Dear Mr. Hernal1dez:
Tbree samples of tbe exterior siding of buildillg 13()22 (Cllapel II) were collected. TIle average vallIe of tile lead-ill-paint was 65,117 ltlg/kg. TIle paint meets the Jefitlition of "lead-based paint" and exceeds 1,()()O ppm atld any residual waste must be considered to be "llazardotls" as set fortll ill EPA-RCRA.
The painted exterior concrete footing of tIle IJuildillg was sampled and the average concentration of lead-in paint was t io mg/kg. TIle paint does not meet the definition of "lead-based painl ."
Since tIle concentration exceeds S() ppln, tIle waste must be considered to be "llazardolls" atId subsequent testing of waste and residual water will be required to cilaracterize same, The brown-painted lland rail at tIle north entry was sampled and the lead-in-paitlt concentration was 74,()86 mg/kg. TIle paint meets tIle definition of lead-based paint and "hazardous" waste as set forth at RCRA.
The black-painted hallcl rail at the soutll entry was sampled and the lead-in-paint concentration was 9() lng/kg. Wbile t.lIe paint does riot meet tile definition of "lead-hased paint", tIle paint is to be considered a Califonlia "hazardous" waste, wllile being non hazardous as set forth at RCRA.
1'llC brown-paillt 11lclallcHlvers located on tIle east side, adjacent to mecllanical room, lead-it, paint concentration was 74,()85 mg/kg. TIle paint meets the definition of "lead-based paint" and rcsidttal waste is to he COIlsidered a "Ilazardous" waste as set fortil at RCRA.
OSI-IA regtJations (29 CFR 1926.62)requires employers to protect against over expoStlre of their employees whenever, regardless of concentration, lead is present.
