GENERAL PROVISIONS FOR
MULTIPLE AWARD CONSTRUCTION CONTRACT (MACC)
(GeneralProvisionMACC 1June2011.doc)
1. DESCRIPTION OF WORK: The MACC is for a broad range of maintenance, repair and minor construction work as well as design build, on real property at Dyess Air Force Base, TX.
During the contract period, the Government will identify construction tasks required to complete each specific job. The Contracting Officer (CO)* will issue individual Delivery Orders to the contractor to complete those jobs. The jobs will include tasks in a variety of trades such as carpentry, road repair, roofing, excavation, interior (to include remodeling and interior modifications), electrical work, steam fittings, plumbing, sheet metal, painting, demolition, concrete masonry, welding, mechanical, and other general construction work.

2. PROGRAM MANAGEMENT: Contractor shall provide qualified key personnel to manage and execute Delivery Orders awarded under this contract. The program management staff shall have project design, quality control, construction and financial management capability.
2.1 COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK: Contractor shall be required to commence work by an agreed upon date specified in the Notice to Proceed (NTP) letter. The contractor shall complete the entire work not later than the negotiated performance schedule specified in the Delivery Order.
2.2 SUBCONTRACTORS: Within 7 days after the award of any subcontract at any tier, the contractor shall deliver to the CO a completed SF 1413 (Statement of Prime Contractor). (IAW FAR 52-222-11)
2.2.1 The prime contractor must have the ability to manage and control multiple subcontractors at multiple job locations. Also, the prime contractor must ensure subcontractors are competent and capable of handling all assigned tasks.
2.3 QUALITY CONTROL PLAN: Contractors receiving MACC awards are required to submit a Quality Control Plan for review and acceptance by the CO. The Plan should demonstrate methods for surveillance of work, (including subcontractors), and in-house contractor quality control inspectors.
Contractor’s proposed plan shall be submitted for approval with each contractor proposal – in response to each Government issued Request for Proposal. The approved Quality Control Plan will become a compliance document.
3. RESPONSE REQUIREMENT
3.1 The primary goal of MACC is speedy acquisition of Civil Engineering requirements, contractor responsiveness is paramount. Once the Contracting Officer notifies the contractor of an existing requirement, the contractor is expected to expeditiously prepare the proposal.
3.2 Upon notification of a routine requirement, the contractor shall respond to the needs of the Government as following within three working days (1) Visiting the proposed work site accompanied by the Contracting Officer, or (2) Establishing verbal contact with the Contracting Officer to further define the scope of the requirement.
3.3 In the event of an emergency requirement, the contractor’s response time will be as soon as directed by the Contracting Officer. The contractor or his/her designated representative who is able to make decisions and obligate the company must be readily available to communicate with Contracting Officer.
4. DESIGN DOCUMENTS, GENERAL: The design documents developed by contractor shall comply with Appendix A1-Special Design Considerations for Dyess AFB, Abilene, Tx and the following requirements:
4.1 The drawings, bid schedule and cost estimate shall be developed so that a distinction is made between items that are associated with each classification of work (i.e. Demolition, Minor Construction, Repair, and Additives). Whenever a project deals with various categories of work, notes shall be affixed throughout the contract drawings to clearly distinguish between work that is either repair or work that is Minor Construction. Allocate space on the title page for identification of Minor Construction (MC) and Repair (R) symbols. Entitle the space “CONSTRUCTION CLASS”. Use ¼” lettering as a minimum.
MC and R will identify work items on following sheets. When applicable, each work category and associated additive bid items shall be accounted for and priced separately on the AF Force Form 3052. In addition to the basic bid items for each work classification, the associated demolition and supervision costs shall also be determined for each category of work and noted on the AF Form 3052. Additive bid items shall be priced separately, complete with OH&P. Additive bid items that are associated with each work classification shall be noted on the drawings, cost estimate and bid schedule as well. When completing the final design submittals, the drawings, cost estimate and bid schedule shall clearly define the different items associated with each classification of work, including additive bid items. Note:
Submittals at 10%, 35%, 65%, 95%, and 100% (as applicable) design and submittal dates will be negotiated with the selected contractor. Once the Notice to Proceed is issued, construction may begin concurrent with design, but only to the level of the approved design.
