Justification and Approval (J&A) for Other Than Full and Open Competition

I. Agency and Contracting Activity.
The Department of the Air Force, 1st Special Operations Contracting Squadron, 350 Tully Street, Hurlburt Field, Florida, 32544.
II. Nature and/or description of the action being approved.
This Justification and Approval (J&A) document is only for a portion of the solicitation FA441721R0003. This J&A is for Cummins Inc. brand generator equipment outlined in the Attachment 1 - Specifications, dated 16 February 2021.
This contract action will be awarded on a competitive basis, set-aside for service disabled veteran owned small businesses. This notice will be posted to the Government Point of Entry, beta.sam.gov, in accordance with FAR 6.305(d).
III. Description of supplies/services required to meet agency needs (including the estimated value).
In accordance with the Specifications, dated 16 February 2021, the description of the Cummins Inc. brand generator equipment is as follows:
SECTION 26 32 15.00 10 Part 2 paragraph 2.1:
Provide and install each engine-generator set complete and totally functional, with all necessary ancillary equipment to include: air filtration; starting system; generator controls, protection, and isolation; instrumentation; lubrication; fuel system;
cooling system; and engine exhaust system. Each engine-generator set shall satisfy the requirements specified in the Engine- Generator Parameter Schedule. The generator shall be a Cummins model. The following items shall be included with the generator:

Additionally, SECTION 26 36 00.00 10 Part 2 paragraph 2.1 Provide material and equipment which are Cummins. Submit list of proposed equipment and material, containing a description of each separate item, and certificates of compliance showing evidence of UL listing and conformance with applicable NEMA standards. Such certificates are not required if manufacturer's published data, submitted and approved, reflect UL listing or conformance with applicable NEMA standards. The experience use shall include applications in similar circumstances and of same design and rating as specified ATS. The following items shall be included with the Cummins switch:

IV. Statutory authority permitting other than full and open competition.
FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.
Pursuant to 10 U.S.C 2304(c)(1), contracting agencies may restrict competition if the property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency.
V. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above (applicability of authority).
The purchase of this new Cummins Inc. brand generator equipment must integrate with Hurlburt Field's remote telemetry monitoring and control system, as well as all other Onan equipment manufactured by Cummins that is currently in our fleet of emergency power systems. In 2005 and 2006, Hurlburt Field configured the Supervisory Control and Data Acquisition System. When completing this configuration, Hurlburt Field requested data mapping points from Cummins, Kohler and Caterpillar so that the system would be compatible with these manufacturer's products. As a result, Cummins provided 108 data mapping points, Kohler provided 10 data mapping points and Caterpillar provided start and stop points only.
Due to this, Hurlburt Field's system is configured with Onan brand system proprietary mapping points, which is manufactured by Cummins. In order to read all of the data points and information (i.e. temperature, frequency, voltage, etc), the items must be Onan. Other products will only provide an overview of information and depending on the product, the Government would have to spend approximately $7K to $14K on equipment upgrades to complete readings and the reading would not provide all of the necessary information. Digital control panels used on other units will not interface with Onan generator control units without modifications.
Our maintenance personnel and equipment operators are thoroughly familiar with the Onan units and are trained/certified
March 2020 CUI Page 4 of 5March 2020 CUI Page 4 of 5 to perform maintenance. Purchasing of another brand would require the Government to pay for each service call which would increase costs.
Purchase of a brand other than Onan would require the procurement of new special tools and the expense of implementing specialized training for our maintenance personnel and operators or the expense of paying for a Government maintenance contract for those products where government employees cannot obtain training to perform maintenance.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under
FAR 5.202 applies.
Due to the information above, Cummins' products are the only products that are configured for the Hurlburt Field Supervisory Control and Data Acquisitions System. As such, there are no alternatives to soliciting as a brand name requirement for that portion of the acquisition.
This requirement, FA441721R0003, is solicited under a socio-economic set-aside in accordance with FAR Part 15 procedures;
along with the J&A for Brand Name. The contracting office will post this J&A for other than full and open competition on Beta.SAM website for 30 days in accordance with FAR 6.305(d)(3).
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The contracting officer will utilize techniques recommended in FAR 15.404-1 in order to determine price fair and reasonableness.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
During market research, no other brands were found able and cable of meeting the interoperability of the supervisory Control and Data Acquisition System. The Cummins brand equipment that is requested is offered by several vendors. The specific brand cannot be substituted due to the current configurations.
IX. Any other facts supporting the use of Other Than Full and Open Competition.

X. List of any sources that expressed, in writing, an interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Through every available means, the Government will continue to monitor market information and technical publications to determine whether any other source can meet our needs. Additional market research will continue to be accomplished in order to become aware of all available source to meet these requirements and 1st Special Operation Contracting Squadron will provide any information found in the future to the end users so they may consider additional options and foster competition for future acquisitions.
