PERFORMANCE WORK STATEMENT (PWS)
Part 1. DESCRIPTION OF SERVICES
1.0. Scope of Work1.0.. DESCRIPTION OF SERVICES. The Contractor shall coordinate ReFuelRefuel Café Coordinator (RCC) services at Holloman Air Force Base (HAFB) as defined in this PWS. The RCC shall be responsible for preparing, serving, and replenishing beverages. The RCC shall also be responsible for cleaning facilities, utensils, and tables, while maintaining cleanliness of beverage making equipment, phones, and and computers,; as well as performing all other required tasks identified within the PWS. The HAFB facility is dedicated to providing free non-alcoholic beverages and internet access to dorm residents. The primary customers at this facility are military dorm residents.
1.1. Qualifications. The RCC candidate mustP participate in a qualifying interview with the Wing Chaplain or his/her designee. The RCC candidate must submit a resume with experience in non-alcoholic beverage preparation, barista service, or services of a similar nature to the RCC requirement. The RCC candidate must have favorable references, and must not have any felony convictions, nor other restrictions which would prevent access to the installation. The RCC candidate must demonstrate a friendly demeanor with a positive attitude toward customer service, be able to clearly communicate in English. The RCC candidate must present a neat and professional appearance. The RCC must not wear tight nor revealing attire. The RCC candidate must be able to perform basic arithmetic. In the event the candidate is unacceptable, the contractor shall submit another candidate for consideration. 1.2. Operational and Specific Tasks. The contractor shall:
11.32.1. MMaterial Handling. The RCC shall procure all supplies required in the performance of this contract. The Chapel staff will provide Chapel Tithes and Offering (CTOF) funding for all items listed under paragraph 1.2.21.1.1.2. The RCC shall confirm receipts for all delivered items, visually inspect items for deterioration/damage, and account for all delivered items;, and p physically check temperatures on all refrigerated and frozen items in accordance with Air Force Instruction (AFI) 48-116, Food Safety Program and the Food Code. The RCC shall personally shop for and deliver items as approved by the wing chaplain, or designee; necessary for performance of this requirement. A CTOF cardholder shall be available to make payment. Comment by SCALES, JUSTIN A SSgt USAF ACC 49 CONS/PKA: Perhaps specify which supplies: beverage-making supplies, cleaning supplies, plastic ware, etc. Consider adding a provision for
1.2.24. Materials. The RCC shall purchase and re-stock all paper products associated with serving non-alcoholic beverages, flavored syrups, etc. as required in the performance of this requirement. The contractor shall ensure the Refuel Café maintains a stock of supplies to provide drinks and shall be responsible for notifying the Contracting Officer Representative (COR)COR with enough advanced notice of required items to ensure service is not interrupted by supply shortages. Supplies shall be picked-up/delivered by the 1st day of that month. These items will be purchased with CTOF funds as detailed under paragraph 1.21.16. 1.2.35. Beverage Preparation. The RCC shall prepare beverage items utilizing barista type equipment to include (e.g., espresso machine, coffee bean grinder) in accordance with a posted menu, maintained and updated by RCC. The RCC shall provide the wing chaplain or designee a prosed menu with breakdown of supplies pricing list semi-annually. Comment by SCALES, JUSTIN A SSgt USAF ACC 49 CONS/PKA: Is there an approved menu or does the RCC determine what to put on the menu, and if so, is it subject to review by the COR?
1.2.4.6. Table Service. The RCC shall be responsible for arranging tables and seating to accommodate special functions/meetings as required., then returning the tables and seating to the approved arrangement.
1.2.5.7. Recording Facility Usage. The RCC shall maintain a Government -provided Ffacility Uusage log, to include number of beverages served and number of patrons. TheL logs will be submitted to the COR before the 5th day of the following month.
1.2.5.1. Reporting Contractor Labor. The Contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this requirement for Holloman Air Force Base, NM via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil.
1.2.5.2. Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY), which runs 1 October through 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the Contracting Manpower Reporting Application (CMRA) help desk.
1.2.5.3. User Manuals: Data for Air Force service requirements must be input at the Air Force CMRA link. User manuals for government personnel and contractors are available at the Army CMRA link at http://www.ecmra.mil.
