MAF SEWAGE LAGOON PUMPING
MALMSTROM AFB, MONTANA
09 APRIL 2024
This is a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation;
proposals are being requested and a written solicitation will not be issued.
This solicitation FA4626-24-Q-0020 is issued as a request for quotation (RFQ).
This is combined synopsis/solicitation document, and the incorporated provisions and clauses, are those in effect through the following:
• Federal Acquisition Circular (FAC) Number 2024-03, Effective Date: 02/23/2024
This requirement is being solicited as a Service Disabled Veteran Owned Small Business (SDVOSB). The North American Industry Classification System (NAICS) code is 562991, with a Small Business Size Standard of $9.0M.
Defense Priorities and Allocations System (DPAS) is not applicable.
Requirement Description:
The purpose of this combined synopsis and solicitations for the acquisition lagoon pumping services in accordance with the attached Performance Work Statement (PWS).
Place of Performance: Refer to the attached PWS.
Period of Performance: Requirements contract with an ordering period of five (5) years. Refer to the attached PWS for details on orders under this requirement.

Quotes must be sent via email to the above contracting personnel. Questions will not be accepted after 22 April 2024 at 2:00 PM MST. You may follow-up the quote submission with an email/call to ensure receipt if desired.
Notice to Offerors/Suppliers:
Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs.
The anticipated maximum contract value for this requirement is $2,500,000.00 for the entire contract.
The minimum contract value for each task order issued against this contract is $10,000.00 and the maximum contract value for each task order issued against this contract is $600,000.00.

FAR 52.212-1 Instructions to Offerors—Commercial Products and Commercial Services (Sep 2023) Addendum
(a) The following information is added to FAR 52.212-1 Instructions to Offerors—Commercial Products and Commercial Services (Sep 2023), starting with paragraph (m).
(1) When submitting your quotation, use Attachment 8, Amended CLIN Schedule, for the five ordering periods. The award Contract Line-Item Number (CLIN) structure is within this attachment.

(2) Include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services (Feb 2024) with its Alternate I (Feb 2024), and FAR 52.222-22 Previous Contracts and Compliance Reports (Feb 1999) with the offer. Attachment 3, Offeror Representations and Certifications and Attachment 4, Previous Contracts and Compliance Reports are provided to comply with this requirement.
(2) The proposed price shall be firm-fixed-price for the entire requirement.
(3) No additional terms and conditions affecting the total price offered will be accepted.
(4) By providing a quote, you are agreeing to adhere to the solicitation and all attachments.
(5) Your quotation must remain valid until 30 July 2024.
(6) Each offeror shall submit the Past Performance Worksheet (Attachment 7). The offeror shall submit up to three (3) past performance contracts. The offeror shall choose past or current contracts (within the last three years) that show a measure of the offeror’s ability to successfully perform based on previous and current contract efforts. Sections A and B within the worksheet are required to be completed by the offeror. Section C will be completed by the 341st Contracting Squadron during the evaluation phase.
Evaluation Criteria:
FAR 52.212-2 Evaluation—Commercial Products and Commercial Services (Nov 2021) applies to this acquisition and the specified evaluation criteria will be included in paragraph (a) of that provision.
FAR 52.212-2 Evaluation—Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Specific evaluation criteria is included in paragraphs (A) through (H) of this provision:
A. Quotations will be evaluated based upon conformance to the provision FAR 52.212-1 Instructions to Offerors Addendum (listed above) for completeness. Nonconformance to Instructions to Offerors may be deemed incomplete and evaluation of the quote will cease.
B. The Government seeks to award to the responsible Offeror whose quote represents the best value to the Government considering price and past performance. Only one award will be made as a result of this solicitation.
C. Two evaluation factors will be used to evaluate quotes: price and past performance.
(i) Factor 1: Price.
Offerors shall be ranked by lowest total price per gallon for the five year ordering period in ascending order from lowest priced to highest.
(ii) Factor 2: Past Performance.
Offerors shall submit three (3) past performance contacts using the Past Performance Worksheet (Attachment 7). The Government will utilize the reference list provided to conduct past performance assessments. It is the offeror’s responsibility to ensure point of contact information within Attachment 7 is current and accurate. The Government will make reasonable attempts to contact the point of contact to gather data. The procedures at FAR 13.106-2(b)(3) to evaluate past performance. Each offeror will receive an overall rating of one of the following within past performance:
PERFORMANCE ASSESSMENTS
Rating Description
Exceptional
The Contractor’s performance meets the solicitation requirements and exceeds many (requirements) to the Government’s benefit. The contractual performance may have been accomplished with few minor problems.
Very Good
The Contractor’s performance meets the solicitation requirements and exceeds some (requirements) to the Government’s benefit. The contractual performance may have been accomplished with some minor problems.
Satisfactory The Contractor’s performance meets the solicitation requirements.
The contractual performance contained some minor problems.
Marginal Performance does not meet some of the solicitation requirements.
The contractual performance may reflect a serious problem.
Unsatisfactory Performance does not meet most of the solicitation requirements and recovery is not likely in a timely manner.
Neutral Unable to assess or validate the reference.
D. The following steps shall be used to evaluate offers:
Step 1: Evaluate all quotes for completeness.
Step 2: Sort all complete quotes based upon offeror’s total price lowest to highest.
Step 3: Evaluate lowest price offeror’s past performance. If past performance is evaluated at an “Exceptional,” evaluation is complete. If the lowest priced offeror’s past performance is not “Exceptional,” evaluate the next lowest priced offeror’s past performance. Continue evaluating next lowest priced offeror’s past performance until an offeror is rated “Exceptional” or until all offerors are evaluated.
Step 4: Make a Best-Value decision based on performance evaluation and a determination that the price is fair and reasonable.
E. Best Value Determination – The Government will conduct an integrated assessment of the complete, acceptable offers to determine best value on a minimum of three (3) offerors from lowest to highest priced, unless fewer are received. As such, this may result in award to a higher priced, greater past performance rated offeror.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Important Notices:
In accordance with FAR 52.212-1(g), The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest;

Base Access: All personnel requesting access to Malmstrom Air Force Base must possess a valid State or Government picture identification card. Furthermore, individuals presenting identification cards from a state that is non-compliant with the REAL ID Act will require additional documentation to gain unescorted base access. Additional documentation includes a valid U.S. or foreign government issued passport, an employment authorization document that contains a photograph, or identification cards issued by federal, state, or local government agencies that include a photo and biographic information. Personnel requesting vehicle access to Malmstrom Air Force Base must provide a valid driver's license, current vehicle registration, and valid vehicle insurance.

DAFFARS 5352.201-9101 AFGSC OMBUDSMAN (JUL 2023)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution.
Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
(c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, for AFGSC (Air Force Global Strike Command) acquisitions please contact the Director of Contracts, Air Force Installation Contracting Center, Operating Location - Global Strike (AFICC/KG OL-GSC) via the following e-mail workflow address:

Concerns, issues, disagreements, and recommendations that cannot be resolved at the Center/MAJCOM/DRU/SMC ombudsman level, may be brought by the interested party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (571) 256-2395, facsimile number (571) 256-2431.
(d) The ombudsman has no authority to render a decision that binds the agency.
(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the contracting officer.
