The submittals contemplated by the clause herein entitled "Material and Workmanship" shall be accomplished on and in accordance with instruction pertaining to AF IMT 3000, Material Approval Submittal.

H-7. ECONOMIC PRICE ADJUSTMENT

In order to protect the contractor and the government against significant market fluctuations, the unit prices shall be adjusted upward and downward based on material cost changes beyond the contractor’s control. The adjustment shall be based on the Bureau of Labor Statistics, Producer Price Index for the series WPU05810212, (Group: Fuels and related products and power and Item: Asphalt). In the event publication of the index is discontinued, the parties shall agree upon an appropriate substitute index.

A. Prices shall be reviewed and adjusted if requested by the contractor prior to issuance of each Task Order

(TO). The Government will also monitor the price index and adjust the Task Order via modification if there are significant decreases. The base period for the unit price will be May 2013. It will remain in effect for the duration of the contract and shall not be modified except in the event of significant changes in the scope of the contract.

B. The adjustment made will be the most current year and month available. For example, a TO is issued on 15

October and the most current index data is from August, the August index will be used for the adjustment.

C. Index figures subsequently revised by the Bureau of Labor Statistics (e.g., amending formerly released indices by removing or replacing components within the index, describing revisions by footnote or appendix, significantly altering the method of calculating the index, or any other method) may not warrant a retroactive price adjustment under the terms and conditions of this contract.

D. Price adjustments shall be executed via a contract modification to the task order.

E. Any price adjustments under this EPA clause shall be rounded to two decimal positions (e.g. $1.50)

F. Following are the materials subject to adjustment and the percentage of the adjustment:

*The percentage listed is the percentage adjusted. The remainder will remain fixed.

Requests shall not include adjustments in line items other than those listed above. Adjustments shall be for material only and shall not include adjustments for labor, indirect costs or profit.

The percentage established (Column C in the table above) shall be fixed for the duration of the contract and shall not be modified except in the event of significant changes in the scope of the contract.

G. Formula used for determining the adjusted Price (These prices are fictitious. Numbers were given as an example of how the calculation is to be performed)

i. Method 1 (Percentage of Material Adjusted )

Example:

Adjusted Unit Price Formula = [(I2 / I1) * S (P)] + [(1 – S) (P)]

I1 = Index for Base Period = (260.2 in May 2013)

I2 = Index for Adjustment Period = (280.2 in August 2013)

P = Base Unit Price = $1,000

S = Percent Subject to Adjustment = 25%

Adjusted Unit Price = [(I2 / I1) * S (P)] + [(1 – S) (P)]

= [(280.2 / 260.2) * .25 ($1,000)] + [(1 - .25) ($1,000)]

= (1.07686 * 250) + $750

= $269.22 + $750

= $1,019.22