4.2 Drawing: The Government will indicate which drawings are necessary for each individual project. It is not necessary for each drawing to be on an individual sheet, more than one can be on an individual sheet. Each sheet shall be on CAD format and have an approved title block and border. The CO shall require certification / P.E. signature on some or all designs. The title block shall contain project information including but not limited to project #, delivery order #, project name, and date. The contractor shall prepare the following drawings, based on the SOW, for Government approval prior to the start of construction:
(a) Cover sheet with Title and Approval block
(b) Existing Site Plan
(c) Final Site Plan
(d) Grading Plan
(e) Underground Utility Plan and Profiles
(f) Floor Plans
(g) Elevation
(h) Finish Schedule
(i) Wall and Roof Sections
(j) Window and Door Schedules
(k) Ceiling Plan
(l) Mechanical Plan
(m) Plumbing and HVAC Riser Diagrams
(n) Electrical Site Plan
(o) Power Plan and Panel Schedule
(p) Electrical Plan and Lighting Plan with Schedule
(q) Fire Protection Plan
(r) Telephone Plan
4.3 RENDERED PERSPECTIVE (when required)
4.3.1 When a rendered (color) perspective is required, the perspective shall clearly reflect the A-E’s intent to make the new building compatible to existing buildings in the vicinity of the site. The perspective shall be approximately 14” x 28” is size and shall be mounted on a Dyess AFB presentation board, complete with a small site plan and supporting data (i.e. size, cost of landscaping, site work, building, etc.) affixed to the presentation board. The presentation board will be provided upon request. The corners of all boards shall be trimmed to a round curve.
4.3.2 A black-line concept perspective shall be provided with the 35% submittal. The rendered perspective shall be delivered with the 95% submittal.
4.4 SPECIFICATIONS: Use Unified Facilities Guide Specifications (UFGS) that can be downloaded from the Whole Building Design Guide (www.wbdg.org) and generated using the SPECSINTACT system and editor. The SPECSINTACT editor has the capability to print out master UFGS specifications in Microsoft Word for ease in editing. All approved 100% specifications shall be submitted on CD ROM in pdf format.
4.4.1 Specifications Section 01110, Special Conditions, shall be developed using the attached Dyess AFB, TX – Special Conditions. Modify the Special Conditions to meet this project scope.
4.4.2 The bottom of each page shall have the following relative information indicated in the format noted:

4.4.3 The use or specification of materials not made in the United States is prohibited. Only American made products shall be used in this project.
4.4.4 Do not use Section 1300 of the guide specifications. In the submittal paragraph of each section of the specifications, delete submittal number and all references to “GA” and “FIO (For information Only)”.
Replace reference to “Section 1300” with edited “Dyess AFB, TX – Special Conditions.”
4.5 CONSTRUCTION COST ESTIMATE BREAKDOWN: Cost estimate shall be submitted using the AF Form 3052, or computer format similar to the AF Form 3052. Complete last page of cost estimate using appropriate percentages for Field Overhead, Profit, Home Office G & A and Bond. Repair and Minor Construction costs are to be submitted on separate AF Form 3052. The following describes the requirements for each of the three types of delivery orders that may be issued against this contract IAW Section H, paragraphs 3.3.1 through 3.3.3.
4.5.1 Design and Build (100%): The cost estimates for this type of requirement will consist of a one
(1) page per discipline maximum-not to exceed seven (7) pages, a cost summary and the last sheet where Field Overhead, Profit, Home Office G & A and Bond are inserted. The cost estimate shall not exceed a total of nine (9) pages.
4.5.2 Minimal Design Build: The cost estimates for this type of requirement will consist of a one (1) page per discipline maximum-not to exceed seven (7) pages, a cost summary and the last sheet where
Field Overhead, Profit, Home Office G & A and Bond are inserted. The cost estimate shall not exceed a total of nine (9) pages.
4.5.3 Construction: The cost estimate for this type of requirement shall consists of single line item/lump sum costs (including material, labor and other) for each designated discipline and the last sheet where Field Overhead, Profit, Home Office G & A and Bond are inserted
4.6 PREPARATION OF AF FORM 66, Schedule of Material Submittals: Required submittals shall be listed on the form in the format noted on the examples. Provide a separate line item number for each required submittal (i.e. samples, shop drawings, catalog data, or other descriptive elements would be line numbers 1, 2, 3 & 4, respectively). Contractor’s proposed draft of the AF Form 66 shall be submitted with the 95% submittal. Ensure all items requiring submittals are annotated on the AF Form 66.