1.2.68. Monthly Expenditures. The RCC shall be proficient in managing monthly supply expenditures handled in accordance with Air Force Instruction (AFI) 52-105 Chaplain Corps Resourcing. , dated 23 June 2015. RRequests for operating funds shall be submitted via AF FormFORM 4356 to the CTOF Account Technician no later than the 25th day of each month. A CTOF Cardholder will be assigned for the following month to purchase supply items only. and be picked up/delivered by the RCC on the 1st day of that month. Comment by SCALES, JUSTIN A SSgt USAF ACC 49 CONS/PKA: A bit of contradiction to paragraph 1.2.2. Previously it read “The RCC shall purchase and restock…”
1.2.97. Cash Handling Procedures. The RCC shall not accept payment of any kind for services or materials provided in the ReFfuel Café (RC).
1.310. Sanitation Requirements.
1.3.1. The RCC shall clear, clean, and sanitize dining tables, chairs, and entercomputtainmenter areas with Government provided cleaning ersupplies within 15 minutes of customer departure to ensure availability to customers.
1.310.12.. The RCC shall clean up those areas that immediately affect customer service, including the appearance of the Cafe.
1.310.23. The RCC shall sweep/clean floors so that no visible dirt or dust remains on floors, floor mats or runners, in corners, behind doors, or under furniture and equipment. The RCC shall monitor customers to ensure they do not move tables and chairs since this creates safety and fire hazards.
1.130.43. The RCC shall spot clean all floors to remove food spills and debris immediately.
1.310.54. The RCC shall clean both sides of interior windows and the inside of exterior windows and doors so that no visible smudges or streaks remain on glass.
1.310.65. The RCC shall clean and sanitize wash basins, slop sinks, and walls to remove all deposits, stains, and foreign matter, including those under fixture edges and lips, and on all exposed surfaces in assigned food service areas.
1.310.76. The RCC shall clean and sanitize all glasses, kitchen prep areas, food preparation equipment, refrigerators and freezers, serving areas and dining areas in accordance with AFMAN 48-147, the 2014 Tri-Service Food Code.
1.3.8. The RCC shall clean the restroom nightly.
1.141. Equipment. Comment by SCALES, JUSTIN A SSgt USAF ACC 49 CONS/PKA: Should wi-fi access be addressed?
1.114.1. Equipment Inventory. The RCC shall inventory RC equipment daily at closing. The RCC and COR shall will periodically conduct a joint inventory and shall sign a receipt for all equipment within the RC. The RCC and the COR shall jointly determine the availability, working order, and condition of all equipment then document their findings on the inventory.
1.114.2. Repair of Equipment. Within two days the RCC shall Nnotify the COR in writing of any equipment or facilities needing repairs. required repairs of equipment and facility. The RCC shall maintain an equipment maintenance log that documents specific repairs requested and the date repairs were completed on each piece of government furnished equipment. Within two (2) days of identifying a problem with any equipment or missing equipment, the RCC shall notify the COR. Notification to COR shall be verbal and written. Comment by SCALES, JUSTIN A SSgt USAF ACC 49 CONS/PKA: Re-worded. I also remoted "notification shall be verbal and written”. Always a good practice to notify the COR of equipment damage, in writing.
1.114.23.1. Equipment Operation. The RCC shall be Rresponsible for connection and operateion of Refuel CCafé equipment (e.g., video game consoles and TVs).
1.4.4. The RCC shall be responsible for changing and the Wi-Fi password every three months. The new password must be posted immediately
1.125.. Hours of Operation.
1.5.1. The Wing Chaplain or designated representative reserves the right to change the work schedule/location, provided the Contractor is given notice one week prior to the change. The Contractor must arrive no later than fifteen (15) minutes prior to the beginning of any event/activity. Flexibility is required due to possible variances in hours for holidays and or special activities. All work will be accomplished at the rReFfuel café, unless otherwise noted. below .Normal Refuel Café operating hours are as follows:
1.12.1. Weekday.
Fridays: 1700-2100, Comment by SCALES, JUSTIN A SSgt USAF ACC 49 CONS/PKA: If the Refuel Café operates in 4 hour blocks, shouldn’t the RCC be doing 4 hours of administrative duties?
1.12.2. Weekends. Saturdays: 1700-2100, Sundays 1700-2100
1.12.1.5.32. Perform administrative duties as outlined above in the Operational and Specific Tasks. Approx. three (3) hours weekly, accomplished any day/time/location.
1.12.1.5.43. Holidays. The Refuel Cafe will maintain regular operating hours as stated in this PWS to include all holidays/ and ACCMajor Command (MAJCOM) family days. Refer to the table listed in PWS paragraph 4.1, Recognized Holidays.
