 pages, which is insufficient to provide all of these plans. The PWS requires that the ISDMP alone include at least 13 full sections, many of which will consist of multiple pages; previously our submissions for the required plans have totaled more than 85+ pages combined. We recommend the ISDMP, QCP, Phase-in/out Plan, and the ITCP be excluded from the 25 page limit, increase the page limit to 100 pages, or not require these plans to be provided in the proposal, retaining the 25 page limit for the technical volume. Precendence is based on the previous RFP FA4890-17-R-0013 where all plans were required, but the page limit for the technical volume was 100 pages of which we utilized 85 to meet the requirements and had a technically acceptable proposal. If the Government desires all the PWS plans to be provided in the proposal, we respectfully request the Government amend the Section L insturctions and Section M to reflect the requiremetns for the Manning Analysis, TWMP, ITCP, ISDMP, QCP, and the Phase-in/out Plan. Additionally we request the proposal due date extenion from 13 Feb 2023 to 27 Feb 2023 to provide bidders to provide resposive proposals. We also believe there will be significant timeline impact to the mission and elevated mission performance risks should the Section L be in its current state, requiring only the TWMP and Manning Analysis, but the Government evaluate the proposal requiring the ITCP, ISDMP, QCP, Phase-in/out Plan, not currently in the Amendment 0003 combined solicitation Section M Evaluation Criteria.Revised PWS to direct ISDMP be submitted within 10 business days of contract award. Page count increased to 50 pages. Please see PWS Appendix 4 A4.1.1 for list of deliverables to be provided with proposal.
