About this file
This is a federal contracting evaluation clause (FAR 52.212-2) for commercial items procurements. The document establishes the evaluation framework and award criteria that the Government will use when assessing vendor quotes for commercial products and services.
The evaluation process employs two primary factors: Price and Technical Acceptability. For Price, the Government reserves the right to award to vendors other than the lowest bidder if higher quality justifies the difference. For the Technical factor, vendors must submit a secondary document demonstrating how their quoted item meets all requirements specified in the Salient Characteristics attachment. Technical submissions must be clear, concise, and sufficiently detailed to substantiate claims—vendors cannot simply restate solicitation requirements or use generic language. Each technical submission receives a rating of either "Acceptable" (quote clearly meets minimum requirements) or "Unacceptable" (quote does not clearly meet minimum requirements). The Government assumes no prior knowledge of the vendor's experience and bases evaluation solely on information presented in the offer. Best value is expected to result from selecting the technically acceptable quote with the lowest evaluated price. By submitting a quote, vendors accept all solicitation requirements including technical requirements and terms and conditions, and failure to conform may result in the quote being deemed not awardable without further evaluation.

Price Technical Acceptability
(End of provision)
ADDENDUM TO FAR 52.212-2:
Best value is expected to result from selection of the technically acceptable quote with the lowest evaluated price.
By submission of its quote, the vendor accepts all solicitation requirements, including all technical requirements and terms and conditions. Failure to conform to solicitation requirements may result in a quote being determined not awardable without further evaluation. The evaluation criteria are detailed below:
Factor 1 – Price. The Government will award a contract resulting from this solicitation to the responsible offeror whose quotation conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government reserves the right to award to other than the low quote for a higher quality item.
Factor 2 – Technical. The purpose of the technical factor is to assess whether the vendor’s quoted item meets all of the provided information from the Salient Characteristics. Each vendor’s quote will be evaluated against technical requirements and will be assigned a rating of “acceptable” or “unacceptable.” Technical submission must be completed using a secondary document. The Technical information shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims. Quotes shall not simply rephrase or restate the Salient Characteristics or contain general statements such as “Standard procedures will be employed.”
Proposals shall provide convincing rationale addressing how the technical portion of the offer meets solicitation requirements. Offerors shall assume the Government has no prior knowledge of the offeror’s experience. The Government will base its evaluation on the information presented in the offer.
Rating Description:
“Acceptable” - Quote clearly meets the minimum requirements of the solicitation.
“Unacceptable” - Quote does not clearly meet the minimum requirements of the solicitation.
The quote will be determined technically acceptable if it meets the requirements set out in the Attachment 1 - Salient Characteristics.
