JBSA-Lackland, TX JBSA-Lak Rpl Boiler Tubes
Request for Quote (RFQ): Replace Boiler Tubes (NOTE: The quote shall be effective for 30 days after submission of quote)
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a separate Request for Proposal (RFP) will not be issued. The vendor shall respond to this RFQ by: 12:00 p.m. CST on Friday, 24 January 2020, via email to Contract Specialist: Bobbie Dobberstein at: bobbie.dobberstein.1@us.af.mil and courtesy copy Contracting Officer:
Heather Sorensen; email: heather.sorensen@us.af.mil. Any quote, modification, revision, or withdrawal of a quote received after the exact time specified in this solicitation shall be determined as late and will not be considered unless received before award is made, the Contracting Officer determines that accepting the late quote would not unduly delay the acquisition, and it was the only quote received.

This acquisition is 100% Set-Aside to Small Business concerns, utilizing NAICS 238220, Plumbing, Heating, and Air-Conditioning Contractors, Business Size Standard is $16.5M.

Special Notes and Instructions:
1. This is a notice that this purchase order is solicited as 100% Set-Aside to Small Business contractors. Only quotes submitted by Small Business contractors will be accepted by the Government. Any quote that is submitted by a contractor that is not a Small Business contractor will not be considered for award.
2. Basis for Award. 502 CONS/JBKAA will issue a purchase order to the Contractor who is determined to offer the best value to the Government.
3. Best Value Determination.
4. By submitting a quote to the government, the quoter/vendor concedes they have read, understand and can provide the services required in accordance with the SOW and this RFQ. Furthermore, the quoter/vendor concedes that services shall be provided and complete within 14 days of receiving the purchase order.
The technically acceptable, lowest priced quote will be determined to represent the best value. Technical acceptability will be determined by an evaluation of the quoted requirements that meet the technical criteria that is contained in this RFQ. If the lowest priced submission does not meet the technical criteria described in this solicitation, the Government reserves the right to evaluate the next lowest priced submissions until it has determined a technically acceptable submission. The evaluation will stop at the point when the government determines a quote to be technically acceptable with the lowest evaluated price, because that quote will represent the best value. Contingent upon a determination of contractor responsibility, award will be made to that contractor without further evaluation of other quotes. Award will be made to the responsible vendor whose quote is the lowest evaluated price among technically acceptable quotes.
In order to ensure price reasonableness, the government reserves the to make this determination based on competition, historical pricing, current market conditions, comparison to the independent government estimate, and/or any other analysis techniques under FAR 13.106-3(a). This may require submission of information other than cost or pricing data to the extent necessary to ensure price reasonableness.
The lowest priced technically acceptable quote found to be reasonable will be determined to represent the best value. A firm-fixed price award will be made to the lowest price technically acceptable quoter contingent upon a determination of contractor responsibility.
5. Mandatory Registrations. To be eligible for award, registration with the System for Award Management (SAM) must be current (legacy for On-line Registration and Certifications Application (ORCA) and Central Contractor Registration (CCR) registrations). To register or update former CCR and Reps & Certs that are not current go to https://www.sam.gov/portal/public/SAM/ and provide mandatory information.
6. Site Visit.
Date/Time: Tuesday, 14 January 2020 at 9:00 a.m. CST Location: JBSA-Lackland AFB visitor Center gate address is 2602 Luke Blvd, Lackland AFB, TX 78236.
Interested contractors shall fill out base pass (Attach 4) and email bobbie.dobberstein.1@us.af.mil and heather.sorensen@us.af.mil, not later than three (3) days prior to site visit.
*NOTE: All interested vendors are requested to meet at the JBSA-Lackland Visitors Center regardless of whether a base pass is required.
7. Site Maintenance. Work areas shall be maintained in a neat, clean, safe condition and all trash, debris, and garbage, which the contractor generates shall be removed from the premises upon completion and delivery, or daily if the completion/delivery will be completed in more than one day
8. Completion of Work. The Contractor shall ensure that work for this project is performed in accordance with the criteria herein, and that all items/products in the description shall be fully operational at the completion of work for this project.
9. Technical Experience/Certification. The contractor shall be bonded, licensed (Class A), and properly insured and shall provide proof to the Government upon request.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. OMBUDSMAN (OCT 2019)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
(c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, Deputy Director of Contracting, AFICC/KT (OL-AET), 2035 First Street West, JBSA Randolph TX 78150-4304, telephone 210-652-1722 (DSN 487-1722). 5352.209-9000 Organizational Conflict of Interest (Oct 2019) “(a) The following restrictions and definitions apply to prevent conflicting roles which may bias the Contractor's judgment or objectivity, or to preclude the Contractor from obtaining an unfair competitive advantage in concurrent or future acquisitions.
(1) Descriptions or definitions:
""Contractor"" means the business entity receiving the award of this contract, its parents, affiliates, divisions and subsidiaries.
""Development"" means all efforts towards solution of broadly-defined problems. This may encompass research, evaluating technical feasibility, proof of design and test, or engineering of programs not yet approved for acquisition or operation.
""Proprietary Information"" means all information designated as proprietary in accordance with law and regulation, and held in confidence or disclosed under restriction to prevent uncontrolled distribution. Examples include limited or restricted data, trade secrets, sensitive financial information, and computer software; and may appear in cost and pricing data or involve classified information.
""System"" means the system that is the subject of this contract.
""System Life"" means all phases of the system's development, production, or support.
""Systems Engineering"" means preparing specifications, identifying and resolving interface problems, developing test requirements, evaluating test data, and supervising design.
""Technical Direction"" means developing work statements, determining parameters, directing other Contractors' operations, or resolving technical controversies.
(2) Restrictions: The Contractor shall perform systems engineering and/or technical direction, but will not have overall contractual responsibility for the system's development, integration, assembly and checkout, or production.
The parties recognize that the Contractor shall occupy a highly influential and responsible position in determining the system's basic concepts and supervising their execution by other Contractors. The Contractor's judgment and recommendations must be objective, impartial, and independent. To avoid the prospect of the Contractor's judgment or recommendations being influenced by its own products or capabilities, it is agreed that the Contractor is precluded for the life of the system from award of a DoD contract to supply the system or any of its major components, and from acting as a subcontractor or consultant to a DoD supplier for the system or any of its major components.”

5352.242-9000 Contractor Access to Air Force Installations (Oct 2019
(a) The contractor shall obtain base identification and vehicle passes, if required, for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. Contractor personnel are required to wear or prominently display installation identification badges or contractor-furnished, contractor identification badges while visiting or performing work on the installation.
(b) The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. The letter will also specify the individual(s) authorized to sign for a request for base identification credentials or vehicle passes. The contracting officer will endorse the request and forward it to the issuing base pass and registration office or Security Forces for processing. When reporting to the registration office, the authorized contractor individual(s) should provide a valid driver s license, current vehicle registration, and valid vehicle insurance certificate to obtain a vehicle pass.
(c) During performance of the contract, the contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials and vehicle passes for any employee who no longer requires access to the work site.
(d) When work under this contract requires unescorted entry to controlled or restricted areas, the contractor shall comply with [insert any additional requirements to comply with AFI 31-101, Integrated Defense, and DODMAN5200.02_AFMAN 16-1405, Air Force Personnel Security Program] citing the appropriate paragraphs as applicable.
(e) Upon completion or termination of the contract or expiration of the identification passes, the prime contractor shall ensure that all base identification passes issued to employees and subcontractor employees are returned to the issuing office.
(f) Failure to comply with these requirements may result in withholding of final payment.
