1.0. DESCRIPTION OF SERVICES. The contractor shall provide all management, tools, supplies, equipment, and labor necessary to repair and inspect Flameholders, National Stock Number (NSN): 2840-01-326-4066. Services will also include the pickup of the units from HAFB, transport to repair/inspection facility and delivery back to HAFB after completion of repair and inspection.
1.1. PURPOSE / BACKGROUND
1.1.1. Purpose
The purpose of this contract is to provide the repair capability to the F100-PW-100, 200, 220, 220E engine model Flameholders at a lower cost than new purchases of the same item in the Defense Logistics Agency system. This capability will optimize HAFB and Air Force (AF) supply system balances ensuring serviceable Flameholders backfill warehouse quantities.
1.1.2. Background
Air Force Life Cycle Management (AFLCMC) USAF F100 Engineering Office, the approving organization, approves sources of this service through a Source Approval Request (SAR) Package. Any potential offer not approved, may contact AFLCMC/LPEA2 F100 Engineering Office at (405)-734-7558 / DSN: 884-7558 or AFLCMC.LPEA2.Engineers@us.af.mil in order to submit a SAR, which may or may not be approved prior to closing date of this requirement. Contractors must be approved by the AFLCMC USAF F100 Engineering Office to perform these services.
1.2. BASIC SERVICES
1.2.1. Scope
The scope of the contract includes the shipping of Flameholders from HAFB to repair/inspection facility, repairing, inspecting after repair, and shipping from repair/inspection facility to HAFB for the F100-PW-100, 200, 220, 220E engine model Flameholder components.
1.2.1.1. The contractor shall inspect and repair Flameholders in accordance with (IAW) manufacturer specifications and recommendations, in addition to the following technical guidance from F100 Engineering Office:
· Technical Order (T.O.) 2JF100-36-5 , Subordinate Work Package (SWP) 517 02 CUI
· T.O. 2J-F100-46-5, Work Package (WP) 523 02 for the F100-PW-100, 200, 220, 220E engine models CUI
· T.O. 2-1-111 CUI
· T.O. 2J-F100-36-1 CUI
· T.O. 2J-F100-46-1 CUI
1.2.1.2. No significant changes will be made to the repair process without the approval and written consent of USAF F100 Engineering.
1.2.1.3. The contractor will work in accordance with the current changes to all the technical manuals listed.
1.2.1.4. The contractor will obtain the original technical manuals and the current changes to these manuals by contacting the F100 Technical Order Manager Agent (TOMA) at Tinker Air Force Base. When given approval, the contractor can access all technical data at: https://etims.cce.af.mil/ETIMS/index.
1.2.1.5. The above noted requirements are specific to the F100-PW-100, 200, 220, 220E engine models for the Flameholder repair and intended for military use.
1.2.1.6. The contractor will document all repairs and inspections made to the Flameholder as well as documentation of serviceability and provide a copy of that documentation with the returning Flameholders. If the Flameholders are determined to be non-repairable then documentation illustrating a detailed explanation on why it cannot be repaired must be provided to the COR.
1.2.1.7. When Flameholders return to HAFB, Subject Matter Experts (SMEs) will evaluate the condition of the Flameholder. If any discrepancies are found the SME will notify the COR who will then notify the CO.
1.2.2. Schedule and Ordering

A minimum of 7 units and a maximum of 200 units will need repaired during the ordering period. The repair schedule is anticipated to be 45 to 60 days (NOT to exceed 60 days) from the day the COR notifies contractor of required repairs, after the issuance of a task order, to the return of finished repairs and inspections of the Flameholders. If the repair time is expected to extend past 60 days due to extenuating circumstances, contractor shall notify the COR as soon as possible, but no later than the 45th day. Orders will be issued via task order by the 49th Contracting Squadron. A minimum of 4 per shipment.
A new task order may be issued prior to the end of the period of period (PoP) of previous task order, but no sooner than 30 days after previous task order's PoP's start date.