Normally, three copies of printed matter and one or two material item(s) are requested. At the top of Description column, type “SECT” (Section) and “PARA” (Paragraph) on the left and right sides, respectively. Enter Section and Paragraph numbers in each block. In specific terms, indicate the submittal desired just beneath this information in the same block (See example). Using “Other” in the blanks under “No. of Copies Required” is permissible if this is done. Consecutively number each page of the submittal, e.g. “Page 1 of 1”. Use all line number rows on one page before starting another. Number submittals consecutively.
4.7 BID SCHEDULE: A Bid Schedule for each project shall be furnished.
5. DESIGN ANALYSIS: Comply with Appendix A2 – Design Analysis Format for all Dyess AFB Projects. The A-E shall submit design analysis for the following:
5.1 COOLING AND HEATING LOAD ANALYSIS: Perform a complete HVAC analysis using AF Form 108 or a computer program. If a computer program is used submit documentation that explains the program print out.
5.2 HARD COPY: A hard copy of the following calculations shall be submitted, to include code references, as applicable for each discipline, to show compliance.
5.2.1 STRUCTURAL: All design calculations
5.2.2 MECHANICAL:
a. Cooling and Heating Load Analysis.
b. Pump sizing and pump curves.
c. Pipe sizing.
d. Duct size.
e. Static pressure loss.
f. Control valve sizing.
g. Psychometric chart analysis.
h. Fan sizing and fan curves.
i. Catalog cuts of selected equipment.
j. Heat exchanger selection.
k. Heating and cooling load calculation.
l. Water demand and sewer flow.
5.2.3 ELECTRICAL:
a. Photometric data including foot-candle level.
b. Short circuit analysis.
c. All other appropriate calculations
6. CONTRACT DOCUMENTS SPECIAL REQUIREMENTS: The dimensions of all contract documents (i.e. drawings, specifications, etc.) shall be developed to reflect the English system of units (inches, feet, pounds, etc).
7. WORK HOURS: Normal duty hours for Dyess Air Force Base are 0730 through 1630, Monday through Friday. Work on weekends, recognized Federal holidays, or other than normal duty hours must be coordinated with the CO.
8. ORDER OF WORK: The Contractor shall coordinate all work with the CO and the Base Civil Engineer.
9. CONSTRUCTION SITE MAINTENANCE: Comply with Dyess AFB, TX – Special Conditions.
10. NOISE CONTROL: Comply with Dyess AFB, TX – Special Conditions.
11. SCHEDULING WORK: Comply with Dyess AFB, TX – Special Conditions and the following:
11.1 The Contractor shall at all times protect and preserve Government property within the work area and could be affected by the accomplishment of the work specified and indicated. Also, protect all parities and individuals within or near the work areas who could be endangered by the installation of the work.
Protection requirements include protecting the interior of the facility from inclement weather. Any actions necessary to provide adequate protection are solely the Contractor’s responsibility. Any temporary boarding of windows or doors must be painted Dyess color scheme to match the exterior.
11.2 Contractor is required to cover equipment that is to remain in place within the area of contract operations and protect it against damage or loss and store equipment that is removed in performance of work where directed or ruse in work as required by drawings and specifications. Equipment temporarily removed shall be protected and returned equal to its condition prior to starting work at no additional expense to the Government. Security for equipment or material that is to be reused and is removed for temporary storage shall be the sole responsibility of the contractor.
11.3 Contractor shall provide protective barriers for all grass, trees, shrubs, sidewalks, curbs and gutters within the construction boundary. Furthermore, such items, including grass, outside the construction boundary shall also be protected during delivery of materials and / or moving of equipment. Damages caused by the Contractor to existing grounds, plants, pavements, utilities, work by others, fixtures, or furnishings shall be repaired by the Contractor. Such repairs shall be of as good condition as existed before the damage, unless such existing work is scheduled for removal or replacement by the work requirements of the contract. This requirement also pertains to grading of site to remove all clods and grade irregularities prior to final inspection and acceptance. The Contractor may be required to install temporary fencing to protect the site, at no cost to the Government.
11.3.1 In some instances, furniture and portable office equipment in the immediate area shall be moved by the contractor and replaced to original position upon completion of the work. If the work required by the Delivery Order will not allow furniture and portable office equipment to be replaced to its original position, the CO will designate new locations by the contractor.
11.3.2 Delivery of materials and equipment shall be made with a minimum of interference to Government operations and personnel.
