Description This is a combined synopsis/solicitation for commercial products/services prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, “Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation will not be issued.
This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-01, 30 Dec 2022.
The associated North American Industrial Classification System (NAICS) code for this procurement is 237120, with a small business size standard of $45 Million dollars.
All responsible sources may submit a response which, if timely received, must be considered by the agency.
The 49 CES at Holloman AFB, NM, is seeking Fuel Tank Repairs in accordance with the ‘Statement of Work’ at Attachment 1. The New Mexico Environment Department requires that all work on this project be completed by certified personnel meeting the requirements of New Mexico Administrative Code (NMAC), Paragraphs 20.5.105.501 and 20.5.105.504. A list of currently known certified personnel and companies is attached at Attachment 2.

Site Visit There will be a site visit held at 9:00 A.M. Mountain Time on 31 MAY 2023. All interested parties will meet at the Holloman AFB Visitor’s Center at the appointed time. A Background Consent Form will be required for installation access for all offerors that do not already possess the necessary access. Upon written request to the Contracting Officer, the Background Consent Form will be provided.

The Government intends to award a purchase order as a result of this combined synopsis/solicitation that will include the terms and conditions set forth herein. To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows:

STATEMENT OF WORK
REPAIR FUEL TANKS

PROJECT SPECIFIC INFORMATION:
1. Location: Bldgs 283, 1166, 906, and 9005
2. Performance Period for Construction: 30 Sep 2023
3. Working Restrictions: Escort required for access to Bldg 9005. NMED Inspector must be present for all work (see #12 below).
4. Restricted Area (as defined in HAFB Instruction 31-102): No
SCOPE OF WORK:
1. Six (6) fuel tanks need repair. One tank is located near Bldg 283. Two tanks are located near Bldg 1166. Two tanks are located near Bldg 9005. One tank is located near Bldg 906. Bldg 9005 is located on the Oscura Range. The driving distance from Holloman is about 62 miles. The GPS location for the tanks at Bldg 9005 are as follows: 33.5297 N - 106.2123 W. A map will be provided to the successful offeror for location of the other buildings.
2. The New Mexico Environment Department (NMED) requires that all work on this project be completed by certified personnel meeting the requirements of New Mexico Administrative Code (NMAC), Paragraphs 20.5.105.501 and 20.5.105.504. These paragraphs are listed on Pages 49 and 52 in the attached NMAC Code, and highlighted in yellow. A list of currently known certified personnel and companies is attached for your reference. The successful offeror must coordinate for the presence of a certified NMED inspector for oversight of all work.
3. Successful offeror must notify Ms. Jessica Guttierrez 40 days prior to the start of work. Her e-mail is jessica.gutierrez.11@us.af.mil.
4. Submit an Alternate Methods Request Form to NMED for approval before building any containment structures. This form is attached.