1.12.1.5.54. Special Event Services. Special events may necessitate the RCC to operate on an extended basis, or beyond normal stated operating hours. Special events may include, but are not limited to, Very Important Personople (VIP) visits, Commander’s Annual Facility Inspection Teams, or other similar functions. Extended hours will be approximately 2two hours and occur approximately monthly.
1.12.1.5.65. Emergency Situations. During emergency situations, RCC shall follow the directions of Security Forces and/or Fire Department personnel. When directed to evacuate the facility for any reason, Contractor employees shall immediately depart the facility and proceed to a pre-determined location. The performance of these services is non-mission essential during times of crisis. Should a crisis be declared, the Contracting Officer or their representative will verbally advise the contractor if temporary suspension of work is required, followed by a written notification. A representative of the Contracting Officer will further notify the contractor verbally when the crisis is ended, with written notification to follow. Any price change resulting from this crisis will be negotiated in accordance with FAR clauses 52.212-4(c), Changesfor "Changes".
1.12.1.6.7. Safety.
1.6.1. The RCC shall maintain a safe and healthful working conditions for all personnel performing, or coming into contact with, the work required by this contractPWS. Safe and healthful conditions are defined by United States Public Law 91-596 and the Occupational Safety and Health Act of 1970 (OSHA). OSHA standards, American National Safety Institute (ANSI), and National Fire Protection Association (NFPA) shall apply to this contract. If a conflict occurs between the standards, the RCC shall apply the more stringent standard.
1.12.1.6.28. . The RCC shall provide mishap reports or contractor generated personnel injury reports to the COR for mishaps involving Government personnel sustaining injury or illness, resulting from Contractor operations; Mishaps involving Government property or equipment damaged by the RCC; mishaps involving beverage service personnel.
1.12.1.6.3.9. The Government will have the authority to conduct mishap investigations in Contractors operated Government facilities or to participate in the Contractor’s investigation of Contractor mishaps. As required by the Government, the Contractor shall participate in, and cooperate with, mishap investigations.
1.12.1.6.140. The Government has the authority to conduct facility safety inspections in Contractor occupied Government facilities.

Part 3.3.0. GOVERNMENT FURNISHED PROPERTY AND SERVICES
3.01. FacilitiesProperty.
3.1. Facilities. The Government will furnish or make available adequate facilities for the Airmen Ministry Center. No alterations to the facilities shall be made by the contractor. All repair requests shall be forwarded to the COR.
3.2. Services.
3.2.1. . Utilities. The Government will provide gas, electricity, sewage, and water as necessary for the accomplishment of work in accordance with this PWS. All reasonable quantities of utilities shall be made available to the Contractor without charge.
3.2.1. Conservation of Utilities. The contractor shall be responsible for instructing employees and operating under conditions which prevent the waste of utilities..
3.2.1.1. Lights shall be used only in areas when and where work is actually being performed, and turned off when no longer needed.
3.2.1.2. Mechanical equipment controls for heating, ventilation and air conditioning systems shall not be adjusted by the Contractor or by Contractor employees unless authorized.
3.2.1.3. Water faucets or valves shall be turned off, or restored to their original state after the required use has been accomplished.
3.2.1.4. Government telephones shall be used only for official Government business. The Government shall only provide base and local commercial (Class C line) telephone service.
Long distance service, if desired, shall be at the Contractor’s expense.
4.0. GENERAL INFORMATION.
4.1. RECOGNIZED HOLIDAYS. The Contractor is required to provide service on the following days if it falls under normal business hours listed under PWS paragraph 1.5.1.

4.2. SECURITY REQUIREMENTS. Base passes shall be obtained immediately upon award of the contract. Employees assigned to this project must possess two (2) types of identification at all times. Please submit to the Contracting Officer a list of names and addresses of every employee that will be involved with this project. Vehicles and equipment that will be used on this project must be registered with the HAFB Security Forces. Paperwork for base passes shall be obtained from the Contracting Officer/Administrator. Base passes are issued on a yearly basis for the duration of the contract.
4.2.1. Listing of Employees. The Contractor shall maintain a current listing of employees that require access to Holloman AFB. The list shall include the employee's name, social security number and type of investigation if contract work involves unescorted entry to Air Force (AF) restricted areas or other sensitive areas designated by the installation commander. The list shall be provided to the Program Manager, CO and sponsoring agency security manager. An updated listing shall be provided when an employee's status or information changes (e.g. terminated for cause, reassignment, retirement, etc.) or when a new employee is added.