11.3.3 The work shall, so far as practicable, be done in definite sections or divisions and confined to limited areas which shall be completed before work in other sections or divisions is begun. The CO has final approval for variations to work areas.
11.3.4 The contractor shall maintain, on all construction sites with work in progress, approved and applicable copies of the following: SOW, drawings, BCE Work Clearance Requests and welding permits.
12. UTITLITY OUTAGES: Comply with Dyess AFB, TX – Special Conditions.
13. EXCAVATION REQUIREMENTS: Comply with Dyess AFB, TX – Special Conditions.
14. GOVERNMENT FURNISHED EQUIPMENT / MATERIALS
14.1 The Government reserves the right to provide Government furnished equipment / materials (GFE / GFM) that is on hand if it can be used by the contractor to complete a delivery order. The contractor, using its own resources, shall transport all GFE / GFM described on the delivery order at no additional cost to the Government. The GFE / GFM shall be transported from the Government storage area, or other area specified in the delivery order, located on Dyess AFB, to the work site indicated on the Delivery Order.
14.2 The contractor assumes the risk and responsibility for the loss or damage to GFE / GFM once the contractor receives possession of the GFE / GFM.
14.3 The contractor shall follow the instructions of the CO regarding the disposition of all GFE / GFM not consumed in performance of a delivery order.
15. GOVERNMENT EQUIPMENT ON THE SITE
15.1 All government equipment and material on each project is the property of the Government unless specifically noted otherwise. Contractor shall relocate all property that the Government retains title to on the installation as specified in the delivery order or follow the instructions of the CO.
15.2 Contractor is required to cover equipment that is to remain in place within the area of contract operations and protect it against damage or loss and store equipment that is removed in performance of work where directed or reuse in work as required by drawings and specifications. Equipment temporarily removed shall be protected and returned equal to its condition prior to starting work at no additional expense to the Government. Security for equipment or material that is to be reused and is removed for temporary storage shall be the sole responsibility of the contractor.
16. DISPOSAL OF WASTE: Comply with Dyess AFB, TX – Special Conditions.
17. APPLICABLE DESIGN & CONSTRUCTION STANDARDS, CODES AND REGULATIONS:
The latest edition of the following Standards (as a minimum) shall be used for all design and construction under this contract. If there is a conflict between these codes or regulations and these contract specifications, the most stringent requirements shall apply at all times. The contractor shall have a copy of each of these documents available for use during the term of this contract.

25. WARRANTY OF CONSTRUCTION: Comply with Dyess AFB, TX – Special Conditions and the following:
25.1 In addition to any other warranties in this contract, the Contractor warrants that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the Contractor or any subcontractor or supplier at any tier. This warranty shall not limit the Government’s rights under the Inspection and Acceptance clause of this contract with respect to latent defects, gross mistakes or fraud.
25.2 This warranty shall continue for a period of one (1) year, from the date of final acceptance of the work. If the Government takes possession of any part of the work before final acceptance, this warranty shall continue for a period of one year from the date the Government takes possession. In the event the Contractor’s warranty of this clause has expired, the Government may bring suit, at its expense, to enforce a subcontractor’s, manufacturer’s or supplier’s warranty.
25.3 The Contractor shall remedy, at the Contractor’s expense, any failure to conform or any defect. In addition, the Contractor shall remedy, at the Contractor’s expense, any damage to Government-owned or controlled real or personal property when that damage is the result of:
25.3.1 The Contractor’s failure to conform to contract requirements, or
25.3.2 Any defect of equipment, material, workmanship, or design furnished.
25.4 The Contractor shall restore any work damaged in fulfilling the terms and conditions of this clause.
The Contractor’s warranty with respect to work repaired or replaced will run for one year from the date of repair or replacement.
25.5 The CO shall notify the Contractor, in writing, within a reasonable time after the discovery of any failure, defect or damage.
25.6 If the Contractor fails to remedy any failure, defect or damage within a reasonable time after receipt of notice, the Government shall have the right to replace, repair or otherwise remedy the failure, defect or damage at the Contractor’s expense.
25.7 With respect to all warranties, express or implied, from subcontractors, manufacturers or suppliers for work performed and materials furnished under this contract, the Contractor shall:
25.7.1 Obtain all warranties that would be given in normal commercial practice, and
25.7.2 Require all warranties to be executed, in writing, for the benefit of the Government if directed by the CO, and
25.7.3 Enforce all warranties for the benefit of the Government if directed by the CO.
25.8 Unless a defect is caused by the negligence of the Contractor, subcontractor or supplier at any tier, the Contractor shall not be liable for the repair of any defects of material or design furnished by the Government. Also, the contractor shall not be liable for the repair of any damage that results from any defect in Government-furnished material or design.