1.2.3. Coordination / Pickup Location
Contractor shall contact the COR, within 2 days after COR notifies contractor of required repairs, to coordinate each and every pickup of Flameholders to be repaired from HAFB and delivery of repaired Flameholders back to HAFB.
1.2.3.1. 49th Maintenance Group/Air Force Repair Enhancement Program (AFREP) office is located in HAFB. Contact information shall be provided at award.
1.3. ENVIRONMENTAL CONTROLS.
1.3.1 Compliance with Laws and Regulations. The contractor shall be knowledgeable of and comply with all applicable Interstate, Federal, State, and Local laws, regulations, and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this contract, the contractor is required to comply as such laws come into effect.
1.3.2. Material Storage and Use. The contractor shall follow manufacturer’s guidelines, professional recommendations, and industry standards for control of humidity, temperature, cleanliness, and materials handling necessary for Flameholder repair and handling. This includes hazardous materials. Contractor shall reference all applicable technical guidance as provided from the F100 Engineering office, F100 Technical Order Manager Agents, and Defense Federal Acquisition Regulation Supplement (DFARS) guidance regarding environmental controls and authorized material use.
2.0. SERVICES SUMMARY (SS). The government will evaluate the Contractor performance IAW the following criteria.

3.0. GOVERNMENT FURNISHED PROPERTY AND SERVICES. The government does not anticipate providing any government furnished property or services.
4.0. GENERAL INFORMATION.
4.1 SECURITY REQUIREMENTS.
The base entry process and procedures as directed by Installation 49th Security Forces for pickup/delivery contractor will comply with all HAFB security requirements upon requesting access for pickup and delivery of Flameholder shipments. AFREP personnel will meet and escort as required to ensure security adherence throughout the shipping/delivery process.
4.1.2. Illegal Aliens. The contractor shall not hire an illegal alien to work or perform any service on HAFB. Employees who are not U.S. citizens can only be persons possessing a current resident alien immigrant status (Green Card), or if a non-resident immigrant, must possess a current Employment Authorization Document. While on HAFB, non-U.S. citizen employees must be able to produce for inspection the appropriate credential: Green Card or Employment Authorization Document. Any illegal alien found on the installation shall be immediately detained by the base security forces and barred from the installation.
4.1.3. Foreign National Employees. The contractor must obtain foreign national visitor approval for all employees requiring access to HAFB who are not U.S. citizens. The 49 MSG/CC is the approval authority; the 49 MSG/CC may delegate approval authority to the 49 SFS/CC.
4.1.3.1. During Force Protection conditions Bravo through Delta the contractor must submit requests for all foreign national employee approvals through the Contracting Office to the 49 MSG/CC or 49 SFS/CC (if delegated) using the HAFB Foreign Visit Request Form (available at the HAFB Visitors Center).
4.1.3.2. Once coordination through the Contracting Office has been completed, the HAFB Foreign Visit Request Form shall be forwarded to 49 SFS/S5AV for coordination. 49 SFS/S5AV will submit the completed form to the 49 MSG/CC or 49 SFS/CC (if delegated) for approval. The Contracting point of contact listed on the Foreign Visit Request Form will be contacted when a final decision has been made.
4.1.3.3. The Foreign Visit Request Form will be maintained by 49 SFS/S5AV and the AF Office of Special Investigation until the visit end date.
4.1.3.4. Employees who are not U.S. citizens will not be allowed to enter the installation until properly approved via the procedures outlined above in 4.1.3. through 4.1.3.3.
4.1.3.5. Physical Security. The contractor shall be responsible for safeguarding all government property during the services described above. At the close of each work period, government property and materials shall be secured.
4.1.3.6. Controlled/Restricted Areas. The company to pick-up and deliver all units shall be subject to local base procedures for entry to AF controlled/restricted areas where shipping personnel will work.
