Performance Work Statement Chemical Toilets Service

1.0 DESCRIPTION OF SERVICES/GENERAL INFORMATION

1.1. Description of Services. The contractor shall provide all equipment, tools, materials, transportation, personnel, labor, supervision, and management necessary to perform Chemical Toilets Leasing, Servicing and Relocation services at the 150 Launch Facilities (LF) assigned to Malmstrom Air Force Base (MAFB), MT. Any reference to MAFB in this document includes the 150 LFs assigned to MAFB.

1.2. Scope. The contractor shall provide 150 Enhanced Access size no smaller than 58” x 58” and no larger than 64” x 64” chemical toilets, set up of toilets on location and provide service and maintenance to the toilets once per month. Set up will include shimming/leveling to an acceptable standard for use. Services shall be completed at the site of each toilet during the hours of daylight, if possible. If the scheduled service day is a holiday, the contractor shall service all units the workday prior to, or after the scheduled service day. If the contractor wants to perform services outside of these hours and day, the contractor must coordinate, at least one week in advance, with Government Contracting Officer’s Representative (COR). Performance outside of these hours and days will be at no additional cost to the Government. Services shall consist of mileage, pumping the holding tanks, washing the units inside and outside, air freshener, hand soap/sanitizer, fresh water, anti-freeze for winter months and furnishing a minimum of two rolls of toilet paper for each toilet. At the end of the performance period the toilets will become the property of the Government.

1.2.1. Scheduling. Upon contract award, the contractor shall submit a written schedule monthly to the Contracting Officer (CO), designating the day(s) of the week the contractor will perform services, and include a plan of how the contractor intends to perform services of all chemical toilets.

1.2.2.1. Out-of-Schedule Servicing. The contractor shall perform out-of-schedule servicing of chemical toilets within 24 hours of notification by COR.

1.2.2.2. Special Event Servicing. The contractor shall perform special event servicing within 24 hours of notification by the COR. Special event servicing will be invoiced on a separate line item as identified in the contract. Special events include but are not limited to MAFB exercises, or sponsored events and are not included in the quantities noted in paragraph 1.2.

1.2.2.3. Inaccessible Toilets. The contractor shall attempt to service each toilet. If the toilet is inaccessible due to weather or access road conditions, the contractor will contact the COR within 24 hours or upon the next duty day. Personnel will not be sent to clear snow from around the toilet nor is a contractor expected for the contractor to clear snow from around the toilet. The Government will not be responsible if a contactor vehicle becomes stuck attempting to access impassible roads.

1.2.3. Transport and Disposal of Waste. The contractor shall comply with all Federal, State, and local laws, regulations, and ordinances while transporting waste for disposal. The contractor shall dispose of all waste at an off- base permitted site.

1.2.3.1. Relocations. The contractor shall relocate any chemical toilet within 24 hours of notification by COR. Relocations will be invoiced on line item X002 per request.

1.2.4. Blown/Knocked Over Toilets. The contractor shall secure toilets to the ground to prevent tipping, in the manner they deem necessary. Stakes may be used to secure, however may not exceed 4” in length. Preferred method of tipping prevention is securing using other methods than staking if possible. If tipping occurs, the COR will contact the contractor to set the toilet upright. Services on the tipped unit should be within 24 hours of notification by COR. The contractor shall thoroughly clean any spillage resulting from blown/knocked over toilets. The contractor shall provide any necessary personal protective clothing and equipment for contractor personnel. The contractor shall not dig deeper than 2” to clean any spilled chemicals. Replacement/cleanup of knocked over/blown over latrines will be invoiced on line item X002 per request. If a spill occurs please contact the 341st Civil Engineering Squadron, Environmental Office, at 406-731-3665 with the details of the spill and the estimate of the spill volume.

1.3. Vandalism and Personal Injury. The contractor shall report, in writing, acts of vandalism, theft, or apparent willful act of damage of toilets to the MAFB Security Forces, CO, and COR. The contractor shall cooperate with Government personnel and provide a written statement of facts for the Security Forces, when requested. The government will not be liable for damage associated with unauthorized use/vandalism or damage caused by weather or other natural events. The vendor is responsible for any cost incurred due to normal wear and tear of the unit.

1.4. Location of Chemical Toilets. Location of Chemical Toilets. Portable toilets must be placed outside the LF on Air Force property, no closer than 10 feet to the fence (unless approved by the COR or CO) and not to extend beyond 25 feet from the fence per as built drawings. Toilet may not interfere with gate operation or hinder vehicles entering the site. Situate toilet so toilet door faces the direction indicated by the COR (see Appendix 2). Final determination of placement of toilets will be made by the COR or CO.

