1. Introduction: This Statement of Work (SOW) sets forth basic requirements for Project NUEX 09-1448-7, Relocate FW/XP to B465. This construction project will require performance at Luke Air Force Base, Arizona. This SOW implements Design Build as a viable process for fulfilling the 56th Fighter Wing, Luke AFB, AZ, design and construction requirements. This project will be a renovation of Building 465 to accommodate the 56th FW Plans and Programs staff. The Contractor shall conduct meetings with Contracting and Civil Engineering. The existing infrastructure and work scope will require inspection to identify the extent of the current deficiencies. It must be acknowledged by the contractor that the work scope includes complete review of the facility and preliminary documents, validation of the preliminary work and standards referenced, and identification of deficiencies against present day standards for an Air Force and DOD building. The renovation will include, but is not limited to: replacing the HVAC system and associated ductwork and registers; repairing the roof; the demolition of walls and associated electrical and communications, floor coverings, doors and ceiling grids; the relocation of light fixtures, mechanical diffusers, and fire protection devices; and the installation of new walls, electrical and communication outlets/wiring, ceiling grids, paint, floor coverings, cove base and doors.
History: Luke Air Force Base, Arizona is a training base for the Air Education and Training Command (AETC) and is part of the general defense preparedness system of the United States Armed Forces. The 56th FW XP staff is currently housed in Building 416. The area occupied by the XP staff will be used to consolidate another squadron in support of future mission requirements. As such, Building 465 must be renovated to support the XP function. This facility site is located in the central part of the developed area of the base near the intersection of Fighter Country Avenue and Mustang Street.
2. Purpose: This project will renovate Building 465 on Luke Air Force Base by procuring design services, material, and construction to upgrade the facility. Under this contract, the contractor may be tasked with validating construction price/cost and scheduling. During the construction phase, the contractor will complete project design and construction, and will deliver and warrant the facility. The objective of this project is to deliver complete and usable repairs to the existing facility, such that it supports the present day mission and meets present day standards.
3. Design-Build: Essentially, Design-Build (D-B) is intended to facilitate the contractor’s long-term understanding of the Air Force’s project requirements, and will allow for independent surveys of existing conditions, collaborative participation, and resolution of building concerns prior to the start of construction. Given the contractor’s envisioned level of involvement, the contractor will serve as both the Architect of Record for the completed project, as well as the Contractor of Record. The contractor shall manage and perform D-B construction work as defined in this contract, to include completion of working drawings, permitting, construction, construction management, scheduling, inspection and testing, maintaining construction facilities and temporary controls, environmental protection, quality control, construction quality control, and project closeout.
A. Concept Definition: During the concept definition (CD) effort, the contractor will utilize a professional consultant, herein after referred to as the CD A/E. The provider of CD services is responsible for the development of the CD products from the information included in this SOW. Specifically, the effort will result in documents that are the basis for the design and construction efforts under this contract. This effort necessarily includes development of a design basis (to include applicable codes, standards, and guidance) and outline specifications.
B. Planning and Programming: The CD A/E (consultant) will provide investigative services, actively participate in constructability reviews of planning/programming documents, and prepare or assist with the preparation of the planning/programming documents. The results will be incorporated into the documentation. The project/program specific requirements are specified herein, and include, but are not limited to, site investigation, hazardous material surveys, topographical surveys, traffic studies, base comprehensive compliance surveys, utilities locating and surveying, maintainability and constructability reviews, programmed amount validation, construction permitting, environmental permitting, value engineering, site study and selection, requirements document development, project management plan development, DD Form 1391 preparation, and other project and/or program planning/programming activities required to satisfy higher authority requirements.
C. Project Definition: The CD A/E (consultant) will provide investigative services, actively participate in constructability reviews of concept definition products, review and validate estimated project costs against the construction cost limitation (CCL), and assist in the preparation of proposal documents for the renovation. It is the intent of the Government to require the contractor to build on the results of these studies and investigative services as part of its cost, scope, and standards validation efforts and again during the design and construction phases of the project. The results of all surveys, investigations and constructability reviews may be incorporated into the project’s final definition documents at the discretion of the Government. The details in this regard will be developed with Luke Engineering personnel.
D. Concept Definition/Design: The project/program specific requirements are specified herein. The emphasis during the concept definition activities is ensuring the development of a product that clearly defines the project requirements in terms of either performance, appearance, criteria and/or specification with enough detail that the contractor can provide a quote with reasonable performance, cost (within the Construction Cost Limitation) and schedule risk. Greater emphasis shall be placed on maintainability, constructability, construction cost validation, and satisfaction of customer requirements and needs.
E. Technical Services: The contractor is the “Architect of Record” and, as such, will sign and seal all completed designs. The contractor is accountable for all aspects of the final design under Federal, State and applicable local laws. WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour
Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the
Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the
Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations
Wage and Hour Division
U.S. Department of Labor
200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator
(See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative
Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board

ARIZONA PRIVILEGE TAX INFORMATION (APR 1999)
There are certain Arizona Taxes that are applicable to any contract. The offeror may contact the State of Arizona, Revenue Department, Sales Tax Audit Section, 1160 W. Monroe, Phoenix, AZ 85007, to determine the taxes and the base upon which such taxes must be paid. Such taxes, if any, shall be considered as being included in the offeror’s price as stated in the bid schedule. These taxes are applicable to out-of-state as well as in-state firms.
Arizona Revised Statues (A.R.S.) 42-5061, Retail classification, imposes the transaction privilege tax on the business of selling tangible personal property at retail. A.R.S. 42-5061 (V)(3) defines “selling at retail” as a sale for any purpose other than for resale. Therefore, sales intended for resale are not taxable. The tax base for the retail classification is the gross proceeds of sales or gross derived from the business. All retail sales are subject to tax unless specifically exempted by statute.
COMMODITIES AND SERVICES
“Sales made directly to the United States government or its departments or agencies by a manufacturer, modifier, assembler or repairer” are not subject to tax (A.R.S. 42-5061(K)(1)). Note: Only sales by a manufacturer, modifier, assembler or repairer are 100% exempt. However, all other sales “made directly to the United States government or its departments or agencies” are deductible from the retailer’s tax base at a rate of 50% (A.R.S. 42-5061(L)).
CONSTRUCTION
A.R.S. 42-5075(B), Prime contracting classification, indicates that the tax base for prime contracting is 65% of the gross proceeds of sales or gross income derived from the business. Sales of tangible personal property to a person engaged in the business of prime construction contracting are not subject to tax if the property is incorporated or fabricated into the real property or project (A.R.S. 42-5061 (A)(27)).
