About this file
This document is the Instructions to Offerors and Basis for Award for a Request for Proposal (RFP) to procure four (4) boats for use in the Philippines. The Government intends to award a single firm-fixed-price order for the performance period from 03 June 2024 to 20 June 2024. The evaluation factors for award are technical conformance and price. Proposals are due by 5:00 PM EDT on 25 May 2024 and must be submitted via email to the specified Contracting Specialist and Contracting Officer. The Government will evaluate offers by ranking them from lowest to highest price, then evaluating the technical acceptability of the lowest priced offeror(s) first. Award will be made to the lowest priced, technically acceptable offeror. The RFP includes detailed requirements for nine contract line items covering transportation of personnel and equipment between various sea ports in the Philippines during the exercise period.

Evaluation Factors for Award
52.212-2 Evaluation Commercial Products and Commercial Services (Nov 2021)
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
Evaluation — Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Technical Conformance
2. Price
Technical Conformance will be evaluated first and then price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
I. TECHNICAL
a. Proposed items meet the requirements of the RFP/attachments.
II. PRICE:
a. Proposals shall include prices for each line item listed and should include a total price, in order that proposals may be properly evaluated.
b. The Government will evaluate offers for award purposes by adding the total price for all Contract Line Item Numbers (CLIN) for the total evaluated price. In the event there is a difference between a unit price and the total CLIN amount, the unit price will be held as the intended price multiplied by the number of units. If the offeror shows only the total amount but fails to submit a unit price, the total CLIN amount divided by the quantity will be held as the intended price.
4. The Government will begin the evaluation process with a ranking based on the Total Evaluated Price from the lowest to highest price. Following the price ranking, only the lowest priced offeror(s) will be evaluated for technical acceptability under the non-price factor(s) according to the evaluation criteria set forth in this section. If acceptable, the evaluation will stop at that point and award will made to the lowest priced technically acceptable offeror. If unacceptable, the Government will continue to review proposals in order of price until evaluating one that is technically acceptable and eligible for award. The Government reserves the right to conduct additional technical evaluations as deemed necessary.
5. Failure to provide the requested information may deem the proposal unacceptable and may not be eligible for award.