4.1.3.7. Escorted Entry Procedures: Unless granted unescorted entry (see procedures below), all shipping employees will be escorted while in AF controlled/restricted areas on HAFB. When escorted, employees shall remain with their assigned escort at all times while in controlled/restricted areas. Escort responsibility rests with the sponsoring agency. An escort briefing will be provided to all escorted employees prior to entering a controlled/restricted area. Persons providing escort are responsible for providing this briefing. Escort officials assume responsibility for the safe and secure conduct of escorted employees and are required to maintain constant surveillance and control of employees at all times while in a controlled/restricted area.
4.1.3.8. Unescorted Entry Procedures: An AF Form 2586, Unescorted Entry Authorization Certificate, must be completed and signed by the sponsoring agency security manager before a restricted area badge will be issued. Employees must have a completed and favorable Tier 1 security investigation before receiving a restricted area badge. Interim access can be granted IAW AFMAN 16-1405, Personnel Security Program. Unescorted entry will never be granted solely to avoid the inconvenience of escorted entry.
4.1.3.9. Listing of Employees. The contractor shall maintain a current listing of employees that require access to HAFB. The list shall include the employee's name, social security number and type of investigation if contract work involves unescorted entry to AF restricted areas or other sensitive areas designated by the installation commander. The list shall be provided to the sponsoring agency security manager. An updated listing shall be provided when an employee's status or information changes (e.g. terminated for cause, reassignment, retirement, etc.) or when a new employee is added. The contractor shall also provide the initial and any updated listings to Contracting with all Personal Identifiable Information (PII) redacted.
4.1.3.10. Security Training. The contractor ensures all employees requiring HAFB unescorted entry receive initial and recurring security education training from the sponsoring agency security manager. Training must be conducted IAW DODM 5200.01, DOD Information Security Program, and AFI 16-1404_AFGM201901, Information Security Program Management. Contractor personnel who work in AF controlled/restricted areas must be trained IAW AFI 31-101, Integrated Defense.
4.1.3.11. Pass and Identification Items. The contractor shall ensure the pass and identification items required for contract performance are obtained for employees. Employees shall only be granted access to the installation to perform functions directly related to their respective contract.
4.1.3.12. All contractor employees requiring access to HAFB shall be identified on a HAFB Visit Access Request (VAR) form. The contractor shall submit a completed VAR through the Contracting Office to 49 SFS Pass and Registration (49 SFS/S5AV) no later than (NLT) seven (7) duty/business days, and for foreign nationals, 14 duty/business days, prior to requiring access to the installation.
4.1.3.13. Retrieving Identification Media. The contractor shall return all identification media from employees who depart for any reason before the contract expires; e.g., terminated for cause, reassignment, retirement, etc. The Contractor will notify the government within 24 hours when unable to retrieve identification media from contract employees.
4.1.3.14. Travel Restrictions: Contractors are prohibited in areas of the installation other than their appropriate place of work and the routes to and from installation entry/exit points.
4.1.3.15. Traffic Laws. The contractor and its employees shall comply with base traffic regulations. Traffic regulations include, but are not limited to:
4.1.3.16. Employees shall wear a seatbelt when operating or riding in any military, contractor owned, or privately-owned vehicle while on the installation.
4.1.3.17. Speed limits on HAFB are 30 MPH unless otherwise posted. Be aware of reduced speed limits and exercise caution when driving in base housing and school zones.
4.1.3.18. All vehicle operators on the installation shall not use cell phones unless the vehicle is safely parked or unless they are using a hands-free device. The wearing of any other portable headphones, earphones or other listening devices (except for hand-free cellular phones) while operating a motor vehicle is prohibited.
4.1.3.19. Weapons, Firearms, and Ammunition. Employees are prohibited from possessing weapons, firearms, or ammunition on themselves or within military, contractor, or privately owned vehicles while on HAFB.
4.1.3.20. Reporting Requirements. Contractor personnel shall report to an appropriate authority any information or circumstances of which they are aware may pose a threat to the security of DOD personnel, contractor personnel, resources, and classified or unclassified defense information.