4.2.2. Security Training. The Contractor ensures all employees receive initial and recurring (annual) security education training from the sponsoring agency security manager. Training must be conducted IAW DoDM 5200.01, DoD Information Security Program, and AFI 16-1404, Information Security Program. Contractor personnel who work in AF controlled/restricted areas must be trained IAW AFI 31- 101, Integrated Defense.
4.2.3. Pass and Identification Items. The Contractor shall ensure the pass and identification items required for contract performance are obtained for employees. Employees shall only be granted access to the installation to perform functions directly related to their respective contract.
4.2.3.1. All Contractor employees requiring access to Holloman AFB shall be identified on a Holloman AFB Visitor Access Request (VAR) form. The Contractor shall submit a completed VAR through the CO to 49 SFS/S5AV no later than 7 duty/business days, and for foreign nationals, 14 duty/business days, prior to requiring access to the installation. Comment by REN, PATTI J CIV USAF AFMC 704 TSS/XPA: Should be 4.3.3.1.
4.2.4. Retrieving Identification Media. The Contractor shall return all identification media from employees who depart for any reason before the contract expires; e.g. terminated for cause, reassignment, retirement, etc. The Contractor will notify the Government within 24 hours when unable to retrieve identification media from contract employees.
4.2.5. Traffic Laws. The Contractor and its employees shall comply with base traffic regulations. Violations may result in the loss of base driving privileges and/or debarment from the installation.
4.2.5.1. Employees shall wear a seatbelt when operating or riding in any military, Contractor-owned, or privately- owned vehicle while on the installation.
4.2.5.2. Speed limits on Holloman AFB are 30 MPH unless otherwise posted. Be aware of reduced speed limits and exercise caution when driving in base housing and school zones.
4.2.5.3. All vehicle operators on the installation shall not use cell phones unless the vehicle is safely parked or unless they are using a hands-free device. The wearing of any other portable headphones, earphones or other listening devices (except for hands-free cellular phones) while operating a motor vehicle is prohibited.
4.2.6. Weapons, Firearms, and Ammunition. Employees are prohibited from possessing weapons, firearms, or ammunition on themselves or within military, Contractor or privately-owned vehicles while on Holloman AFB.
4.2.7. For Official Use Only (FOUO). The Contractor shall comply with DoDM 5200.01-V4, Enclosure 3, DoD Information Security Program: Controlled Unclassified Information (CUI), requirements. This manual sets policy and procedures for the disclosure of records to the public and for marking, handling, transmitting and safeguarding FOUO material.
4.2.8. Reporting Requirements. Contractor personnel shall report to an appropriate authority any information or circumstances of which they are aware may pose a threat to the security of DoD personnel, Contractor personnel, resources, and classified or unclassified defense information.
4.2.9. Controlled/Restricted Areas. The Contractor shall implement local base procedures for entry to AF controlled/restricted areas where Contractor personnel will work. An AF Form 2586, Unescorted Entry Authorization Certificate, must be completed and signed by the sponsoring agency security manager before a restricted area badge will be issued. Contractor employees must have a completed and favorable National Agency Check with Inquires (NACI) or DoD-determined equivalent investigation, or greater, investigation before receiving a restricted area badge. Interim access can be granted in accordance with AFI 31-501, Personnel Security Program Management.
4.2.10. Video/Still Imagery Devices: The use or possession of any device capable of capturing video and still images is strictly prohibited within any controlled/restricted area without written authorization from the installation commander or his/her designated representative. Individuals will be denied access to restricted/controlled areas if in possession of these devices.
4.2.11. Portable/Personal Electronic Devices (PED): The use or possession of all PEDs used for storing, processing, and/or transmitting information is strictly prohibited within all areas where classified material is discussed, briefed, stored, or processed without written authorization from the Designated Approval Authority. Use of PEDs during training events is strictly prohibited.
4.2.12. Security Doors: Accessing/opening doors controlled or attached to an intrusion alarm system such as the Base Exchange must be coordinated through Security Forces, phone 575-572-5810.
4.2.13. Special Force Protection Operations: during force protection operations, Security Forces may deny access to HAFB without notice. Please contact your Contract Administrator and COR a soon as possible.