25.9 The warranty enumerated herein does not preclude any manufacturer warranties in excess of one year as noted in the individual specifications sections. The Contractor should read each section carefully to ensure that he / she is aware of all warranties called for in this project.
26. WARRANTY / GUARANTEE RECORDS: Comply with Dyess AFB, TX – Special Conditions and the following:
26.1 The Contractor shall prepare Optional Form(s) (OF) 274, Equipment Warranty Certificate, and affix the certificate(s) to all warranted components of the equipment installed during the project. When a complete mechanical system has been installed, affix the OF(s) 274 to the Mechanical Room door also. If the warranted items are in a new facility, Optional Form(s) 274 shall be placed as mentioned above. The Construction Inspector will distribute the OF 274 to the Contractor during the Pre-Construction Conference. The Contractor shall place all OF(s) 274 on the appropriate equipment prior to final acceptance of the project by the Government.
26.2 The Contractor is required, prior to the final inspection to provide a listing of all equipment or material carrying a manufacturer’s warranty or as indicated in the specifications. Use the following summary for each item and attach manufacturer’s certificate as appropriate.

27. PROGRESS OF WORK: Comply with Dyess AFB, TX – Special Conditions and the following:
Contractor shall submit for approval all work schedules to the CO within ten calendar days after start of work unless otherwise specified. The reports contemplated by the clause titled “Schedules for Construction Contracts” shall be accomplished on and in accordance with instructions pertaining to AF Form 3064, Contract Progress Schedule, and AF Form 3065, Contract Progress Report. This requirement is applicable to delivery orders with a minimum performance period of 60 calendar days and a minimum dollar value of $100K, unless otherwise specified by CO.
28. MATERIAL APPROVAL SUBMITTAL FORM (AF Form 3000) (AF FAR SUP 5336.290):
Comply with Dyess AFB, TX – Special Conditions and the following:
28.1 Within 10 calendar days after issuance of NTP or as otherwise established by the AF Form 66, all material and articles requiring approval, as contemplated by the Materials and Workmanship Clause, shall be submitted by the contractor using AF Form 3000. The contractor shall catalog and maintain the submittals, as approved, to avoid repetitive duplication in subsequent delivery orders. All wall covering, carpet and other fabric type submittals will show the full pattern of material as a minimum. All applicable submittals shall be grouped in color boards as installed, i.e. carpet, paneling, chair-rail, wall covering and ceiling tile. Contractor is responsible for identifying and locating required materials for submittals to include matching any existing materials. Once a submittal is approved, future submittals for the same type item can be referenced by the use of the Form 66 numbering system.
29. CONSTRUCTION DATA WORKSHEET: The Contractor is required, prior to the final inspection, to submit a completed copy of the Construction Data Worksheet found at the end of this document. This worksheet is used by the Air Force to inventory and capitalize new work. The Contractor shall complete only those areas of the form that are applicable to the work included in this project.

If the work site is located in a restricted or controlled area, the contractor may experience delays due to compliance with entrance / exit requirements of restricted / controlled areas. The contractor shall not be compensated for reasonable delays in accessing the site. Also, due to the nature of restricted areas, the contractor may be requested to leave the restricted area at any given time. The CO may extend the contract performance time when area designations change while the contractor is working.
32. SAFETY AND HEALTH: Comply with Dyess AFB, TX – Special Conditions.
33. PRECAUTIONS AGAINST HAZARDS: Comply with Dyess AFB, TX – Special Conditions.
34. TOILET FACILITIES: Comply with Dyess AFB, TX – Special Conditions.
35. SELECTION PROCESS FOR INITIAL SUCCESSFUL MACC CONTRACTOR(S): Potential MACC Contractors should respond to the RFP by submitting all information required by Section 00110, "MACC CONTRACT PROPOSAL SUBMISSION AND EVALUATION REQUIREMENTS" and by preparing/submitting a 100% design package for seed projects 3 & 4 (seed projects 1 & 2 are provided at 100% designed). After review of all proposals submitted in response to the RFP, the government will select the successful MACC Contractor(s) by a "best value" process. The successful MACC Contractor(s) will each be awarded one seed project.
