SECTION 1

1. DESCRIPTION OF SERVICES. The contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision, and other items and services necessary to perform Integrated Solid Waste Management, Municipal Solid Waste (MSW) collection and cardboard recycling services at Eglin Air Force Base, Florida. Services shall be performed for Eglin Main, Duke Field, Camp Rudder, 7TH Special Forces, Eglin ranges and sites. The contractor shall perform to the standards in the Performance Work Statement (PWS) as well as all Federal, State, and local regulations. Estimated workload factors are in Appendix A and collection areas are in Appendix B.

1.1. COLLECTION REQUIREMENTS.

1.1.1. Main Base

1.1.1.1. Integrated Solid Waste Management. Empty MSW/Recycling containers/dumpsters based on historical data for the first 30 days of performance or at least weekly. The contractor shall establish initial vehicle routes and collection schedules upon contract award. They are to be submitted to the contracting officer five (5) calendar days prior to start of contract performance. The contractor may propose adjustments to the schedule at any time but as a minimum the Government Contracting Officer Representative (COR) and contractor shall monitor fill capacities during the first 30 days of performance and during one other period to be agreed upon during the same performance period. No changes are allowed to the schedule or haul route without COR approval. Historical frequency tables are located at Appendix A. When the contractor completes service at a location there shall be no litter, waste, and recyclable material on the ground within a 10 foot radius of the container.

1.1.1.2. Food Waste Containers (Compactors). The contractor shall furnish compactors constructed for commercial use in sizes 8 and 30 cubic yards. Compactor locations and collection days are specified per Appendix B. The contractor shall service compactors on a scheduled basis and on call as required.

The contractor shall have four (4) work hours to complete servicing. Servicing includes pickup, disposal, return, and proper reconnection. Cleaning and deodorizing shall be accomplished in accordance with (IAW) paragraphs 1.4.3. In the event a compactor cannot be serviced within the specified timeframe, the contractor shall replace the compactor from his backup stock. Under no circumstances will the contractor leave a facility without refuse container service.

1.1.2. Bear Proof Industrial Solid Waste Containers Requirement. The contractor shall furnish and service 8 cubic yard (The Guardian by Bearicuda part # DMP108FL or Government approved equivalent) containers with dump bar feature that allows the front load driver to remain in the vehicle throughout the dumping procedure. The Government will only approve bear proof containers that have a 12 Gauge (GA) steel body, 14 GA steel lids, 14 GA sliding back door, 10 GA skids, 10 GA pads, 10 GA lift pockets, and a powder coated finish. This contract requires 40 such containers 20 weeks after contract start up to be placed in accordance with Appendix A and the designation BP (Bear Proof) in type column. Upon request by the CO, the contractor shall provide up to 8 additional BP containers per contract year. The contractor shall have them in service within 20 weeks of the request. The Government may require more than eight (8) additional containers in a calendar year however the contractor will have up to 120 calendar days to place them into service. The locations for these containers will be determined by the COR and in coordination with the Jackson Guard.

1.1.3. Over and Above Requirements.

1.1.3.1. Unscheduled Pickup and Special Events. In addition to the scheduled solid waste collections, the Contracting Officer (CO) or COR may request the contractor make unscheduled collections and disposals.

For unscheduled pickups, the contractor shall respond within one (1) work day of notification from the CO or COR. For special events, the contractor shall also provide (or re-position as directed) solid waste containers. These containers shall be placed in locations for a length of time designated by the CO or COR.

The CO/COR shall notify the contractor in writing at least 3 workdays in advance of the special event date.

See Appendix A for workload data.

1.1.3.2. Construction and Demolition Debris (C&D). The contractor shall furnish roll-off containers constructed for commercial use in standard sizes of 20, 30, and 40 cubic yards. Permanent roll-off containers are located in various locations identified in Appendix B. The contractor shall also provide temporary roll-off containers to locations identified by the Government COR. The contractor shall provide service to permanent and temporary roll-off containers on an “as required” basis. In the event regular scheduled service is required for roll-off containers, the contractor will be notified by the Government COR of the location and frequency of the service. Upon notification by the COR, the contractor shall have 12 work hours to respond and complete servicing. Servicing includes pickup, disposal, and return to original location. All container servicing shall be accomplished IAW paragraphs 1.1.5., and 4.5. The Government may require the contractor to perform this service other than normal duty hours. The contractor shall recycle or dispose of all C&D at a permitted landfill or recycling facility.

1.1.3.3. – 1.1.3.5. Government Provided Containers. The Government reserves the right to purchase and modify containers to meet unique requirements and timelines. The contractor may be tasked to service these containers on an on call or recurring bases. On calls will be handled by COR request and recurring service requirements will be added to appendix A. The Government will remain responsible for the maintenance and replacement of these containers.

1.1.3.6. Additional Pickups. In the event unusual conditions cause a container to require pickup before the scheduled time, the CO may request in writing (email/fax sufficient) pickup within 24 hours. The contractor will be bill per contract line item in accordance with the contract Schedule.

1.1.4. Inclement Weather Schedule. The contractor shall collect MSW and recyclable material during periods of inclement weather. In cases of severe weather, the CO/COR may authorize exceptions. When exceptions are granted all missed collections shall be performed within 24 hours after the severe weather has terminated, unless the CO authorizes additional time.