4.1.3.21. Photography. Photography in or within the close proximity of an AF controlled/restricted area, flight line, or taxiway is strictly prohibited. Contractors that wish to take photos shall coordinate with their COR or government Program Manager who will coordinate with the appropriate owning unit security manager for a photography clearance memorandum prior to taking photos.
4.1.3.22. Video/Still Imagery Devices: The use or possession of any device capable of capturing video and still images are strictly prohibited within any controlled/restricted area without written authorization from the installation commander or his/her designated representative. Individuals will be denied access to restricted/controlled areas if in possession of these devices.
4.2. QUALITY CONTROLS.
4.2.1. The contractor shall develop and maintain a Quality Control Program/Plan (QCP) to ensure maintenance and repair services are performed IAW approved methods detailed by AFLCMC (USAF F100 ENGINEERING) as noted in the Technical Orders and manuals listed below:

4.2.1.1. The plan shall also include QC procedures that are outlined below:
4.2.1.1.1. Document should be on contractor letterhead or include Contractor Name, Address, Phone Number & Email. The Contract Number (located in Block 2 of the SF1449) shall be included.
4.2.1.1.2. The plan shall define the role of management.
4.2.1.1.3. The plan shall provide an organizational flow chart (can be very simplistic) and identify the individual(s) who will be performing quality control checks.
4.2.1.1.4. The plan shall address contractor's inspection system that will be used to cover the services stated in the Service Summary (Section 2.0) of PWS.
4.2.1.1.5. The plan shall identify contractor's method(s) for:
· Identifying defects in the quality of how services are performed:
· identifying how to prevent defects in the quality of service;
· state how founded defect(s) are recorded;
· include preventative measures to preclude recurrence;
· Describe the method for identifying and recording corrective actions taken
· Identifying recording QC inspections conducted
4.2.1.1.6. The plan shall address specific tasks of the contract requirement, not just items listed under Section 2.0. If using random and/or periodic performance checks, please outline. Include any written work instructions, procedures, processes or checklists used to meet the contract terms.
4.2.1.1.7. The plan shall address how company recruits and maintains employees to ensure no lapse of service.
4.2.1.1.8. The written QCP shall be submitted to the CO for review within thirty (30) days after award. The CO will review and either accept the QCP as written or provide feedback within ten (10) working days. If QCP is returned, contractor shall resubmit within five (5) working days, until plan is accepted. The plan shall specifically address the items listed above as well as the Contractor's strategy to provide quality workmanship, continual process improvement and for correcting deficiencies as required.
4.2.2. The contractor must provide a guarantee of workmanship, warranty for at least one year. Any discrepancies found by the HAFB SME when items are received will be placed under the responsibility of the contractor to fix.
4.2.3. All technician certifications must be in compliance with industry standards. Industry standards for repair of F100-PW-100, 200, 220, 220E engine model Flameholders are determined by Air Force F100 Engineering office.
4.2.3.1. All business practices will be IAW properly referenced to technical manuals and work packages T.O. 2-1-111, T.O. 2J-F100-36-1, and T.O. 2J-F100-46-1, T.O. 2J-F100-36-5, SWP 517 02 and T.O. 2J-F100-46-5, WP523 02 for the F100-PW-100, 200, 220, 220E engine models.
4.2.4. Any matter concerning a change to the scope, prices, terms or conditions of this contract shall be referred to the CO.
4.2.5. Quality Assurance. The services to be performed by the contractor during the period of this contract shall at all times and places be subject to review by the COR and SMEs.
4.3. Controlled Unclassified Information (CUI). The contractor shall comply with DoDI 5200.48, Controlled Unclassified Information (CUI), requirements. This enclosure identifies the controls and protective measures developed for DoD CUI material.
4.4. HOURS OF OPERATION.
4.4.1. Normal Hours of Operation.
The contractor pick-up and delivery of items shall only be performed, under this contract, during the normal hours of operations: Monday-Friday 0700-1630. If contractor performance is required on HAFB it is the Contractor’s responsibility for supervising its employees to ensure adherence to the hours of operation in performance of the Flameholder repair.