36. AIRFIELD REQUIREMENTS: Comply with Dyess AFB, TX – Special Conditions.
37. NOTICE TO PROCEED: A notice to proceed will be issued with each Delivery Order. The contracting officer reserves the right to determine the issue date of any notice to proceed.
38. DELIVERY ORDER PROCEDURES:
38.1 As requirements are identified, the government will issue Request for Proposals (RFP) that will describe the services required, along with the required proposal response time. A site visit will be scheduled with the contractor (s) to verify measurements and elements of work. Delivery Orders are the award of the services required under the RFP. The performance period shall be determined during discussions, and incorporated into the Delivery Order. All Delivery Orders issued hereunder are subject to the terms and conditions of this contract. Note: It is the Government’s intent to issue Delivery Orders with an established firm fixed price.
38.2 After award of initial contracts, it is the government’s intention to have contractors compete for Delivery Orders based on either best value, low price technically acceptable or low price. Typically the evaluation methods will correspond with the level of design or complexity of the proposal to be submitted. In most cases best value will correspond to a design build project, low price technically acceptable to minimal design, and low price to a pre-designed type solicitation. Each request for proposal will state the method of selection. The government may elect not to solicit to all awardees. This restricted competition may be to meet minimum order amounts, work requiring special skills or trades, or urgent and compelling schedules. Similarly, contractors may elect not to propose on all requirements.
38.3 Proposal Procedures: The following describes the procedures for each type of requirement the RFP could present: Note: Proposal preparation fees will not be provided to any competing MACC contractors.
38.3.1 Design and Build (100%): This type of RFP will typically contain little or no drawings or specifications; but will contain a Statement of Objective (SOO) that describes the required end product.
Based on the SOO, the contractor shall perform all investigation and design services necessary to provide the Government a 35% design package (Statement of Work (SOW) and Drawings) which describes how the contractor intends on meeting the requirements of the SOO. The Government will review the 35% design package for acceptability. The Government will either request price proposals based upon the acceptable design packages, or, issue a revised SOO and repeat the process. The Government will indicate which 35% design package(s) have been determined to be acceptable. Contractors with acceptable packages will be asked to provide a price proposal to include a proposed performance period.
Only the successful contractor will be required to design the project to the 100% level.
38.3.2 Minimal Design Build: This type of RFP will typically contain concept drawings and specifications and a limited SOW that describe the work included. Based upon the SOW, the contractor shall provide a 35% design, a priced proposal, and proposed performance period.
38.3.3 Construction: This type of RFP will typically contain 100% designed drawings and specifications for the contractor to propose pricing and performance period.
38.4 Liquidated damages, if applicable, will be identified on each Delivery Order.
38.5 PERIOD OF PERFORMANCE:
38.5.1 This contract provides for a basic year, to start on date of award and four consecutive one-year option periods to be exercised at the discretion of the government.
38.5.2 The contractor will propose period of performance for each Delivery Order. If necessary, the performance period will be negotiated. The Contracting Officer will have the final decision regarding performance period.
38.6 PERFORMANCE MEETINGS: Performance meetings will be held with the Contracting Officer or his/her designated representative, technical representatives, and the contractor. The meetings will be held weekly, or on an as needed basis, to discuss ongoing and upcoming projects, potential problems, any concerns, the contract in general and any other items that may need to be addressed.
39.0 DAVIS BACON WAGE RATES: The current Davis Bacon Wage Rate Decision(s) applicable to the particular construction project of the issued RFP will be incorporated into any resulting Deliver Order.
40.0 PAYMENT AND PERFORMANCE BONDS (IAW FAR 28.102): Payment and Performance Bond requirements pertain only to the issuance of Delivery Orders.
41.0 EXERCISE OF OPTIONS: Exercise of option is based on the Government’s need for continued service and past performance on this contract and other contracts the contractor may have. At time of exercise of option, the contractor will provide a list of current contracts and contracts completed within the last year. If performance is not acceptable, the option may not be exercised.
42.0 REPLACING MACC CONTRACTORS: Should one or more of the incumbent MACC contractor’s options not be exercised, or if termination of contract(s) occurs, the process for selecting replacement contracts shall follow the same process and procedures as used in selecting and awarding the initial basic MACC awards.
43.0 IDENTIFICATION OF CORRESPONDENCE: All correspondence and data submitted by the contractor under this contract shall reference the contract number, Delivery Order number, project number and project title.
