DIVISION

SECTION 01 57 20, ENVIRONMENTAL PROTECTION Atch 1

1.0. DESCRIPTION OF SERVICES:

1.1. The contractor shall provide all management, licenses, laboratory testing (as required), tools, supplies, equipment, materials, transportation, and labor necessary to implement integrated pest management and control methods at Vandenberg Air Force Base (VAFB), California to include off-site locations. Pest inspection and treatment shall be accomplished in accordance with the approved Integrated Pest Management Plan. Interior and exterior pests can include but are not limited to: weed abatement, invasive species eradication, bats, cockroaches, crickets, spiders, millipedes, centipedes, beetles, gnats, ants, flies, fleas, termites, bedbugs, mosquitoes, wasps, bees, hornets, birds (to include migrating birds), and rodents; animal trapping and snake removal. Dead animal odor in buildings will require carcass removal, sanitization, and deodorizer. For the DoD definition of Pest, see Section 12.

Inspection and general pest control shall include carcass, hive, and bird nest removal (including migrating bird nests) and hanta virus cleanup. The contractor is responsible for coordination with each appropriate Air Force agency, as required. All actions must comply with Federal laws including, but not limited to, applicable parts of 29 Code of Federal Regulations (CFR) 1910, Labor, Occupational Safety and Health Standards, 29 CFR 1925, Labor, Safety and Health Standards for Federal Service Contracts, 40 CFR 150-189, Protection of Environment, Pesticide Program, and 49 CFR 171, Transportation, General Information, Regulations, and Definitions. In addition the Endangered Species Act, Migratory Bird Treaty Act, Clean Air Act, Clean Water Act and Toxic Substances Control Act. Full compliance with Executive Orders regarding actions related to management of Migratory Birds, Invasive Species, and other topics is required.

1.2. All service calls issued under this contract will be issued to the contractor on the Government Civil Engineer Work Clearance Request, Form 332, via e-mail or fax. This form will include the name of the requester, contact number, the date of request, a control number, summary of work to be performed.

The contractor will provide a cost estimate after an on-site survey. Pest control work shall only begin after approval from the Installation Pest Management Coordinator (IPMC) or the contract Contracting Officer Representative (COR).

1.3. Burrowing Rodent Control (ground squirrels, gophers, moles, etc.): Grounds will be surveyed , treated, and all mounds, holes, or burrows will be flattened within the area treated. Rodent carcass removal from the treated area(s) is required and it will be the contractor's responsibility to dispose of property in accordance with local laws and regulations. Burrowing rodent control will require one initial treatment with two follow-ups.

1.4. Pesticide Usage Reporting. Contractor shall submit all pesticides application data to the IPMC no later than the 5th day of the month for the prior months applications. See para 6.5 for data reporting requirements.

1.5 Emergency Services. In the event of a pest emergency, the IPMC may issue a verbal tasking to the contractor. The contractor shall respond within 60 minutes to emergencies, which occur during normal hours of operation, and within two hours when outside normal business hours, holidays, and weekends. "Response" shall be the deployment of personnel qualified to treat the pest emergency. Emergencies may consist of, but are not limited to, bees or wasps, a hazardous vector, and/or any other pest issues that are considered a health and safety risk.

1.6. Pesticide Selection. The contractor shall use methods that are most effective and do not contribute to non-point source pollution. Local policy prohibits any pesticide that may cause secondary poisoning to predators. Pesticides selected for use the installation shall be approved for use in the State of California and listed by the Armed Forces Pest Management Board (AFPMB).

Each selected pesticide is subject to approval by the IPMC and the Air Force Civil Engineer Center (AFCEC) entomologist. Pesticides chosen shall have the lowest toxicity, least environmental impact, minimal exposure to non-target organisms and shall rapidly degrade in the environment..

1.7. Pesticide Mixing and Storage. All pesticides shall be mixed and stored off base. All unused pesticides, empty pesticide containers, and residue shall be disposed of off base. In the event the contractor spills or releases any hazardous substance, the contractor shall immediately notify the government and take appropriate action. See Paragraph 8.0, Spill or Release and Cleanup Requirements.

