COMBINED SYNOPSIS/SOLICITATION

(6/2/2023) (rev 6/8/2023)

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

(ii) The Request for Quotation (RFQ) number FA445223Q0016 shall be used to reference any written quote provided under this RFQ.

(iii) The RFQ document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-03; Effective 5-26-2023.

(iv) This is a 100% set-aside for Service-Disabled Veteran-Owned Small Business (SDVOSB). The North American Industry Classification System (NAICS) code for this project is 541513 with a size standard of $37M.

(v) The purpose of this combined synopsis and solicitation is for the procurement of Computer Support Services as described in the Performance Work Statement (PWS). The bid schedule and contract CLIN schedule are below:

Item Description Qty Unit Price Extended Amount 0001 Computer Support Services. The contractor 156 Sessions shall provide services in accordance with all requirements in the PWS and in accordance with the terms and conditions of this contract.

1001 Computer Support Services. The contractor 156 Sessions Option shall provide services in accordance with all requirements in the PWS and in accordance with the terms and conditions of this contract.

2001 Computer Support Services. The contractor 156 Sessions Option shall provide services in accordance with all requirements in the PWS and in accordance with the terms and conditions of this contract.

(vi) Description of the requirement: The description of the requirement is provided in the attached PWS. Period of performances are: CLIN 0001 – 7/17/23-7/16/24; CLIN 1001 – 7/17/24-7/16/25; CLIN 2001 – 7/17/25-7/16/26

(vii) Place of Performance: Pope AAF, NC

(viii) FAR Provision 52.212-1, Instructions to Offerors – Commercial Products and Commercial Services (Mar 2023) applies to this acquisition and the following addendum applies:

The following words stating “offer”, “offeror”, and “proposal” are replaced with “quotation”, “vendor”, and “quote.”

Paragraph (b)(4) is revised as follows:

The Vendor shall submit a Relevant Experience document, limited to no more than a 3-pages, on their relevant experience providing services that are the same or similar to those required in the PWS. Prior experience can either be at federal, state, or local government levels, or within the private sector. When documenting relevant experience, include: 1) name of the Government agency or company to which services were provided to; 2) Government contract number (if applicable); 3) POC with contact information at the agency or company where services were provided; 4) narrative detailing how the previous experience is relevant to PWS requirements.

Paragraph (b)(12) is added as follows: Additional information required:

All companies must be registered in the System for Award Management at https://www.sam.gov/SAM/pages/public/index.jsf to be considered for award. The Government will not provide contract financing for this acquisition. Invoice instruction shall be provided at time of award.

Paragraph (c) first sentence revised as follows:

The vendor agrees to hold the prices in its quote firm for 60 calendar days from the date specified for receipt of quotes unless another time period is specified in an addendum to the solicitation.

Paragraph (e) is deleted in its entirety.

(ix) Pursuant to FAR 12.602, contract award will be made using Simplified Acquisition Procedures in accordance with FAR 13.106. Vendor’s submissions will be evaluated based upon the following:

Basis for Award

1. Price will be evaluated to determine if it is fair and reasonable in accordance with FAR 13.106-3. Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

2. Relevant Experience will be evaluated and assigned one of three available Confidence Ratings:

High Confidence The Government has high confidence based on the Vendor’s relevant experience that they will be successful in performing contract requirements with little or no Government intervention.

Some Confidence The Government has some confidence based on the Vendor’s relevant experience that they will be successful in performing contract requirements with some Government intervention.

Low Confidence The Government has low confidence based on the Vendor’s relevant experience that they will be successful in performing contract requirements even with Government intervention.

Award will be made on a best value basis considering price and relevant experience.

(x) FAR Provision 52.212-3, Offeror Representations and Certifications – Commercial Products and Commercial Services (Dec 2022) Alternate I (Oct 2014) applies to this acquisition. All vendors must be registered in System for Award Management at https://www.sam.gov/SAM/pages/public/index.jsf at the time of Quote submittal.

Provisions applicable to this RFQ will be reviewed and verified in SAM.gov, vendors are responsible for updating all applicable provisions prior to submission of their quote.

(xi) FAR clause at 52.212-4, Contract Terms and Conditions – Commercial Products and Commercial Services (Dec 2022), applies to this acquisition with the following Addendum:

Paragraph (c) of this clause is tailored as follows:

Changes in the terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes, such as changes in the paying office, appropriations data, etc., which may be changed unilaterally by the Government.

Paragraph (g)(3) of this clause is added as follows:

The contractor shall invoice for services performed no more than once per month.

Note: The vendor acknowledges that should the quote terms and conditions and/or agreement conflict with mandatory provisions of the Federal Acquisition Regulation (FAR) and other Federal law applicable to commercial acquisitions, to the extent of such conflict the FAR and Federal law govern and conflicting vendor terms and conditions and/or agreement are unenforceable and are not considered incorporated into any resultant contract.

5352.201-9101 AFICC-WP Ombudsman 10/1/2019

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

(c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, Mr.

(d) The ombudsman has no authority to render a decision that binds the agency.

(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the contracting officer.
