(d) Comptroller General Examination of Record. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. Instructions to Quoters

1. SUMMARY: This is a request for quotation (RFQ). Responses to this solicitation are considered quotes and not offers. In those instances where the words offer, offeror, and proposal are used, the reader should understand that the use of such words does not change the nature of this RFQ. The resulting award will be for a firm fixed-priced, multiple year purchase order contract for Laboratory Testing Services for the 452d Aerospace Medicine Squadron (AMDS) at March Air Reserve Base (MARB), California.

2. SUBMISSION OF QUOTES: Quotes must be submitted electronically to the email listed below no later than the date and time specified in block #8, page #1- Pacific Standard Time (PST). Faxed quotes will not be accepted. When submitting via email, limit attachment size to 2 MB. If necessary, multiple emails should be submitted. Evaluation Factors for Award

FAR 52.212-2 ADDENDUM

This section is for solicitation purposes only. This section will be physically removed from any resultant award but is deemed incorporated by reference.

Additional Quote Evaluation Information -- Addenda to 52.212-2 Evaluation - Commercial Products and Commercial Services:

A. This requirement is currently being procured as an unrestricted competition.

B. The Government intends to make an award without further discussions. Discussions, if necessary, will be conducted in accordance with FAR 52.212-1(g). Award will be made to the Submitter when the quotation conforms to all required terms and conditions, submits all required representations and certifications, meets all requirements set forth in the RFQ, and provides a fair and reasonably quoted Total Evaluated Price (TEP) to the Government based on the results of the evaluation as described in the paragraphs below.

Evaluation Process:

All quotes will be placed in price order from lowest to highest based on the Total Evaluated Price (TEP). The lowest ranked TEP Submitter's technical quote will then be evaluated and receive a rating of Acceptable or Unacceptable. To be rated as acceptable, the technical quote must meet the Government's minimum requirements. Quotations deemed Unacceptable are those that fail to meet the Government's minimum requirements.

If the lowest priced Submitter's technical quote is rated acceptable, the evaluation process will stop at this point as that quote represents the best value to the Government. Award shall be made to that Submitter without further consideration of any other quotes. If the lowest ranked TEP Submitter's technical quote is assigned an unacceptable rating or if the price is determined not fair and reasonable and poses an unacceptable risk to the Government, or if the quote is found to be non-responsible, the next lowest placed TEP quote will be evaluated. This process will continue (in order of ascending TEP) until a Submitter is evaluated to have an acceptable technical rating, fair and reasonable price, and the Submitter is deemed responsible or until all quotes have been evaluated.

Evaluation Factors: The following factors shall be used to evaluate quotes:

Factor 1: Technical Capability. Each Submitter's technical quote shall be evaluated as Acceptable or Unacceptable as defined below:

To be rated Technically Acceptable, the Submitter must provide a technically acceptable quote which clearly meets the requirements of the Performance Work Statement (PWS) objectives.

When evaluating the Submitter's technical quote, the Government will determine if the Submitter has met the following minimum requirements:

Submit a QCP with the quote.

Factor 2: Price: The Submitter's price quote will be evaluated to determine price completeness and reasonableness.

(a) Award will be made to the Submitter whose quote represents the best value to the Government, based on a Lowest Price Technically Acceptable (LPTA) basis between price and non-price factors - Technical Capability.

(b) Apparent mathematical errors. Overriding formulas within the Government provided pricing estimate worksheet may result in calculating errors and cause the price quotation to be inaccurate. It is highly encouraged that Submitters ensure that all pricing is entered correctly prior to submission to the Contracting Office. Quotes cannot be altered after submission.
