OLD PWS, para 1.14

1.14 Data Rights.

This section is in direct conflict with - Intellectual Property Law, DFARS 252.227-7013 Rights in Technical Data--Noncommercial Items, and 252.227-7014 Rights in Noncommercial Computer Software and Noncommercial Computer Software Documentation.

In the past two years similar verbiage has been listed in multiple RFPs-PWS for medical services (POTFF, HPP, etc.) for the USAF and the language has been repeatedly removed from the PWS by multiple USAF Contracting Officials because of the section's conflict with Federal Law.

We are requesting that this section be removed upon contract award.

The PWS does not request the contractor to provide any non-commercial items or computer software so DFARS 252.227-7013 and -7014 are inapplicable to the contract.

This section is merely referring to any training or rehabilitation programs a contract employee may develop in performance of this contract as well as any patient profiles. The Government requires unlimited rights to this type of data.

File details come from the government source that posted it.