4.4.2. Recognized Holidays.
The Contractor is required to provide service on the following days (see link below) if it falls under normal business hours listed under PWS paragraph 1.5.1.

5.0. RECORDS.
5.1. Freedom of Information Act (FOIA) Requirements And Records Management (August 2022)
5.1.1. Freedom of Information ACT (FOIA) and Privacy Act (PA). The Contractor shall comply with DoDM 5400.7_R, DoD Freedom of Information Act (FOIA) Program, DoD5400_7-R_AFMAN33-302, Freedom of Information Act Program, and AFI 33-332, Air Force Privacy and Civil Liberties Program. These regulations set policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding Personally Identifiable Information (PII) material. The contractor shall participate in awareness training as determined by the government in accordance with The Privacy Act, Title 5 United States Code Section 552a.
5.1.1.1. Controlled Unclassified Information (CUI): Any information transmitted by the Government or stored by the Contractor in performance of this contract that is considered CUI shall be marked accordingly. Examples of CUI can be found at https://www.archives.gov/cui/registry/category-list. According to the aforementioned website, some examples of CUI are certain technical orders and publications, personally identifiable information (such as social security numbers, driver's license number or citizenship status) and "material and information relating to, or associated with, the acquisition and procurement of goods and services, including but not limited to, cost or pricing data, contract information, indirect costs and direct labor rates."
5.1.2. Contractor Records and Records Management (July 2019). Contractor shall comply with all applicable records management laws and regulations, as well as National Archives and Records Administration (NARA) records policies, including but not limited to the Federal Records Act (44 U.S.C. chapters. 21, 29, 31, 33), NARA regulations at 36 CFR Chapter XII Subchapter B, and those policies associated with the safeguarding of records covered by the Privacy Act of 1974 (5 U.S.C. 552a). These policies include the preservation of all records, regardless of form or characteristics, mode of transmission, or state of completion.
5.1.2.1. In accordance with 36 CFR 1222.32, all data created for Government use and delivered to, or falling under the legal control of, the Government are Federal records subject to the provisions of 44 U.S.C. chapters 21, 29, 31, and 33, the Freedom of Information Act (FOIA) (5 U.S.C. 552), as amended, and the Privacy Act of 1974 (5 U.S.C. 552a), as amended and must be managed and scheduled for disposition only as permitted by statute or regulation.
5.1.2.2. In accordance with 36 CFR 1222.32, Contractor shall maintain all records created for Government use or created in the course of performing the contract and/or delivered to, or under the legal control of the Government and must be managed in accordance with Federal law. Electronic records and associated metadata must be accompanied by sufficient technical documentation to permit understanding and use of the records and data.
5.1.2.3. United States Air Force (USAF) and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Records may not be removed from the legal custody of USAF or destroyed except for in accordance with the provisions of the agency records schedules and with the written concurrence of the Head of the Contracting Activity. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. In the event of any unlawful or accidental removal, defacing, alteration, or destruction of records, Contractor must report to USAF. The agency must report promptly to NARA in accordance with 36 CFR 1230.
5.1.2.4. The Contractor shall immediately notify the appropriate Contracting Officer upon discovery of any inadvertent or unauthorized disclosures of information, data, documentary materials, records or equipment. Disclosure of non-public information is limited to authorized personnel with a need-to-know as described in the [contract vehicle]. The Contractor shall ensure that the appropriate personnel, administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, documentary material, records and/or equipment is properly protected. The Contractor shall not remove material from Government facilities or systems, or facilities or systems operated or maintained on the Government's behalf, without the express written permission of the Head of the Contracting Activity. When information, data, documentary material, records and/or equipment is no longer required, it shall be returned to USAF control or the Contractor must hold it until otherwise directed. Items returned to the Government shall be hand carried, mailed, emailed, or securely electronically transmitted to the Contracting Officer or address prescribed in the [contract vehicle]. Destruction of records is EXPRESSLY PROHIBITED unless in accordance with Paragraph (4.7.2.3.).
