52.212-2 Evaluation-Commercial Products and Commercial Services. Nov 2021
Evaluation-Commercial Products and Commercial Services (Nov 2021)
BASIS FOR CONTRACT AWARD: This is a solicitation that utilizes FAR Part 13, Simplified Acquisition Procedures, and will utilize the best value to the Government evaluation procedures and fair and reasonable price determination. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions to Offerors, the offeror accedes to the terms of this solicitation. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:
A. Price Evaluations.
A.1 Pricing must be good for a minimum of 90 days from submission of quote.
A.2 Reasonableness: For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. The Government will determine prices fair and reasonable through the use of one or more of the price analysis techniques at FAR 15.404-1(b)(2). The price reasonableness will also be evaluated using one or more of the procedures described in FAR 13.106-2 and FAR 13.106-3.
A.3 Unbalanced pricing: Contractors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one (1) or more contract line items is significantly over or understated. The Government shall analyze offers to determine whether they are unbalanced with respect to separately priced line items or sub-line items. An offer that is determined to be unbalanced may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
B. Technical Capabilities Evaluations.
B.1 The technical capability of each responsive offeror will be evaluated as either acceptable or unacceptable based on the Government’s evaluation of the offeror’s submission of the following:
- A list of the equipment to be delivered which includes the characteristics of the equipment.
- A maintenance execution plan.
- A delivery execution plan.
- A pick-up execution plan.
B.2 The vendor shall submit a plan for how they will meet the requirements outlined in the Performance Work Statement (PWS). The vendor shall demonstrate that they can provide all the content within the PWS.
B.3 Quotes will be evaluated to be technically acceptable or not technically acceptable based on the evaluation factors listed above.
C. Completeness of Quote.
Offerors are cautioned to submit sufficient information and, in the format, specified in the RFQ to permit a meaningful assessment of technical acceptability. Offerors may be asked to clarify certain aspects of their quote. Clarifications conducted to resolve minor or clerical errors will not constitute discussions and the Contracting Officer reserves the right to award a contract without the opportunity for a quote revision. The Government intends to award a contract without discussions (While abiding regulations IAW Far Part 12 and 13).
D. Award
The Government will start evaluations by identifying the three quotes with the lowest prices first. The Government will then evaluate those quotes for price and technical capability. If at least two quotes are determined to be technically acceptable, then the Government shall award to the offeror with the lowest price and no other evaluations will take place. If only one quote is considered acceptable then the Government shall evaluate the next lowest price quote(s) until there are two acceptable quotes. The Government intends to award the contract without discussions. If the Government decides to conduct discussions, all offerors will be notified as soon as possible.