2. SERVICES SUMMARY

The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold describes the minimum acceptable levels of service required for each requirement.

These thresholds are critical to mission success. Procedures as set forth in the FAR 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies.

2.1. Periodic Progress Meetings. The CO, COR, COR Supervisor, other Government personnel as appropriate, and the Contractor shall meet quarterly to discuss the Contractor’s performance. The following issues shall be discussed: opportunities to improve the contract, any modifications required of the contract, unsatisfactory complaints and trends against performance objective observed, and positive performance and steps taken by the Contractor to prevent unsatisfactory occurrences in the future. The Contractor shall provide a summation of customer complaints and provide insight into any identified trends.

The minutes of these meetings will be reduced to writing, signed by the CO and any other signatures as deemed appropriate, distributed to the functional area and the Contractor. Should the Contractor not concur with the minutes, the Contractor shall provide a written notification to the Contracting Office identifying areas of non-concurrence for resolution within one week upon receipt of minutes.

3.1. GOVERNMENT FURNISHED PROPERTY AND SERVICES

3.2. Emergency Services. The Government will provide security forces services. Call Missile Security Control at 406-731-6850. There are no emergency medical services available on MAFB. Therefore, the contractor shall call 911 in case of medical emergencies.

4.1. GENERAL INFORMATION

4.2. Contract Manager. Upon contract award, the contractor shall designate a primary, and at least one alternate Contract Manager (CM), who will be responsible for performance of services. The contractor shall submit the names and telephone numbers of the primary and alternate(s) CM, in writing, to the CO. The contract manager or alternate(s) shall have full authority to act for the contractor on all matters relating to daily operation of this contract. The contract manager or alternate(s) shall be available within 60 minutes, either in person or by telephone, during normal duty hours to discuss performance issues or problems with Government personnel. The CM may be a contractor employee providing services in accordance with the contract.

4.2.1. Contract Manager Experience. The primary and alternate CM must have experience performing services described in this Performance Work Statement (PWS).

4.3. Contractor Employee Restrictions. The contractor shall not employ persons for work on this contract if such employee is identified to the contractor by the CO as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population.

4.3.1. Conflict of Interest. The contractor shall not employ any individual who is an employee of the United States Government if the employment of that individual would create a conflict of interest, nor shall the contractor employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval of the employment in accordance with Department of Defense Directive (DoDD) 5500.07-R, Standards of Conduct. In addition, the contractor shall not employ any person who is an employee of the Department of the Air Force if such employment would be contrary to the policies contained in AFI 64-106, Air Force Industrial Labor Relations Activities.

4.3.2. Military Personnel. The contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station (PCS), change in duty hours, or deployment. Military reservists and National Guard members may be subject to recall to active duty. The abrupt absence of these personnel could adversely affect the contractor’s ability to perform. Their absence at any time shall not constitute an excuse for non-performance under this contract.

4.3.3. Illegal Aliens. Illegal aliens without a valid work permit are unauthorized on MAFB. The contractor shall not hire illegal aliens to perform contract services on MAFB or in the missile field, nor attempt to bring illegal aliens on the installation. Corrective/punitive action will be taken against the contractor and the illegal alien if the contractor hires illegal aliens to perform contract services on MAFB or in the missile field.

4.3.4. Contractor Employee Conduct. The Government reserves the right to require removal from the contract any contractor employee who endangers persons or property, whose actions are inconsistent with professional conduct, whose continued employment is inconsistent with the interest of military security or who is found to be incapacitated or under the influence of alcohol, drugs, or other substances. Removal of employees for any reason does not relieve the contractor of the requirement to perform services specified herein.

4.4. Federal Holidays. MAFB recognizes the following Federal Holidays. The contractor is not required to perform services on the following Federal Holidays.

4.5. MAFB Official Hours of Operation. The official hours for MAFB are from 7:00 a.m. to 4:30 p.m., Monday-Friday, excluding federal holidays.

4.5.1. Normal Duty Hours. The normal duty hours for 341 Security Forces Group (341 SFG) are from 7:00 a.m. to 4:30 p.m., Monday-Friday, excluding federal holidays. COR’s are usually available during these times. However, Missile Alert Facilities are manned 24 hours a day, 7 days a week, with no exceptions.

4.5. Cooperation with Other Contractor Personnel. The Government may award other contracts for additional work. The contractor shall fully cooperate with other contractors and Government employees and fit its own work to such other work as may be directed by the CO. The contractor shall not interfere with the performance of work by any other contractor or Government employee.

