ADDENDUM TO FAR 52.212-2
ADDENDUM TO FAR 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
Addendum to 52.212-2(a): Paragraph “(a)” is hereby tailored as follows:
(a) Basis for Contract Award. The Government intends to award one contract for this competitive Small Business set-aside commodities acquisition. Award will be made to the acceptable Offeror representing the “best value” to the Government. For this Request for Proposal (RFP) “best value” means the award will be made to the responsible contractor, whose products/services are technically acceptable and offers the lowest overall price. The solicitation requirements include all stated terms, conditions, representations, certifications, and all other information required by this solicitation. Unless specifically identified otherwise, by submitting an offer, the Offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications and technical requirements, in addition to those identified as evaluation factors or sub factors. Failure to meet a requirement may result in a proposal being determined ineligible for award.
A Firm Fixed Price (FFP) Indefinite Delivery (ID) – Requirements contract in which the Government will utilize the Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with FAR.15.101-2, will result from this solicitation. Technical tradeoffs will not be made and no additional credit will be given for exceeding technical acceptability standards. Award will be made to the technically acceptable Offeror representing the best value to the Government who is deemed responsible in accordance with FAR Part 9.104. The solicitation requirements include all stated terms, conditions, representations, certifications, and all other information required by this solicitation.
It is the Government’s intent to evaluate proposals and award contracts without discussions with Offerors (except clarifications as described in FAR 15.306(a). Therefore, the Offeror's initial proposal should contain the Offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
1.0 Evaluation Process.
1.0.1 Offers will be ranked from lowest to highest based on initial assessment of Total Evaluated Price (TEP).
1.0.2 Price analysis will be conducted on the three (3) lowest priced technically acceptable proposals to determine price reasonableness. Award will be made to the lowest TEP proposal meeting the technical acceptability standards (contingent upon Offeror being deemed responsible). If award is to be made without discussion the evaluation factors and process to be used is listed below.
1.1 Evaluation Factors. In evaluating proposals, the Government will select for award the proposal that is technically acceptable, offers the lowest overall price and is determined responsible. Each offer will be assessed in accordance with the following evaluation factors:
Factor 1: Price Factor 2: Technical Acceptability Technical Acceptability Factor 2 consists of two (2) Sub Factors:
Sub Factor 1: Approach to Meet 14 Day Turnaround Time Sub Factor 2: Samples
1.1.1 Price Evaluation. Evaluations will be completed by multiplying the Offeror’s unit price by the estimated quantity. An Offeror’ s proposed Total Evaluated Price (TEP) will be determined by multiplying the estimated quantities identified in the Schedule of Supplies/Services by the proposed unit price for each CLIN. The extended amounts for each CLIN will then be totaled to obtain the estimated total for each performance period. The TEP consists of all periods of performance. The estimated total for each period of performance will be added together to obtain the TEP.
The contract will include FAR Clause 52.217-8, Option to Extend Services, with the potential to extend the contract an additional 6 months beyond the awarded contract performance period. This period is not represented by a CLIN.
The price for the potential 6-month extension will be determined based on the unit prices proposed for the last option period of performance and will be evaluated at time of award. In the event the Government requires continued performance, the Government's evaluation of prices proposed will be considered fair and reasonable as applied to an extension of services. Should an extension of services be required rates will be adjusted only as result of revisions to applicable prevailing Department of Labor wage rates.
1.1.2 Technical Acceptability Evaluation. The Government will evaluate all offers submitted in accordance with the requirements of this solicitation for technical acceptability. The Government will submit the samples submitted to The Institute of Heraldry for testing and evaluation.
1.1.2.1 Acceptability Ratings. The evaluation factors listed below will be evaluated and prescribed one of the following ratings:
(i) Acceptable – The proposal clearly meets the minimum requirements of the solicitation.
(ii) Unacceptable – The proposal does not clearly meet the minimum requirements of the solicitation.
1.1.2.2 Evaluation of Factors. Offerors are advised that their initial submission should be their best effort. Only technically acceptable proposals, either initially or as a result of discussions, are eligible for award. If award is made without discussions, proposal revisions will not be permitted. The Government will evaluate the proposals selected above for technical acceptability on an Acceptable/Unacceptable basis. For the technical proposal to be rated as “Acceptable”, all technical factors and sub factors must be rated acceptable. If any technical factor or sub factor is rated “Unacceptable” the overall proposal will be rated as “Unacceptable”.