5.1.2.5. The Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts. The Contractor (and any sub-contractor) is required to abide by Government and USAF guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information.
5.1.2.6. n/a
5.1.2.7. The Contractor shall not create or maintain any records containing any non-public USAF information that are not specifically tied to or authorized by the contract.
5.1.2.8. The Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected from public disclosure by an exemption to the Freedom of Information Act.
5.1.2.9. The USAF owns the rights to all data and records produced as part of this contract. All deliverables under the contract are the property of the U.S. Government for which USAF shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Any Contractor rights in the data or deliverables must be identified as required by FAR 52.227-11 through FAR 52.227-20.
5.1.2.10. Training. All Contractor employees assigned to this contract who create, work with, or otherwise handle records are required to take USAF-provided records management training. The Contractor is responsible for confirming training has been completed according to agency policies, including initial training and any annual or refresher training.
5.2. Certificate of Insurance (COI) – Working on Government Installation. (January 1997). In accordance with FAR 28.306, Insurance under fixed-priced contracts, paragraph (b)(1), contractor shall carry the minimum coverage of insurance as outlined in FAR 28.307-2, Liability; (a) Workers' Compensation and employer's liability; (b) General liability; (c) Automobile liability; and if applicable (d) Aircraft public and passenger liability or (e) Vessel liability. The Contractor shall provide proof of insurance coverage within fourteen (14) days of award to the Contracting Officer. NOTE: COI document (e.g. ACORD 25) shall have the 13-digit "Contract", not solicitation, Number on the document
5.3. Freedom of Information Act (FOIA) Requirements and Records Management (August 2022)
5.3.1. Freedom of Information ACT (FOIA) and Privacy Act (PA). The Contractor shall comply with DoDM 5400.7_R, DoD Freedom of Information Act (FOIA) Program, DoD5400_7-R_AFMAN33-302, Freedom of Information Act Program, and AFI 33-332, Air Force Privacy and Civil Liberties Program. These regulations set policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding Personally Identifiable Information (PII) material. The contractor shall participate in awareness training as determined by the government in accordance with The Privacy Act, Title 5 United States Code Section 552a.
5.3.1.1. Controlled Unclassified Information (CUI): Any information transmitted by the Government or stored by the Contractor in performance of this contract that is considered CUI shall be marked accordingly. Examples of CUI can be found at https://www.archives.gov/cui/registry/category-list. According to the aforementioned website, some examples of CUI are certain technical orders and publications, personally identifiable information (such as social security numbers, driver's license number or citizenship status) and "material and information relating to, or associated with, the acquisition and procurement of goods and services, including but not limited to, cost or pricing data, contract information, indirect costs and direct labor rates."
5.3.2. Contractor Records and Records Management (July 2019). Contractor shall comply with all applicable records management laws and regulations, as well as National Archives and Records Administration (NARA) records policies, including but not limited to the Federal Records Act (44 U.S.C. chapters. 21, 29, 31, 33), NARA regulations at 36 CFR Chapter XII Subchapter B, and those policies associated with the safeguarding of records covered by the Privacy Act of 1974 (5 U.S.C. 552a). These policies include the preservation of all records, regardless of form or characteristics, mode of transmission, or state of completion.
5.3.2.1. In accordance with 36 CFR 1222.32, all data created for Government use and delivered to, or falling under the legal control of, the Government are Federal records subject to the provisions of 44 U.S.C. chapters 21, 29, 31, and 33, the Freedom of Information Act (FOIA) (5 U.S.C. 552), as amended, and the Privacy Act of 1974 (5 U.S.C. 552a), as amended and must be managed and scheduled for disposition only as permitted by statute or regulation.