2.0. GOVERNMENT PROVIDED SERVICES: N/A

3.0. GENERAL INFORMATION

3.1. Quantity of Work. The actual quantity of service calls will vary from month to month.

3.2. Work Standards. The contractor shall comply with industry standards, laws, and regulations and the Performance Work Statement (PWS)

3.3. Required Approval for Pesticide Products. The contractor will provide the IPMC with labels and MSDSs for all proposed pestricide materials at contract award. IPMC will submit labels and MSDS to the AFCEC Entomologist for coordination and possible approval. Any request during the contract period to use unauthorized (pesticides that are not included on the DoD approved pestide list) pesticides will be forward to the AFCEC Entomologist for coordination and possible approval prior to use.

3.4. Food-handling Facilities, Child Development Center, and Youth Center, and Medical Facilities.

When a service call is requested by the government at one of these facilities, the contractor shall brief the facility managers on appropriate IPM methods to prevent and reduce pest infestations.

The contractor shall coordinate these call requests with the Public Health Office, 30 MDOS/SGOL,

(805) 606-0648, prior to any type of pesticide application.

3.5. Contract Manager. The contractor shall appoint a member of their management team who, irrespective of other responsibilities, shall have defined responsibility and authority to make relevant program decisions, and be able to communicate clearly and effectively with the IPMC or COR. The name of this person, and his/her alternate(s) who shall act on behalf of the the contractor shall be designated in writing to the Contracting Officer (CO) no later than start date of contract, and within 3 business days of changes in personnel.

3.6. Appointments: The contractor shall coordinate with and schedule an appointment with an appropriate timeframe with the facility manager(s) for all inspections and treatments.

3.7. Missed Appointments. When the contractor cannot make a scheduled appointment, the contractor shall contact the facility manager prior to the scheduled appointment and reschedule.

3.8. Customer Complaints. The COR will validate each customer complaint received.

3.9. Re-performance of Services. Re-performance of service (call back) may only be requested by IPMC or the COR and shall be completed within 24 hours of notification unless otherwise noted. If re-performance is necessary it shall be completed at no cost to the government. If a call back is required the contractor shall be notified in writing.

4.0. HOURS OF OPERATION.

4.1. Normal Hours of Operation. The Government program office hours are Monday through Friday, 0700 – 1700, and closed on Federal Holidays.

4.2. Federal Holidays. VAFB observes the following federal holidays.

New Year’s Day Martin Luther King’s Birthday President’s Day Good Friday Memorial Day Independence Day Labor Day Columbus Day Veterans Day Thanksgiving Day Christmas Day

5.0. HEALTH AND SAFETY.

5.1. The contractor shall notify Military Public Health prior to any pesticide application in any food-handling, Child Development or Youth Center. Public Health Office, 30 MDOS/SGOL, (805) 606- 0648, prior to any type of pesticide application.

5.2. All fumigations shall be coordinated with Military Public Health 805-606-0648; Fire Department 805-606-4680; Security Forces Squadron 805-606-3911; and Base Safety (Occupational) 805-606-8806 – Coordination must occur at least 72 hours in advance.

5.3. Internal combustion or electrical power-driven spraying machines for aerosol or mist sprays inside buildings are shall not be used without approval from the Bio-Environmental Engineer and the Fire Department.

6.0. LAWS AND REGULATIONS

6.1. The contractor shall ensure all pest management operations comply with applicable federal, state, and local statutory and regulatory requirements, DoD directives, and Air Force requirements in coordination with 30 CES/CEI, Installation Management Flight, and the IPMC.

6.2. The contractor shall comply with all applicable parts of Title 29, Code of Federal Regulations (CFR), Occupational Safety and Health Standards, Part 1910; Title 29, CFR, Safety and Health Standards for Federal Service Contracts, Part 1925; Title 40, CFR Parts 150-189, and Title 49, CFR, Hazardous Materials Regulations, Part 171, while performing work on an Air Force installation, to ensure safe working conditions for contract personnel and a safe environment for the occupants of Air Force facilities.

6.3 Environmental Compliance and Fines. The contractor shall ensure all employees comply with applicable federal, state, and local statutory and regulatory requirements and directives. The government shall retain from amounts otherwise due the contractor an amount equal to any fines assessed against the government as a result of the contractor’s failure to perform in accordance with the terms of this statement of work or in the event that a regulatory agency issues a Notice of Violation

(NOV).

6.4. All pesticides applied on VAFB shall be on the current Armed Forces Pest Management Board (AFPMB) Standard Pesticides List Available to DoD Components and Agencies listing also known as the ‘DoD Approved Pesticide List’. This document will be provided at the request of the contractor.