7. Except for Tank #13905, all tanks currently have a tank gauge mounted on top of the tanks. Remove and dispose all currently installed gauges. Install new 9" high nipples on the five (5) tanks. Install new gauges on top of the 9" nipples. Provide a conduit union at or near the transducer. The new gauges shall be as follows: Solar Gauge EFG-8000-A, or approved equal. The gauges shall be equipped with both audio and visual (LED) programmable fill alarms, alerting the operator of the fill level, and shall be solar powered with backup batteries. Calibrate and adjust the gauges as required. The solar panels shall face due South at a 45 degree angle for optimal sun exposure, with no immediate nor obvious obstruction.
8. The three (3) tanks at Buildings 283 and 9005 require a drip pan containment structure installed beneath the pump. Remove the pumps, conduits, hoses, piping, and anything else as required. Set them aside for reuse and reconnection after other work is completed. The contractor is responsible for reconnection. Install a containment structure beneath the pumps. Perform any structural work as necessary to install for a permanently mounted spill pan, approximately 4’ in diameter, in accordance with NMED standards (see #12 below). Reinstall all items in working order. This may involve extending the hoses, piping, and conduit. The containment structures shall be watertight. Perform hydro-static testing as required. The attached picture called, “Picture – Bldg 283”, shows the location of the containment structure on all three tanks.
9. Three (3) of the tanks at Bldgs 1166 and 906 require a spill bucket “containment structure,” e.g., installation of a permanently mounted bucket, approximately 3 gallons, in accordance with NMED standards (see #12 below). See the attached pictures called “Picture – Bldg 906”, and “Picture – Bldg 1166”. They show where the containment structures need to be built. The containment structures shall be watertight. Perform hydro-static testing as required (see #12 below).
10. The contractor must perform overflow prevention testing for three (3) tanks, namely tanks 12104, 13905, and 12102. See #12 below for the necessary standards.
11. Tank 13905 has a tank gauging and high alarm system on it. Remove the entire system, to include the panel and electrical wiring. The conduit should be reused, if not damaged by the contractor. If the conduit is damaged, it must be replaced by the contractor at no cost to the government. Install a new, solar-powered, tank gauging and high fill programmable alarm system with audio and visual (LED) alarms. The solar panels shall face South at a 45 degree angle for optimal sun exposure, with no immediate nor obvious obstruction.
12. All equipment shall be tested in accordance with the NMAC, Sections 20.5.110.1005.D and
20.5.109.917. These paragraphs are on Pages 140 and 152, and highlighted in yellow. The equipment shall be tested on the same day that it is installed by the contractor, and in the presence of the NMED inspector.
13. The Contractor shall furnish all labor, equipment, materials, tools, and transportation necessary to accomplish the work.
14. All debris shall be disposed off base.
15. All work shall be in accordance with the manufacturer’s instructions and NMED requirements.
16. The Contractor may park storage trailers and equipment on site.
17. Perform a complete clean-up of the work area after the work is complete.
18. Repair any damage that may occur during the course of the work.

FAR provision 52.212-1 (NOV 2021) is hereby replaced in its entirety
Instructions to Quoters-Commercial Products and Commercial Services
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees if the acquisition—
(1) Is set aside for small business and has a value above the simplified acquisition threshold;
(2) Uses the HUBZone price evaluation preference regardless of dollar value, unless the offeror waives the price evaluation preference; or
(3) Is an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.
(b) Submission of quotes. Submit signed and dated quotes to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotes may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, quotes must show—
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of quotes (if specified);
(3) The name, address, and telephone number of the quoter;
(4) A technical description of the items being quoted in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at Federal Acquisition Regulation (FAR) 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the quoter shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the quote is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Quotes that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of quotes. The quoter agrees to hold the prices in its quote firm for 110 calendar days from the date specified for receipt of quotes, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotes. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple quotes. Quoters are encouraged to submit multiple quotes presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10, or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each quote submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of quotes.
(1) Quoters are responsible for submitting quotes, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation.
If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotes or revisions are due.
(2)(i) Any quote, modification, revision, or withdrawal of a quote received at the Government office designated in the solicitation after the exact time specified for receipt of quotes is "late" and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late quote would not unduly delay the acquisition. However, a late modification of an otherwise successful quote, that makes its terms more favorable to the Government, will be considered at any time it is received prior to award.
(3) If an emergency or unanticipated event interrupts normal Government processes so that quotes cannot be received at the Government office designated for receipt of quotes by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotes will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(4) Quote may be withdrawn by written notice received at any time before the exact time set for receipt of quotes. Oral quotes in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile quotes, quotes may be withdrawn via facsimile received at any time before the exact time set for receipt of quotes, subject to the conditions specified in the solicitation concerning facsimile quotes. A quote may be withdrawn in person by a quoter or its authorized representative if, before the exact time set for receipt of quotes, the identity of the person requesting withdrawal is established and the person signs a receipt for the quote.
(g) Purchase order issuance. Quotes should contain the quoter’s best technical and price terms. The Contracting Officer may reject any or all quotations. The Contracting Officer may issue a purchase order to other than the quoter with the lowest priced quotation. After the evaluation of quotations, the Contracting Officer may negotiate final terms with one or more quoters of the Government’s choice before issuing any purchase order. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR Part 15.
(h) Multiple purchase orders. The Government may issue a purchase order for any item or group of items of a quote, unless the quoter qualifies the quote by specific limitations. Unless otherwise provided in the Schedule, quotes may not be submitted for quantities less than those specified. The Government reserves the right to issue a purchase order for any item for a quantity less than the quantity quoted, at the unit prices quoted, unless the quoter specifies otherwise in the quote.

