FAR 52.212-2 ADDENDUM

This section is for solicitation purposes only. This section will be physically removed from any resultant award, but will be deemed incorporated by reference.

52.212-2 Evaluation—Commercial Items

ADDENDA TO 52.212-2 Evaluation Basis for Award

This acquisition will utilize the Lowest-Price Technically-Acceptable (LPTA) source selection procedure under FAR Subpart 12, Acquisition of Commercial Items, and FAR Subpart 13, Simplified Acquisition

Procedures. The Government intends to make an award without discussions. Discussions, if necessary, will be conducted in accordance with FAR 13.106-2. Award will be made to the responsible offeror whose proposal conforms to all required terms and conditions, submits all required representations and certifications, meets all requirements set forth in the RFP, and provides the lowest offered Total

Evaluated Price (TEP) to the Government based on the results of the evaluation as described in the paragraphs below.

1. Part I – Technical Proposal

(a) Initially, the Government technical team shall evaluate the technical proposals on a technically acceptable or not technically acceptable basis based on following subfactors:

(1) The proposal clearly meets the minimum requirements in their Program Management plan that shows how the solicitation requirements will be accomplished.

(2) The proposal clearly demonstrates a sound approach for their staffing requirements, identification of key positions, and personnel qualifications assuring they have a clear understanding of the scope of effort required to accomplish the PWS.

(3) The proposal includes a financial capability letter from their financial institution, to be used in the

Contracting Officer’s determination of responsibility.

(4) The proposal’s System for Award Management (SAM) registration indicates it is a small business concern under NAICS 562910 – Remediation Services.

(5) The proposal includes completion of certifications under the provisions of FAR 52.212-3 Offeror

Representations and Certifications—Commercial Items in the System for Award Management (SAM) website at www.sam.gov.

(6) The proposal includes a certification from the State of California that personnel have training/certifications to perform lead cleanup/abatement.

(b) Technical Acceptability Ratings:

(1) Technically Acceptable – Proposal clearly meets the minimum requirements of the solicitation, and includes a financial capability letter from their financial institution; registered in SAM as a small business concern under NAICS 562910 – Remediation Services; completes required offeror representation and certifications in the SAM website www.sam.gov, and includes a certification the State of California that personnel have training/certifications to perform lead cleanup/abatement.

(2) Not Technically Acceptable - Proposal does not clearly meet the minimum requirements of the solicitation, and fails to include any of the required financial capability letter from their financial institution, not a small business concern under NAICS 562910 – Remediation Services; non-completion of the required offeror representation and certifications in the SAM website www.sam.gov, and does not include a certification from the State of California that personnel have training/certifications to perform lead cleanup/abatement.

2. Part II – Price Proposal

(a) Offers found to be technically acceptable under Part I, will be further evaluated for reasonableness and balance as follows:

(1) Reasonableness - The existence of adequate price competition is expected to support a determination of reasonableness. Price analysis techniques may be used to further validate price reasonableness. If adequate price competition is not obtained or if price reasonableness cannot be determined using price analysis of Government obtained information, additional information in accordance with FAR 15.4 may be required to support the proposed price.

(2) Balance - Offerors are cautioned against submitting an offer that contains unbalanced pricing.

Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of proposal analysis techniques. The Government shall analyze offers to determine whether there are unbalanced separately priced line items. Prices submitted will be compared and evaluated to assure that a logical progression exists as related to price and quantity changes within each offeror’s response to the pricing http://www.sam.gov/ structure in subparagraph 2(b) Total Evaluated Price (TEP) of this section. Offers that are determined to be unbalanced may be rejected if the lack of balance poses an unacceptable risk to the Government.

(b) Total Evaluated Price (TEP) - The provided quantities in the RFP (SF-1449) for each CLIN shall be multiplied by your proposed unit price to arrive at the total price for that CLIN. The TEP will be the sum of all CLINs which also includes all Option CLINs. The TEP should be the total amount entered in Block

26 of the SF-1449.

(c) Those proposals evaluated as not satisfying all of the price criteria may be eliminated from the competition unless the Contracting Officer determines:

(1) A minor clerical error has occurred, then the offeror may be given an opportunity to correct the minor error within the constraints of the “clarifications” process, or

(2) Discussions are required.