If the contractor desires to use a pesticide that is not on the DoD Approved Pesticide List, the contractor shall provide the IPMC all pertinent information related to the non-standard pesticide.

The government will provide an electronic .pdf file after contract award. This document shall include a comprehensive justification and rationale why the products on the DoD Approved Pesticide List cannot be used instead of the proposed pesticide, the benefit gained by using the proposed product verses what is already available (i.e. less active ingredient). The IPMC will submit to AFCEC Entomologist for consideration and possible approval of the proposed pesticide.

6.5. Contractor shall report all pesticide applications monthly to the IPMC electronically. IPMC will provide the appropriate form or database access (30 CES/CEOES at 805-606-1927) for the contractor to complete by the 5th day of the month for the prior month’s applications. Monthly reporting facilitates the compliance with Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) for the collection and reporting of all pest management activities.

6.5.1. Certification and License. All contractor personnel who apply pesticides on VAFB shall possess a valid California pest control license in the appropriate category for type of work being performed, and the contractor’s company must have a valid California pest control business license and insurance. The State of California Department of Pesticide Regulation Categories for this contract are Residential, Industrial and Institutional (Category A); Landscape Maintenance (Category B); Right of Way (Category C); Health Related (Category K); and Structural Pest Control Board license for General pests and Termites. California Department of Fish & Wildlife trapping license is required. The contractor shall obtain any county, local, state, or federal permits required for any work to be done or materials to be used, under this contract. The contractor will prepare, maintain, and/or submit to the appropriate state, local, Air Force, or federal agency, any reports/records required by such agency. The contractor shall provide legible copies of all licenses and permits to the IPMC within 15 days of prior to start of work and within two (2) work days after receipt of replacement license.

7.0. HAZARDOUS MATERIAL REQUIREMENTS

7.1. The contractor shall obtain approval from the government's hazardous material supply system (known as HAZMART), by processing an Air Force Form 3952, Chemical/Hazardous Material Request Authorization, for all of their hazardous materials with the HAZMART, 30 LRS/LGRMSH, Building 5500, (805) 605-4786 or 605-3870, prior to using any hazardous materials on VAFB.

7.2. Contractor shall report their monthly hazardous materials usage for their activities on VAFB to the HAZMART. By reporting all of the monthly usage through the HAZMART, the contractor shall meet VAFBs reporting requirements for air emissions, EPCRA Toxic Release Inventory (TRI), solvent usage, and hazardous materials.

8.0. SPILL OR RELEASE AND CLEANUP REQUIREMENTS

8.1. The contractor shall comply with all environmental spill or release and cleanup regulations.

8.2. If the contractor incurs a spill or release, they shall immediately notify 30 CES/CEI,

(805) 606-1921 or 605-2015. If a spill cannot be managed, call the Command Post, (805) 606-9961.

Based upon the Reportable Quantity, 30 CES/CEI will determine if an environmental regulatory agency Incident Release Report needs to be prepared and submitted. (Note: If a regulatory agency incident release reporting action is required for the spill or release on VAFB, then 30 CES/CEI is responsible to notify the appropriate regulatory agency within the mandated reporting period)..

9.0. SECURITY REQUIREMENTS.

9.1. Contractor employees shall comply with all security requirements imposed by the Installation Commander while on VAFB property. Contractor needs to be aware that entry requirements are subject to change due to installation and world situations. For base access all contractor employees are subject to a background check through the Federal Bureau of Investigation.

9.2. Current security access restrictions at the Santa Maria gate (Main Base entry point) require all contractor vehicles (which are the size of a standard commercial bread delivery truck or larger) to enter through the Lompoc Gate exclusively (gate is located at the intersection of Santa Lucia Road and Pine Canyon Road). There is a vehicle check pull-off area and the contractor will be required to pull-off and submit to a vehicle search prior to gaining entry to the base. The contractor should plan and allow for delays as a result of these mandatory security procedures.

9.3. At contract award, the contractor shall designate, in writing to the Contracting Officer, a Security Manager who shall be the contractor’s point of contact for all security matters. Within 5 working days of contract award, the contractor’s Security Manager shall contact the 30th Civil Engineer Squadron (CES) Security Manager (located in Bldg 11442), phone 805-605-2059 for assistance in accomplishing contractor personnel security requirements.