(3) The overall ranking of all quoters, when any ranking was developed by the agency.

FAR provision 52.212-2 (NOV 2021) is hereby replaced in its entirety
Basis for Contract Award – Evaluation of Quotations-Simplified Acquisition Procedures
(a) In accordance with FAR 13.106, the Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:
(i) Price
(b) A quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract.
Therefore, issuance by the Government of an order in response to a supplier’s quotation does not establish a contract. A written notice of award or purchase order, mailed or otherwise furnished to the successful quoter is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer.
Quote Evaluation: The evaluation process will be accomplished as follows:
A. General: We will award a contract to the responsible quoter who represents the best value to the Government on the basis of its (1) quote.
B. Quote
1. General: We will determine the merits of your quote on the basis of (a) its acceptability and (b) its quoted price.
(a) Acceptability: We will determine the acceptability of your quote on an acceptable or unacceptable basis. We will consider your quote acceptable if it (i) conforms to the material solicitation requirements; (ii) manifests your unconditional assent to the terms of this Request for Quote (RFQ), and (iii) you are a responsible prospective contractor pursuant to FAR 9.104-1. (NOTE: By submission of a quote, the quoter represents that it unconditionally assents to the terms of this Request for Quote, except for any written express exceptions.)
(i) Conformance. Material solicitation requirements include those terms affecting quality, quantity, price, or delivery. (ii) Assent. If you (1) take exception to any term of this RFQ, (2) propose any additional terms, or (3) omit material information required by this RFQ then we will consider your quote to be unacceptable and ineligible for contract award.
(b) Price: We will evaluate your price for fairness and reasonableness in accordance with FAR 13.106-3(a).
52.212-3 Offeror Representations and Certifications - Commercial Products and Commercial Services
(DEVIATION 2023-O0002).
Effective December 19, 2022, insert the following provision in solicitations for the acquisition of commercial products or commercial services. This provision provides a single, consolidated list of representations and certification for the acquisition of commercial products or commercial services and is attached to the solicitation for offerors to complete. This provision may not be tailored except in accordance with FAR subpart 1.4. Use the provision with its Alternate I in solicitations issued by DoD, NASA, or the Coast Guard.
Offeror Representations and Certifications - Commercial Products and Commercial Services

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision - Covered telecommunications equipment or services has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
Forced or indentured child labor means all work or service -
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
Immediate owner means an entity, other than the offeror, that has direct control of the offeror.
Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
Manufactured end product means any end product in product and service codes (PSCs) 1000- 9999, except -
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.
Reasonable inquiry has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174).
Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate -
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology -
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically -
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
Service-disabled veteran-owned small business concern -
(1) Means a small business concern -
(i) Not less than 51 percent of which is owned by one or more service - disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
Small business concern –
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in its field of operation, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships.
SBA determines affiliation based on the factors set forth at 13 CFR 121.103.
Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that -
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by -
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $850,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
Subsidiary means an entity in which more than 50 percent of the entity is owned -
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
Veteran-owned small business concern means a small business concern -
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
Women-owned business concern means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
Women-owned small business concern means a small business concern -
(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and
(2) Whose management and daily business operations are controlled by one or more women.
Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300.