4.6. Contractor Vehicles. All contractor vehicles shall be properly registered and meet all local, state, and federal safety and emissions requirements. Each contractor vehicle shall have the contractor’s logo neatly exhibited on each side of the cab and the name of the contractor’s business. Vehicles shall be in satisfactory mechanical condition and present a neat and clean appearance. Any vehicle(s) not so maintained may be ordered removed at the sole discretion of, the CO until satisfactory repairs are made. Vehicle-mounted communication equipment shall conform to all applicable base and federal frequency regulations and avoid conflict with existing frequencies.

4.7. Safety. The contractor shall comply with all applicable laws and safety regulations. Compliance with OSHA and other applicable laws and regulations for the protection of contractor employees is exclusively the obligation of the contractor, and the Government will assume no liability or responsibility for the contractor’s compliance or non-compliance with such responsibilities. The contractor shall provide all personal protective clothing and equipment for contractor employees.

4.7.1. Fire Prevention and Safety Standards. Contractor employees shall comply with the Occupational Safety and Health Act (OSHA), Malmstrom AFB Fire Protection Program, Air Force Occupational Safety, and the Fire Prevention and Health Program.

4.7.2. Safety Data Sheet. Upon contract award, the contractor shall submit a Safety Data Sheet (SDS) to the CO and COR for all chemicals used in servicing and/or servicing the portable toilets.

4.8. Illegal Substances. Illegal substance possession and/or use will not be tolerated. The contractor shall ensure that contractor employees do not possess and/or use illegal substances. All contractors and subcontractors are required to adhere to all local, state and federal laws concerning possession and/or use of illegal substances. Contractors found to be in possession of illegal substances will be barred from the contract, and subject to arrest and prosecution by local authorities.

4.9. Continuation of Essential DoD Contractor Services During Crisis. This requirement has been determined not to be essential and does not require continued support during a crisis as defined in DoDI 3020.37, E2.1.1 and E2.1.3.

4.10. Security Requirements

4.10.1. For Official Use Only (FOUO). The contractor shall comply with DoDD 5400.07, Chapter 4, DoD Freedom of Information Act (FOIA) Program requirements. This regulation sets policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding FOUO material. FOUO or FOIA material discovered by the contractor or contractor employees shall not be retained by the contractor and surrendered immediately to an appropriate Government authority.

4.10.2. Reporting Requirements. Contractor employees shall immediately report to an appropriate Government authority any information or circumstances of which they are aware that may pose a threat to the security of Department of Defense personnel, contractor personnel, resources, and classified or unclassified defense information.

4.10.3. Key Control. If the contractor is issued Government keys, the contractor shall establish and implement methods of ensuring all keys issued to the contractor by the Government are not lost or misplaced and are not used by unauthorized persons. The contractor shall not duplicate any keys issued by the Government.

a. The contractor shall immediately report any occurrences of lost or duplicated keys to the COR and 341 SFG.

b. In the event keys, other than master keys, are lost or duplicated, the contractor may be required, upon written direction of the CO, to re-key or replace the affected lock or locks without cost to the Government. The Government may, however, at its option, replace the affected lock or perform re-keying and deduct the cost of such from the monthly payment due the contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the contractor.

c. The contractor shall prohibit the use of keys and/or cipher lock combinations, issued by the Government, by any persons other than the contractor’s employees and the opening of locked areas by contractor employees to permit entrance of persons other than contractor employees engaged in performance of contract work requirements in those areas.

4.10.4. Restricted/Controlled Access Areas. Contractor personnel shall avoid restricted and controlled areas unless work is to be accomplished in those locations and the necessary coordination has been made. Strict security and personnel access control is maintained in these areas. The area within the fenced adjacent to the toilets are restricted/controlled areas and entry is prohibited and not expected. Contractor must contact the appropriate Security Control Center upon arrival to service toilets.

4.11. CONTRACTOR FULL-TIME EQUIVALENT REPORTING

The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil.

Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY), which runs 1 October through 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the CMRA help desk.

Uses and Safeguarding of Information: Information from the secure web site is considered to be proprietary in nature when the contract number and contractor identity are associated with the direct labor hours and direct labor dollars. At no time will any data be released to the public with the contractor name and contract number associated with the data.

User Manuals: Data for Air Force service requirements must be input at the Air Force CMRA link. However, user manuals for government personnel and contractors are available at the Army CMRA link at http://www.ecmra.mil.