4.3. PHYSICAL SECURITY. The Contractor shall be responsible for safeguarding all Government property provided for Contractor use. At the close of each work period, all Government facilities, property, and materials shall be secured. The RCC shall be responsible for securing the Refuel Café nightly.
4.3.1. Key Control. The Contractor shall establish and implement methods of ensuring that all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. The Contractor shall not duplicate any keys issued by the Government. The Government requires keys/combinations to the Contractor’s area of responsibilities. The Contractor shall supply a key or combination to the Fire Department in the event of an emergency. (NOTE: ALL REFERENCES TO KEYS ALSO INCLUDE KEY CARDS. THE CONTRACTOR SHALL DEVELOP PROCEDURES COVERING KEY CONTROL THAT SHALL BE INCLUDED IN THE QUALITY CONTROL PLAN. SUCH PROCEDURES SHALL INCLUDE TURN-IN OF ANY ISSUED KEYS BY PERSONNEL WHO NO LONGER REQUIRE ACCESS TO LOCKED AREAS). Comment by REN, PATTI J CIV USAF AFMC 704 TSS/XPA: Could this be 4.3.15.?
4.3.1.1. Lost Keys. The Contractor shall immediately report to the COR any occurrences of lost or duplicated keys, compromised lock combinations, or use by unauthorized persons. Comment by REN, PATTI J CIV USAF AFMC 704 TSS/XPA: Could this be 4.3.15.1.?
4.3.1.2. In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon written direction of the CO, re-key or replace the affected lock or locks without cost to the Government. The Government may, however, at its option, may replace the affected lock or locks or perform re-keying and deduct the cost of such from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor. 4.3.1.3. Prohibit Use of Keys. The Contractor shall prohibit the use of keys or combinations, issued by the Government, by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor’s employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the CO. 4.3.2. Lock Combinations. The Contractor shall establish and implement methods of ensuring that all lock combinations are not revealed to unauthorized persons. The Contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations. These procedures shall be included in the Contractor’s Quality Control Plan. Comment by REN, PATTI J CIV USAF AFMC 704 TSS/XPA: Could this be 4.3.15.4.?
4.4. QUALITY CONTROL. Comment by REN, PATTI J CIV USAF AFMC 704 TSS/XPA: Paragraph number will be off if follow QAPC notes. Need to correct. Also, this would go under paragraph 2.X
4.4.1. Quality Control (QC) Program. The Contractor shall establish a complete QC program to ensure the requirements of this requirement are provided as specified. The contractor shall submit an initial quality control plan (QCP) at the time of offer submission. The QCP shall address project organization, personnel, and project management; technical approach; coordination procedures and activities and deliverables schedule; quality assurance and quality control procedures, and activities that will contribute to the successful execution of this contract. Specifically, the QCP shall address how the Contractor intends to meet the Government’s needs. The CO will notify the contractor of acceptance or required modifications to the plan before the contract start date. The contractor shall submit a final QCP to the CO for review within 10 days after award. The Contractor shall make appropriate modifications (at no additional cost to the Government) and obtain acceptance of the plan by the CO before the start of the first operational performance period.
4.4.2. Quality Assurance. The Government will periodically evaluate the Contractor’s performance by appointing a representative(s) to monitor performance to ensure services are received. The Government representative will evaluate the Contractor’s performance through intermittent on-site inspections of the Contractor's quality control program and receipt of complaints from base personnel. Results of the surveillance then become the official Air Force record of the Contractor’s performance. The Government may inspect each task as completed or increase the number of quality control inspections if deemed appropriate because of repeated failures discovered during quality control inspections or because of repeated customer complaints. Likewise, the Government may decrease the number of quality control inspections if merited by performance. The Government will also investigate complaints received from various customers located on the installation. The Contractor shall be responsible for initially validating customer complaints. However, the Government representative shall make final determination of the validity of customer complaint(s) in cases of disagreement with customer(s).
4.4.3. The COR(s) is the authorized Government representative(s) who will perform assessments of the Contractor’s performance. Subsequent to award, the identity of the COR(s), with a letter defining their duties and authority will be promptly furnished to the Contractor.
4.4.4. The COR(s) or alternate(s) will inform the Contract Manager when discrepancies occur and will request corrective action. The COR(s) or alternate(s) will make a notation of the discrepancy on their assessment checklist with the date and time the discrepancy was noted and will request the Contract Manager (or authorized representative) to initial the entry on the checklist.
