I. Contracting Activity.

HQ USMTM Contracting

II. Nature and/or description of the action being processed.

Solicitation of Brand Name or Equal Requirement that will result in a new contract.

III. Description of supplies/services required to meet agency needs.

Provide installation, training, operation, and sustainment of intrusion detection system (IDS), access control system (ACS), and closed circuit television (CCTV) system at two office buildings located at Al Nakhla Residential Resort. Installation and training will take place within the base year while operation and sustainment will continue for up to four option years. Will be funded with Foreign Military Sales (FMS) funds.

IV. Statutory authority permitting other than full and open competition.

10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901)

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The required brand name or equal must meet requirements of IC Technical Specifications for ICD/ICS 705, Chapter 7, DoDMs 5200.1 and 5200.2, and Army Regulations 380-5, 190-11, and 190-13.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

A Sources Sought was sent out. Included was a redacted SOW that stated contractor requirements such as Facility Clearance and brand names. Will solicit on beta.SAM to ensure maximum participation.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The anticipated cost to the Government will be fair and reasonable as this requirement has a high probability of competition.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Sources Sought was posted in January. There were 13 responses to the Sources Sought. This along with internet searches and talks with industry show that there are multiple contractors ready and willing to participate in this acquisition.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

This requirement is for the installation of a security system at an overseas location. It is imperative that the acquisition ensures that all applicable DOD and Army security regulations are upheld.

X. List of any sources that expressed, in writing, an interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The or equal allows contractors with sufficient licensing to take over maintenance of the system after the initial maintenance period is over. This will allow multiple contractors the opportunity to win future contracts related to this project.

XII. Certification by the Contracting Officer.

As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.
