PERFORMANCE WORK STATEMENT

FORKLIFTS & LIGHT ALLS

SAIPAN INTERNATIONAL AIRPORT

1.0 SCOPE OF WORK. In accordance with the schedule of services to be provided upon issuance of a solicitation, the contractor shall provide all qualified personnel, supervision, transportation, maintenance, operating costs, equipment to unload, tools, materials, fuel, and any other necessary supply or service to accomplish the complete performance of the services requested within the Performance Work Statement.

2.0 DESCRIPTION OF SERVICES. The contractor shall provide equipment to perform operations in accordance with requirements specified by the Contracting Officer or their designated in writing representative. A listing of the provided equipment is as follows:

0001 – Forklifts (2 each)

- Caterpillar or equivalent

- 10K All Terrain

- Height: 10’5” (125”)

- Tines: 75” Length x 8” Wide

0002 – Light Alls (10 each)

- Mobile Light Tower (MLT4200) - 20kW – Diesel – 23.3 feet – 320W LED or equivalent

- Must be mobile (trailer preferred)

- Must be self-powered via 20kW diesel generator

Equipment to be delivered to Saipan International Airport on 8 July 2025. Equipment to be picked up by contractor from Saipan Internation Airport on 8 August 2025.

2.1 Equipment Condition: The contractor shall provide equipment with adequate fuel, oils, insurance, repair, maintenance, and any other operational costs. All equipment systems shall be operative and kept in line with manufacturer’s recommended maintenance program.

2.2 Equipment Maintenance: The Contractor shall ensure each piece of equipment meets or exceeds the following minimum maintenance standards at the time of acceptance and throughout the rental period. The contractor is responsible for all scheduled and unscheduled maintenance of equipment. The contractor shall provide all parts and labor necessary to complete required maintenance tasks. Maintenance shall be performed according to the manufacturer’s recommended maintenance schedule. If the contractor’s scheduled or unscheduled maintenance results in the Government losing use of a piece of equipment for more than 24 hours, the Contractor shall provide replacement equipment of a comparable make and model for the Government to use.

2.3 Delivery: The Contractor shall ensure delivery of all equipment by the date specified in the period of performance. Each piece of equipment must pass an acceptance inspection before the Government takes possession. The equipment shall also be recovered by the Contractor from the respective locations at the conclusion of the lease period.

2.4 Recovery/Replacement: Upon proper notification, the contractor shall recover disabled equipment within 24 hours of notification by the Government. The Contractor shall provide replacement equipment for all disabled equipment at the time of recovery.

3.0 DAMAGES. The U. S. Government shall not be responsible for acts of God that may result in damage to any supplies or services provided (i.e., hailstorms, thunderstorms etc.). In addition, the government shall not be responsible for normal depreciation to the equipment/supplies provided. For purposes of this contract, “normal depreciation” is defined as the wear and tear that can reasonably be expected to result given the supplies or services use by equipment-laden troops in a harsh environment. Normal depreciation includes, but is not limited to, minor scratches and dents to equipment interior/exterior. The government will only be responsible for damage in excess of normal wear that results from negligence, neglect, or similar acts of the USG. All contractor claims for damage by the government should be submitted to the contracting officer for consideration in accordance with FAR part 33.2.

4.0 HOLIDAYS. The contractor may be required to work during holiday periods in accordance with the periods of performance and delivery schedules required.

5.0 POINTS OF CONTACTS AND AUTHORITIES. The Contracting Officer is the only person authorized to approve any changes to the requirements of this contract and not withstanding provisions contained elsewhere in this contract, the authority remains solely with the Contracting Officer. In the event the contractor effects any change at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price as a result of the change.

6.0 QUALITY ASSURANCE. The Contractor shall maintain a quality control program to ensure services are performed in accordance with commonly accepted commercial practices.

The contractor shall, if any of the services provided do not conform to the contract requirements, be required by the U.S. Government to re-perform the services in conformity with the contract requirements, at no additional expense to the Government.

7.0 GOVERNMENT FURNISHED FACILITIES, SUPPLIES, EQUIPMENT AND

SERVICES. None.

8.0 LIABILITY. The U.S. Government accepts no liability for the actions of the contractor or his employees and agents.

9.0 MANAGEMENT. The contractor shall designate a Contract Manager, who is responsible for the contract operations and is available to the Contracting Officer and designated government representative. The contractor shall provide in writing the name and contact information for the Contract Manager within five (5) days after award of this contract. Contractor Manager will be made available during the Period of Performance dates. When contacted, the Contractor Manager must respond within one (1) hour whether by phone or email correspondence. Contractor personnel shall, at all-times, be under the supervision of the contractor and not under the supervision of the U.S. Government or any of its officers or employees. The Contracting Officer will bring discrepancies or noncompliance with the contract clauses, specifications, or Performance Work Statement to the attention of the contractor’s supervisor or foreman for necessary corrective action. The Contractor shall immediately notify the Contracting Officer upon contractor determination of inability to perform.
