As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
The Government will award a contract resulting from this solicitation to the responsible offeror whose proposal conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Contract award will be made to the contractor found technically acceptable with a Green or better Supplier Performance Risk System (SPRS)rating with the lowest price. Technical rating will not be an evaluation factor but rather it will first be determined whether or not the contractor meets technical acceptability and then the proposal will be evaluated based on the evaluation factors; past performance and price.
The government will conduct a tradeoff analysis of the past performance and price factors of technically acceptable proposals.
The following factors shall be used to evaluate offers:
1) Technical Acceptability
2) Past Performance
3) Price
1) Technical acceptance is based on the proposal conforming to the overall specifications set forth in the performance work statement. The contractor should indicate that their proposal meets all specifications.
2) Past Performance -
Evaluation of a vendor's past performance will be accomplished in an efficient and minimally burdensome fashion. Past performance history in SPRS will be assessed based on the color legend below. The percentage is based on past projects that have been evaluated and reported. A color rating is assigned based on the performance. Blue being the best and red being the worst. If a vendor does not have past performance history in SPRS, a Green rating will be assigned.
Blue: Top 5%
Purple: Next 10%
Green: Next 70%
Yellow: Next 10%
Red: Lowest 5%

Contract award will be made to the contractor found technically acceptable, with a Green or better SPRS rating, with the lowest Total Evaluated Price (TEP). An offeror's Total Evaluated Price (TEP) will be determined by the sum of all separately priced CLINS as presented in Supplies/services section. If a separate CLIN and a TEP (as applicable) are not included, or are not clearly stated, miscalculated and/or understandable, the offer will be rejected as non-responsive.
Evaluation Process:
Step 1: Proposals received and sent for technical evaluation.
Step 2: Technically Acceptable proposals are separated and evaluated for past performance within SPRS.
Step 3: Remove technically acceptable offers below the Green rating.
Step 4: Award to lowest TEP.
* In the event that the SPRS system is down during the evaluation period of this solicitation, proposals will be evaluated in the same manner using
CPARS rather than SPRS. CPARS has assigned ratings scored as below and the same color system has been assigned for evaluation.
(Blue) - One (1): Exceptional
(Purple) - Two (2): Very Good
(Green) - Three (3): Satisfactory
(Yellow) - Four (4): Marginal
(Red) - Five (5): Unsatisfactory
* Note: The system of evaluation will only change if SPRS is unavailable during evaluation. *
(b) . The Government will evaluate offers forward purposes by adding the total price for all options to the total price for the basic requirement. The Options Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