5.3.2.2. In accordance with 36 CFR 1222.32, Contractor shall maintain all records created for Government use or created in the course of performing the contract and/or delivered to, or under the legal control of the Government and must be managed in accordance with Federal law. Electronic records and associated metadata must be accompanied by sufficient technical documentation to permit understanding and use of the records and data.
5.3.2.3. United States Air Force (USAF) and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Records may not be removed from the legal custody of USAF or destroyed except for in accordance with the provisions of the agency records schedules and with the written concurrence of the Head of the Contracting Activity. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. In the event of any unlawful or accidental removal, defacing, alteration, or destruction of records, Contractor must report to USAF. The agency must report promptly to NARA in accordance with 36 CFR 1230.
5.3.2.4. The Contractor shall immediately notify the appropriate Contracting Officer upon discovery of any inadvertent or unauthorized disclosures of information, data, documentary materials, records or equipment. Disclosure of non-public information is limited to authorized personnel with a need-to-know as described in the [contract vehicle]. The Contractor shall ensure that the appropriate personnel, administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, documentary material, records and/or equipment is properly protected. The Contractor shall not remove material from Government facilities or systems, or facilities or systems operated or maintained on the Government's behalf, without the express written permission of the Head of the Contracting Activity. When information, data, documentary material, records and/or equipment is no longer required, it shall be returned to USAF control or the Contractor must hold it until otherwise directed. Items returned to the Government shall be hand carried, mailed, emailed, or securely electronically transmitted to the Contracting Officer or address prescribed in the [contract vehicle]. Destruction of records is EXPRESSLY PROHIBITED unless in accordance with Paragraph (4.7.2.3.).
5.3.2.5. The Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts. The Contractor (and any sub-contractor) is required to abide by Government and USAF guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information.
5.3.2.6. n/a
5.3.2.7. The Contractor shall not create or maintain any records containing any non-public USAF information that are not specifically tied to or authorized by the contract.
5.3.2.8. The Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected from public disclosure by an exemption to the Freedom of Information Act.
5.3.2.9. The USAF owns the rights to all data and records produced as part of this contract. All deliverables under the contract are the property of the U.S. Government for which USAF shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Any Contractor rights in the data or deliverables must be identified as required by FAR 52.227-11 through FAR 52.227-20.
5.3.2.10. Training. All Contractor employees assigned to this contract who create, work with, or otherwise handle records are required to take USAF-provided records management training. The Contractor is responsible for confirming training has been completed according to agency policies, including initial training and any annual or refresher training.
6.0. GOVERNMENT OBSERVATIONS. The COR may from timetotime, with CO coordination, observe contractor operations. However, these personnel may not interfere with contractor performance or make any changes to the contract.
7.0. SAFETY REQUIREMENTS. In performing work under this contract, the contractor shall:
7.1. Take such actions and immediate precautions as the contractor may reasonably require for safety and mishap prevention purposes for their employees.
7.2. Have a safety plan for the protection of government property to prevent damage during the period of time the property is under the control or in possession of the contractor and to provide a safe work environment for contractor personnel.
7.3. Record and report promptly (within one hour) to the CO or authorized GR/COR, all available facts relating to each instance of damage to government property not repairable within the guidance listed within the T.O.s listed in Section 1.2.1.1
7.4. In the event of an accident/mishap, take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence until released by the accident/mishap investigative authority through the contracting officer.
7.5. If the government elects to conduct an investigation of the accident/mishap, the contractor shall cooperate fully and assist government personnel in the conduct of investigation until the investigation is completed.
8.0. TRAINING.
8.1. All employees conducting work on the Flameholders shall be adequately trained and authorized to accomplish work on the Flameholders under the industry standard workmanship practices and applicable certifications.
9.0. CONTRACT REMEDIES FOR PERFORMANCE FAILURES.
9.1. If the Contractor fails to perform required services, the government will exercise its rights IAW 52.212-4(a), Inspection/Acceptance, which could result in a Contract Discrepancy Report (CDR).
