About this file

This is a Department of the Air Force Justification for Other Than Full and Open Competition (J&A) document dated March 2026, approved for a contract action valued between $10M and $100M.

The justification approves modifications to increase the ceiling of an existing Firm Fixed Price contract with the 628th Contracting Squadron at Joint Base Charleston, South Carolina from $96M to $161M through bilateral contract modifications to three current MACC (Maintenance and Construction Contract) holders: Outside the Box, LLC (FA441823D0005); Hightower Construction Co, Inc. (FA441823D0007); and A-Plus K&K JV, Inc. (FA441823D0009). The increase of $65M is justified by inflation in material and labor costs (17.9% increase between 2022-2023), with current total obligations across all contractors at $77,450,742.27 as of April 14, 2026. The existing MACC covers construction services including demolition, new construction, alterations, repairs, and design-build projects on real property at Joint Base Charleston. The performance period runs from May 15, 2023 through May 14, 2028, including a base year and four option years, with a six-month extension of service expiring May 14, 2028. The Government justified the sole-source approach under 10 U.S.C. 3204(a)(1), citing that current contractors are the only firms with unique qualifications and base access necessary to avoid unacceptable delays (approximately 180 days per project) and substantial cost duplication estimated at over $5.8M if competitive solicitation occurred. Funding will come from FY26 and FY27 Operations and Maintenance appropriations, and a follow-on MACC acquisition is projected for award in FY27.
