About this file

This is a Sources Sought Questions and Answers document for federal contract opportunity FA462526Q10132 concerning the T-38 Virtual Reality Procedures Training Tactics (VRPTT) system.

The document addresses four key inquiries from potential contractors regarding intellectual property, data rights, and licensing requirements for VRPTT sustainment activities. The Government clarified that the licensing requirement refers specifically to source code licensing. Regarding technical documentation, the Government indicated that the technical data package, software baseline, interface documentation, and engineering artifacts necessary for sustainment, troubleshooting, calibration, modification, and aircraft configuration updates are all proprietary and will not be provided. The Government does not own the rights necessary to permit a follow-on contractor to perform software modifications and system updates without original equipment manufacturer coordination. Additionally, the VRPTT system source code is proprietary, which restricts the Government's ability to enable full and open competition for sustainment activities. These responses indicate that prospective contractors must possess or obtain appropriate source code licensing and authorization from the current system owner to perform work on this Air Force contract.

FA462526Q10132 Sources Sought Questions – Answers in red text.

1. The Sources Sought notice states that contractors "shall have the licensing required to perform work on the T-38 VRPTT system." Could the Government clarify whether this licensing requirement refers to software licenses, OEM authorization, access to proprietary technical data, or another licensing mechanism? The licensing requirement refers to source code licensing.

2. Will the Government provide access to the technical data package (TDP), software baseline, interface documentation, and other engineering artifacts necessary to perform the sustainment, troubleshooting, calibration, modification, and aircraft configuration update activities identified in the PWS? All of that is proprietary.

3. Does the Government own the rights necessary to allow a follow-on contractor to perform software modifications and system updates, or are there third-party intellectual property restrictions that would require coordination with the original equipment manufacturer? No.

4. Is the current VRPTT system contractor-owned/proprietary, or does the Government possess sufficient data rights to enable full and open competition for sustainment activities? The VRPTT system source code is proprietary.
