PERFORMANCE WORK STATEMENT

JOINT BASE McGUIRE-DIX-LAKEHURST, NJ

CYBER CAFÉ

13 November 2014

1.1. DESCRIPTION OF SERVICES:

Contractor shall furnish all food, beverages, equipment and services pertaining to the operation of a food service café and provide occasional catering to FSS activities and other installation wide departments on Joint Base McGuire/Dix/Lakehurst (JB MDL). The physical address of the location is 87th FSS Lakehurst Cyber Café, Route 547, Building 123, Lakehurst area of Joint Base McGuire-Dix-Lakehurst, NJ 08733

1.2 REQUIREMENTS:

The Contractor must have a minimum of two (2) years experience in the operations management of the food and beverage service industry.

Contractor shall provide ALL necessary equipment to carry out day to day operation, and will be responsible for daily cleaning of the facility and equipment to meet health and sanitation codes. Equipment at the facility includes dishwasher, 3 part sink, server counter, counter with drawers, and overhead cabinets. Reccommended equipment needed to operate may include but not limited to refridgerator, cooking appliances, beverage cooler, serving utensils, coffee maker, Panini maker, food warmer, etc. Deep fryers are NOT permitted in the building. However; the use of food warmers, flat plate/Panini grills and refrigeration items to keep hot food hot and cold food cold are permitted. Maintenance of government furnished property is the Contractor’s responsibility. Additionally, the contractor is responsible for all pest control for the facility.

The contractor will provide products and services of a quality and satisfactory nature to the code of the current Department of Defense, Food & Drug Administration. The Contractor shall comply with food & beverages regulations, and shall pass, without discrepancy, regular health inspections conducted by the Air Force Public Health for Food Safety and Sanitation. The Contractor will maintain all Air Force standards for food preparation & storage. All information shall be found in the 2013 US Food & Drug Administration Food Code, which is highlighted in AFI48-116 and AFI48-117.

1.3 FOOD GUIDELINES:

The contractor shall provide fresh and made to order concession items such as, but not limited to:

BREAKFAST

Breakfast Sandwiches - Bagels, Danish, Muffins Fresh Fruit & Yogurt Parfait Hot Coffee, Chocolate, Tea, Soda & Other Soft Drinks

LUNCH

Wraps & Sandwiches Soups, Chili Hot & Cold Subs Assorted Salads Snacks and Protein Shakes ***All menu items must be pre-approved by the Program M an ager prior to being offered.*** The Contractor shall be able to reasonably accommodate custom catering for events of varying sizes and budgets for special events. In the past such events were catered from 10 – 300 people with the contractor given sufficient amount of notice. The food items for these events include but not limited to: breakfast foods such as danish, breakfast sandwiches, muffins, bagels, fruit trays. Other options for lunch include but not limited to sandwiches, wraps, and soups or for hors devours such as cheese trays, vegetable trays or fruit trays.

Concessionaire will submit a list of items with corresponding selling prices prior to the start of the period of performance. The list of menu items shall be placed in a conspicuous area for patrons to view, with pricing of each item.

Alcoholic beverages will not be sold.

1.4 WORKING HOURS:

Contractor shall provide personnel to operate the concession at a minimum Monday through Friday , 0630 through 1400. Operations on weekends, holidays etc are at the discrecion of the Contractor with approval from the Program Manager and Contracting Officer.

The following federal holidays are observed by this installation:

New Year's Day, January 1 Martin Luther King's Birthday, 3rd Monday in January President’s Day, 3rd Monday in February Memorial Day, last Monday in May Independence Day, July 4 or Friday preceding or Monday following Labor Day, first Monday in September Columbus Day, 2nd Monday in October Veterans Day, November 11 or the Friday preceding, or Monday following Thanksgiving Day, 4th Thursday in November Christmas Day, December 25 or the Friday preceding or Monday following

Under certain circumstances, with the joint agreement of the Contractor, Program Manager and the Contracting Officer, hours of operation can be changed in order to accommodate an event or a situation that arises that we are in need of the contractor’s services.

