About this file

This document is a Questions and Responses file for Solicitation # FA442725Q1156, Amendment #1 dated 23 September 2025, issued by the Air Force. The document addresses two key questions related to Trade Agreements Act (TAA), Buy American Act (BAA), and National Defense Authorization Act (NDAA) compliance for a Small Business Set-Aside procurement. Despite the small business designation typically exempting the solicitation from TAA requirements, the Air Force is maintaining TAA compliance due to specific equipment being acquired for critical infrastructure security. The Wing Cyber Security Office (WCO) will be responsible for verifying the country of origin for all components before installation. Any equipment submitted must be TAA/BAA/NDAA compliant, with non-compliant items being deemed unacceptable for the procurement.

QUESTIONS/ RESPONSES

Solicitation # FA442725Q1156

Amendment #1 – 23 September 2025

Ques on 1 - Given that the RFQ is a Small Business Set-Aside, and FAR 25.401(a) states that the Trade Agreements Act (TAA) does not apply to such acquisiƟons, should the TAA compliance requirement be removed from the RFQ's Statement of Work (SOW).

Response -No, the TAA compliance requirement will not be removed from the RFQ. While FAR 25.401(a) generally exempts Small Business Set-Asides from TAA, the specific equipment being acquired, as detailed in AƩachment 4 (Air Force-authorized equipment approved by AFLCMC/HBU for criƟcal infrastructure security), is subject to addiƟonal Air Force policy consideraƟons. In addiƟon, Paragraph 3 of AƩachment 4 states that the equipment was iniƟally TAA/BAA/NDAA compliant at the Ɵme of the list of approval, however, manufacturers could change the place of origin.

The government is not permiƩed to remove TAA compliance due to operaƟonal mission safety and adherence to Air Force policy. Therefore, despite the Small Business Set-Aside designaƟon, maintaining TAA compliance is crucial for ensuring the integrity and security of the specified Air Force-approved equipment. The installaƟon agent, Wing Cyber Security Office (WCO) bears the responsibility to verify the country of origin of all components before installaƟon to ensure conƟnued TAA compliance. Any equipment items submiƩed not listed in AƩachment 4, shall be TAA/NDAA compliant as specified in the Statement of Work/SolicitaƟon.

Ques on 2 - IF the Trade Agreements Act (TAA) does not apply and the Defense Federal AcquisiƟon RegulaƟon Supplement (DFARS) Buy American Act (BAA) applies per 225.1101, but neither DFARS clause 252.225-7000 nor 252.225- 7001 are included, can you confirm that the evalua on will be conducted as described in DFARS clause 252.225- 7000(b), or if not, please provide the ra onale for its absence from the solicita on?

Response - The solicitaƟon, as specified in AƩachment 4, sƟpulates that the Trade Agreements Act (TAA), Buy American Act (BAA), and NaƟonal Defense AuthorizaƟon Act (NDAA) apply. Therefore, the evaluaƟon will be conducted to ensure all offered items are compliant with the intent outlined in AƩachment 4. Please be aware that any items submiƩed that do not meet the TAA/BAA/NDAA compliance requirements will not be considered acceptable.
