About this file

This is a Sole Source (Including Brand Name) Justification document for the procurement of 100 Selector Valves (P/N: 8411E6D2P or AD-2331509-1; NSN: 4820-00-022-3379) by the 325th Contracting Squadron at Tyndall AFB. The justification supports a brand name/part number restriction for the selector valve, which is an integral component of the BAK-12 energy absorber's rewind system used for stopping tail-hook equipped fighter aircraft during emergencies.

The document establishes that while multiple vendors (ATECH Inc., Curtiss-Wright Fluid Control Services/ESCO, and Parker-Hannifin) can supply the specific valve, the exact part numbers are required for proper form, fit, function and configuration conformity as specified in Aircraft Arresting Barrier Technical Orders 35E8-2-5-1 and 35E8-2-5-4. The procurement will be conducted through a Request for Quote (RFQ) on SAM.gov to ensure maximum competition among qualified suppliers. The acquisition is conducted under AFFARS 5313.501 authority, and market research confirmed that standard government sources (FPI, AbilityOne, GSA, DLA) cannot fulfill the requirement.

CONTROLLED UNCLASSIFIED INFORMATION

I. Contracting Activity.

325th Contracting Squadron, 105 Mississippi Rd., Bldg 36235, Tyndall AFB, FL 32403

II. Nature and/or description of the action being processed.

Brand name/part number restriction for Selector Valve

III. Description of supplies/services required to meet agency needs.

CLIN 0001 - Valve Selector; P/N: 8411E6D2P or AD-2331509-1; NSN: 4820-00-022-3379; Quantity: 100 each Both part numbers refer to the same item.

IV. Statutory authority permitting other than full and open competition.

AFFARS 5313.501 - 10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901)

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The selector valve is identified in Aircraft Arresting Barrier Technical Order 35E8-2-5-1 (Operation and Maintenance Instructions) and 35E8-2-5-4 (Illustrated Parts Breakdown). The specific selector valve is required for proper form, fit, function and configuration conformity. Failure to procure the technical order approved selector valve could result in improper system operation to reset the aircraft arresting system/energy absorber to the ready position. In addition, these systems are fielded globally with critical parts/components being standardized to minimize operational and spare provisioning costs as well as eliminating long-term impacts and increased integration costs of non-standardized selector valves.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

To ensure maximum competition, the government will post a Request for Quote (RFQ) on SAM.gov so that all interested parties in the commercial marketplace have the opportunity to submit an offer.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Adequate competition is reasonably expected for this procurement. Prior to contract award, the anticipated cost to the government will be fair and reasonable as required by FAR 13.106-3.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

IAW FAR Part 8, Market Research indicates that Federal Prison Industries (FPI), AbilityOne, GSA and all relevant Strategic Sourcing platforms cannot fulfill this requirement. The required items are not available via Defense Logistics Agency (DLA) due to the warehouses currently not having the required items in stock. The market research results show that items are available from multiple vendors; ATECH Inc., Curtiss-Wright Fluid Control Services/ESCO, and Parker-Hannifin (manufacturer and distributor) therefore one large business and multiple small businesses are capable of fulfilling this requirement directly or through the distributor.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

The selector valve is an integral component of the BAK-12 energy absorber's rewind system. The BAK-12 and Mobile Aircraft Arresting System (BAK-12 on a specialized trailer) purpose is stopping tail-hook equipped fighter aircraft on aborted take-off (engine failure) or when declaring an in-flight emergency requiring the aircraft to engage the runway barrier to prevent potential damage to the airframe and/or loss of aircrew. Any deviation from the part required or the Technical Order specified has potential to cause harm to Government personnel and equipment. The form, fit, and function of the selector valve must be specific enough as such that only one will meet the needs and intent of the Government's requirement.

X. List of any sources that expressed, in writing, an interest in the acquisition.

N/A

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The user and contracting agency will continue to survey the market place to locate any new prospective brands and contractors who are able to provide the needed requirement.

XII. Certification by the Contracting Officer.

As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.

XIII. Certification by the technical/requirements personnel.

As evidenced by my signature above, I certify that any supporting data contained herein, which is my (our) responsibility, is both accurate and complete.