4.4.5. Any matter concerning a change to the scope, prices, terms or conditions of this requirement shall be referred to the CO and not to the COR(s).
4.4.6. The services to be performed by the Contractor during the period of this requirement shall at all times and places are subject to review by the CO or authorized representative(s).
4.5. ENVIRONMENTAL CONTROLS.
4.5.1. Compliance with Laws and Regulations. The Contractor shall be knowledgeable of and comply with all applicable federal, state, and local laws, regulations, and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this requirement, the Contractor is required to comply as such laws come into effect. If there is an increase or decrease in cost as a result of the change, the Contractor shall inform the CO pursuant to notice requirements and negotiate a modification to the contract.
4.5.2. Notification of Environmental Spills. If the Contractor spills or releases any substance contained in 40 CFR 302 – Designation, Reportable Quantities, and Notification; into the environment, the Contractor or its agent shall immediately report the incident to Holloman AFB Fire Dept. at 572-7228. The liability for the spill or release of such substances rests solely with the Contractor and its agent.
4.6. SAFETY REQUIREMENTS. In performing work under this requirement, the Contractor shall:
4.6.1. Conform to the safety requirements contained in the contract for all activities related to the accomplishment of the work.
4.6.2. Take such additional immediate precautions as the CO may reasonably require for safety and mishap prevention purposes.
4.6.3. Develop and provide at the start of the orientation period or the start of the first operational performance period (if there is no orientation period) a safety plan for the protection of Government facilities and property and to provide a safe work environment for Contractor personnel.
4.6.4. Provide protection to Government property to prevent damage during the period of time the property is under the control or in possession of the Contractor.
4.6.5. Include a clause in all subcontracts to require subcontractors to comply with the safety provisions of this requirement as applicable.
4.6.6. Record and report promptly (within one hour) to the CO or designated Government representative, all available facts relating to each instance of damage to Government property or injury to either Contractor or Government personnel.
4.6.7. In the event of an accident/mishap, take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence until released by the accident/mishap investigative authority through the CO.
4.6.8. If the Government elects to conduct an investigation of the accident/mishap, the Contractor shall cooperate fully and assist Government personnel in the conduct of investigation until the investigation is completed.
4.6.9. Include a clause in each applicable subcontract requiring the subcontractor's cooperation and assistance in accident reporting and investigation.
4.7. NEW MEXICO GROSS RECEIPTS TAX.
The State of New Mexico assesses a Gross Receipts Tax for firms conducting business operation within the State without regard to the location of entity. You are advised that services and all construction materials and the associated services are taxable to governmental entities for gross receipts purposes. Any proposals/bids received will be presumed to include this cost of business and any request for adjustment or proposed/bid prices as a mistake in proposal/bid either before or after award of a contract will not be considered.
The tax rate applicable to a particular contractor (for work completed on Holloman Air Force Base) is based on the type of work performed and place of business (Out-of-State companies versus NM companies). New Mexico Taxation and Revenue Department publication FYI-200, Your Business Location and the Appropriate Tax Rate, explains the methods of determining the business location and the applicable tax rate, and is available on the Internet at http://www.tax.newmexico.gov/forms-publications.aspx. Select Gross Receipts Tax Rate Schedules and click on “Current Year Gross Receipts Tax Rate Schedules”.

4.8. RECORDS MANAGEMENT AND FREEDOM OF INFORMATION ACT (FOIA) REQUIREMENTS
4.8.1. Records Management (RM) (June 2017). The Contractor shall provide accountability and ensure all records and documents generated during the period of this contract are made available to the Government at all times. All information may be maintained electronically. All publications and forms will be available for contractor's use through the Holloman Publications Web Site. Any publications or forms that are required for the performance of this contract and are not available electronically are required to be maintained manually.
4.8.2. Freedom of Information ACT (FOIA) and Privacy Act (PA) (July 2015). The Contractor shall comply with DoDM 5400.7, DOD Freedom of Information Act (FOIA) Program and AFI 33-332, Air Force Privacy and Civil Liberties Program. These regulations set policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding Personally Identifiable Information (PII) material.
4.8.3. Contractor Records (June 2017). The Contractor shall maintain all Government records IAW AFMAN 33-363, Management of Records, paragraph 6.4., Contractor Support, in order to support the COR who is responsible for all lifecycle record management and all duties assigned to the organization's Record Professional (RP) (Tier-1 (T-1)).