9.3.1. All contractor personnel shall be thoroughly briefed by the CES Security Manager on established security requirements and procedures as stipulated in Air Force Policy Directive (AFPD 31-1, Physical Security Program).

9.3.2. The contractor shall brief all employees that they shall immediately leave any area upon notification by the CO, COR, constituted authority, or Security Forces personnel, when directed, as occasional operational requirements, real world activities, or emergencies dictate.

9.3.3. Contractor performance within Restricted/Controlled (R/C) areas shall require contractor compliance with various levels of security and established personnel security entry control procedures. Contractor employees working in R/C areas shall fluently speak, understand, read, and write English.

9.3.3.1. If required, the facility manager shall be responsible for providing access, escorts, or temporary visitor access badges for contractor personnel while providing burrowing rodent control inspection/control. The contractor shall be responsible for scheduling access/escorts/badges by contacting the facility manager at the Entry Control Point of the restricted/controlled area.

9.3.3.2. At all times while in restricted/controlled areas, contractor employees shall be under direct surveillance of a person from that facility who is authorized to wear a Restricted Area Badge and perform escort duties. Visitor badges issued to contractor personnel shall be returned to the Entry Controller or escort each time the employee completes the duties and leaves the area.

9.3.3.3. The contractor shall not employ persons for work on this contract if such employee is identified as a potential threat to the health, safety, security, general well-being, or operational mission of the installation and its population. Contractor personnel shall be easily recognized as contractor employees by wearing an identification tag that shall include the company’s name/logo and employee’s name. The contractor shall provide company identification tags at no additional cost to the Government. Upon completion of the contract, or an individual contractor employee’s employment, the contractor shall retrieve all identification media issued by 30th Security Forces Squadron and immediately surrender it to the Government.

9.3.3.4. Contractor vehicles shall have the company name/logo prominently displayed on each side panel of the vehicle whenever the vehicle is on Vandenberg AFB. The contractor shall provide company vehicle identification at no additional cost to the Government.

10.0. PAYMENT. Payment for each completed work order will be made by the government credit card. A government purchase card (GPC) approval document will be provided to the contractor’s administrative personnel. The adminstrative personnel will provide a transaction receipt to the IPMC or COR via e-mail after the credit card transaction is complete. Contractor will keep a current spreadsheet of each work order and credit card transaction.

11.0. PUBLICATIONS. Publications that apply to the PWS are Department of Defense Instruction 4150.07, DoD Pest Management Program; and, Air Force Manual 32-1053, Integrated Pest Mangement Program. And the Installation Pest Management Plan.

12.0 DEFINITIONS.

AFCEC Entomologist. Air Force Civil Engineer Center entomologist is a DoD employee and pest management professional who provides technical and management guidance on using installation pest management operations to prevent and control pest and disease vectors. Also this person is the IPMCs point of contact for coordinating and approval of non-standard pesticides.

Contract Manager. The contract manager is an individual who possesses all the appropriate certification in the pest management field who can be delegated to communicate, and act on behalf of the contractor.

Contracting Officer Representative (COR). A Contracting Officer's Representative is a DoD employee who is designated in accordance with DFARS subsection 201.602-2 and authorized in writing by the contracting officer to perform specific technical or administrative functions.

Integrated Pest Management (IPM). A planned program, incorporating continuous monitoring, education, record-keeping, and communication to prevent pests and disease vectors from causing unacceptable damage to operations, people, property, materiel, or the environment.

IPM uses targeted, sustainable (effective, economical, environmentally sound) methods including education; habitat modification; biological, genetic, mechanical, and physical control; and, where necessary, the judicious use of least-hazardous pesticides.

Installation Pest Management Coordinator (IPMC). The IPMC is a DOD employee who is designated in writing by the Base Civil Engineer. This individual has a multitude of responsibilities and is the focal point for any pest control issue. The IPMC works directly with the COR(s) and functions as the liaison between the government and the AFCEC Entomologist.

Pest. [As defined in DODI 4150.07, DoD Pest Management Program] Arthropods, birds, rodents, nematodes, fungi, bacteria, viruses, algae, snails, marine borers, snakes, weeds, and other organisms (except for human or animal disease-causing organisms) that adversely affect readiness, military operations, or the well-being of personnel and animals, attack or damage real property, supplies, equipment, or vegetation; or are otherwise undesirable.