(A) Sub Factor #1 – Approach to Meet 14 Day Turnaround Time Standard: The offeror shall submit a narrative of their approach to meet the 14 day turnaround time for delivery of metal name tags to the Government.
The standard has been met when: The offeror’s narrative clearly addresses the approach to be used to meet the 14 day turnaround time for delivery of metal name tags to the Government.
(B) Tab 2: Sub Factor #2 – Samples Standard: The Offeror shall provide samples as listed below:
i. A quantity of 5 samples are engraved with the following name: MARTINEZ-HERRING (all caps)
ii. A quantity of 5 samples are engraved with the following name: SMITH (all caps)
iii. Material: The material of the samples submitted shall be Brass or Nickel Silver. The back plate standard will have been met when the material tested registers as plastic
iv. Finish: The finish of the samples shall be nickel plated, silver plated, matte finish with brushed silver finish. The finished name tag shall be lacquered using a pale, clear, synthetic lacquer. The use of a pigmented lacquer will be deemed unacceptable.
v. Dimensions: The dimensions of the samples submitted shall be: Height (Overall) 3/4 Inch , Width(Overall) 3 inches, Thickness (Name Plate) 0.025 inch plus or minus 0.005 inch, Thickness(Overall) 0.105 inch plus or minus 0.005 inch.
Dimension Type Standard Height Overall ¾ inch Width Overall 3 inches Thickness Name Plate Only 0.0025 inch plus or minus
0.005 inch Thickness Overall 0.105 inch plus or minus
0.005 inch
vi. Protective Tube: The protective tube of the samples submitted shall: consist of clear plastic with a measure diameter of not less than ¾ inch and a thickness of not less than 0.015 inch.
vii. Engraving: The engraving of the samples submitted shall be: standard block or SL513 Portuguese font engraved in all capital letters and is ¼ inch in height when measured. When a lower case letter is specified, the letter shall be 1/8 inch in height when measured. The lines forming the letters shall use no less than a 0.030 inch or more than a 0.040 inch cutter head. The engraved letter font depth shall be no less than .008 inch or no more than .010 inch when measured.
viii. Engraved Letters: The paint for the engraved letters of the samples submitted shall be: Epoxy based paint applied to the engraved letters. The paint shall match Pantone Color 2747C.
ix. Attaching Device: The attaching device for the samples submitted shall be: prong and clutch. When measured, the two prongs shall be located on the horizontal center line 9/16 inch from each end of the plastic edge and be 3/8 inch in length.
The standard has been met when: The samples submitted by the offeror meet the requirements of subparagraphs i.
and ii. above and The Institute of Heraldry certifies the samples submitted meet the standards as stated in subparagraphs iii thru ix. above.
2.0 Price Analysis. The Government will conduct a complete Price Analysis on the lowest priced technically acceptable offer using one or more of the techniques defined in FAR 15.404-1, to determine if it is reasonable and balanced. Unbalanced pricing exists when, despite an acceptable TEP, the price of one or more contract line items or sub line items appears to be significantly overstated or understated as indicated by the application of price analysis techniques. An Offeror’s proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
3.0 Discussions. It is the Government’s intent to evaluate proposals and award without discussions with Offerors (except clarifications as described in FAR 15.306(a). Therefore, the Offeror's initial proposal should contain the Offeror's best terms from a price, and technical standpoint. However, the Government reserves the right to conduct discussions if the Contracting Officer (CO) later determines them to be necessary. If discussions are to be conducted, the Government will establish a competitive range based on the ratings of each proposal against all evaluation criteria in the solicitation. The competitive range will consist of those technically acceptable offers with the lowest prices that have the potential to represent the best value to the Government. Prior to the establishment of the competitive range, and after the decision to conduct discussions has been made, the Government may enter into limited communications with offerors whose inclusion or exclusion from the competitive range is uncertain.
These communications are limited in accordance with FAR 15.306(b)(1). The Government will only enter discussions with those offerors determined to be in the competitive range.
At the conclusion of discussions, each Offeror still within the competitive range shall be given an opportunity to submit a Final Proposal Revision (FPR) by a common cutoff date and time as established by the contracting officer.
If, after discussions have begun the Government determines that an Offeror’s proposal should no longer be included in the competitive range, the proposal will be eliminated from consideration for award. This may occur at any time even if all material issues have not been discussed or if the Offeror has not yet been afforded the opportunity to submit a proposal revision. Written notice of exclusion from the competitive range will be provided to unsuccessful offerors.
