Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
1. Lowest Price
2. Technically Acceptable
*Technical Acceptability is achieved when offeror provides proof, in the form of a technical narrative, that the offeror meets the minimum standards of the requirement identified in the Attachment 1 - salient characteristics. Each offeror's technical narrative (no more than 5 pages) will receive a rating (acceptable/unacceptable).
The Government will then evaluate the first three (3) lowest prices offers for technical acceptability and assign a technical rating of acceptable or unacceptable. If all three
(3) offers are technically acceptable, no further offers will be evaluated. However, if any of the first three (3) are found to be technically unacceptable, the Government will continue to evaluate offers until there are three (3) technically acceptable offers.
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