NAFI is not responsible for loss of revenue due to closure of the base. power, water, or any utility outage, any local or national disaster, etc.

The Program Manager will notify the contractor of any postponed or cancelled events due to mission requirements, inclement weather, base closure, or other unanticipated events or occurrences.

1.5 RECORDING SALES:

All sales shall be rung up on a register or a sales receipt generated for the consumer. Failure of the contractor to ringing up sales and/or generate receipts to the consumer may result in immediate termination of this agreement. The government reserves the right to send undercover shoppers, to verify the integrity of sales transactions. These random checks shall be conducted at any time, without notice.

l.6 COMPENSATION:

The contractor shall pay the government a quoted percentage of the gross income per month or a quoted dollar amount (minimum $750.00) as indicated in the successful offeror’s quote. The contractor shall pay either the quoted percentage or specific amount whichever is greater to compensate the government. The contractor is required to a minimum of $750 per month if neither the quoted percentage of the gross income per month or the quoted dollar amount exceed $750 for the first base year with $50 incremental increases per year thereafter.

To establish the gross income per month the contractor shall X out of the register daily (close out the register for that day of service) and maintain a daily record of the amount received. The contractor will also be required to Z out of the register monthly (close out of the register for that month) and maintain a monthly record of the amount received.

If manual procedures are used, the contractor shall provide a copy of all invoices with a daily and monthly record of the amounts received. The contractor is required to provide a daily itemized document identifying: date, total sales (per day), net month to date sales, gross month to date sales, gross month to date sales and month to date error correction.

The contractor shall provide to the NAF Project Manager a copy of the daily and monthly register close-out records, invoices, receipts and a check payment to the NAFI within 5 calendar days after the closing of the month.

1.8 INSURANCE/ORDINANCES/TAXES/GAMBLING:

Contractor will provide, and maintain, current copy of its Health Inspection and business license and liability insurance certificate at the business location and should be in view of customers.

The Contractor shall present a Certificate of Liability Insurance naming JB MDL at 2905 Tuskegee Airman Avenue, Joint Base McGuire-Dix-Lakehurst, NJ 08641 as an additional insured and certificate holder, prior to the start of the period of performance and renew such insurance annually as long as they are under contract. Each renewal year contractor will submit to the Contracting Officer a new Certificate of Liability Insurance.

The Contractors shall , at their own expense, obtain all insurance coverage, and comply with all applicable municipal ordinances national law and any regulatory guidance published by the Department of Defense relating to public health.

The Contractor shall assume complete and sole liability for all state and local taxes applicable to income and transactions of the contract.

The Contractor shall comply with all the applicable laws pertaining to wages, wage determination, workers compensation and equal opportunity.

The contractor shall not permit gambling, provide loans or borrow money from patrons.

1. 8 C ONTRACTOR EMPLOYEES:

Contractor personnel shall present a neat appearance at all times. Employees shall wear appropriate clothing and be easily recognized as contracted employees (i.e. uniforms)

Contractor shall insure all employees have a JB MDL issued access badge prior to the contract start date. Identification shall be with the employee at all times while on JB MDL.

The Contractor is responsible to ensure all staff is trained in health & sanitation requirements as well as customer service.

1.9 SMOKING, EATING, DRINKING:

The contractor may smoke, eat, and drink in designated areas only.

1.10 PHYSICAL SECURITY:

The contractor shall safeguard all government property, and report any visible danger to the Program Manager promptly. Contractor shall not sell, remove or in any way alter any property which is owned by the Government.

The reporting of work orders, equipment repairs, incidents, accidents, safety hazards, etc., will be the responsibility of the contractor, all incidents must be reported immediately to the Program Manager.

Contractor is assigned to the workspace provided; the space is irrevocable and shall not be construed as creation of tenancy. Contractor is liable for any damage or loss of the premises, and/or injury to its employees.

Subletting of any of the premises to another concessionaire or individual is not authorized at any time or for any reason.

The government will be responsible for the building structure and utilities, however, the contractor is responsible to conserve energy.

1.12 This contract can be terminated by either party upon (30) day’s written notice.