1.1.5. Route Parameters. The contractor shall establish routes to the base through the North gate or as directed by the Government. Collections shall be made between the hours of 0500-1800 Monday – Friday for all containers. Roll-off containers shall also be serviced on Saturday between the hours of 0600-1500 as required by the Government COR.

1.1.5.1. The contractor shall establish routes so that all containers within a restricted or secured area (e.g., ammunition areas) are serviced during normal working hours. The contractor shall identify in writing the employees performing service to any containers located in restricted or secured areas. As a minimum, the names, social security number, type of vehicle and start date of employment shall be provided. The contractor shall update list as changes occur.

1.1.5.2. The contractor shall notify the CO or COR of any conditions that may interrupt the schedule of performance such as disposal sites backed up, delays due to security measures, exercise, vehicle breakdowns, blocked containers, etc.

1.1.5.3. The contractor shall comply with all security procedures to ensure restricted/secure areas are not compromised. This may include but is not limited to: opening and securing privacy fence gates and/or dumpster enclosure doors.

1.1.6. Points of Collection. Collection stations for MSW and recyclable materials are shown in Appendix B. The contractor shall position bulk containers for customer ease in depositing MSW. The contractor shall also position containers to minimize interference with adjacent parking areas, sidewalks, roadways, overhead utilities, trees, and other potential obstructions. The contractor shall accomplish service for all containers on days and frequency stated in their collection schedule IAW requirements in paragraph 1.1.5.

1.1.7. Cubic Yard Capacity. Proposed capacity of containers is indicated in Appendix B. The contractor is encouraged to identify changes to the capacity of containers and/or pickup frequency to improve the overall efficiency of MSW and recycling removal, and to submit these changes to the COR.

No changes shall be made until approved by the COR.

1.1.8. Government-Approved Containers. Collection of MSW and recyclable and compostable materials in all areas shall be from contractor-provided, COR approved containers.

1.1.9. Maintaining Containers and Collection Area. The contractor shall return all MSW and recycling containers to their original location after servicing, in an upright position with the lids securely in place (closed). The contractor is responsible for cleaning up any spills, debris, etc., on the ground within ten (10) feet of the container when servicing a location. The contractor shall collect debris placed at collection stations; for example, tree branches, sacks, cartons, boxes, cans, tied bundles, or other containers. It is intended that the majority of debris will be placed in containers. The contractor shall notify the COR of locations where debris is frequently placed outside of containers so the COR may notify facility managers and, if necessary, the contractor can adjust the container size or pickup frequency with COR approval. The contractor shall be responsible for keeping collection areas free of solid waste and debris.

1.1.10. Weighing of Vehicles. All vehicles used in the collection of MSW, C&D, and organics shall be weighed at transfer stations and landfills as required by state operating guidelines. Incoming and outgoing vehicle weights shall be recorded on weight tickets provided by the operator at the weigh station. The contractor shall submit a monthly report IAW paragraph 1.5. which includes weight tickets reflecting the disposed tonnage figures, date of disposal, and type of vehicle and cost of landfill tipping fees. The contractor shall be paid in accordance with separate contract line item per contract Schedule.

1.2. RECYCLABLE MATERIALS PROCESSING. The base operates a Qualified Recycling Program (QRP) to reduce the volume of non-hazardous solid waste generated. It is the intent of the base to conduct direct sales of recyclable commodities through a QRP.

1.2.1. Materials. The following items shall be recycled: industrial scrap metal, cardboard/pressboard, or any other items that may be identified as recyclable at a later time.

1.2.2. Pickup Points. Contractor shall provide recycling containers at the locations specified in Appendix B. Containers shall be emptied as specified in paragraph 1.1.1.1.

1.2.3. Base Recycling Center. The Government will provide the contractor use of the base recycling center for the purposes of disposal of recyclable material only.

1.2.3.1.-1.2.5. Reserved.

1.2.6. Composting. Wood and compost material shall be transported to the Eglin AFB Compost Facility, Wright Landfill, or other designated location as directed by the Government.

1.3. DISPOSAL.

1.3.1. Off-Base Disposal. The contractor shall transport and dispose of all municipal solid waste at a permitted off-base disposal site. A copy of the landfill(s) operating permit that material is transported to shall be provided to the COR. The contractor shall transport recyclable commodities to an on-base material recovery facility. The contractor is responsible for disposal being in accordance with existing local, state, and federal regulations. The contractor shall be responsible for any permit or fees associated with the use of off-base disposal locations and invoice per contract line item number in accordance with contract Schedule.

1.4. EQUIPMENT MAINTENANCE.

1.4.1. The contractor shall furnish containers that match the approved color scheme of the base.

Additional re-painting must match the approved color scheme. The contractor shall maintain all contractor-furnished containers ensuring containers are reasonably free of unpleasant odors, dirt, debris, and pests. All containers must remain in good, workable condition with no leaks or broken parts. They must remain easily accessible to customers. Trucks and trailers used for hauling and collecting shall be free of odor, dirt, debris, and pests. Contractor vehicles and equipment shall not have any waste or equipment leaks such as oil or hydraulic fluid. Should any contractor vehicles or equipment have any leaks, the contractor is responsible for cleanup. Containers no longer serviceable or repairable shall be replaced from the contractor’s back-up stock at no additional cost to the Government. The contractor shall perform all cleaning, painting, repair and other maintenance tasks off base unless otherwise approved by the Government.

1.4.2. Painting Requirements. Containers shall be painted as required upon notification of the Government COR. Containers shall be maintained free of rust, dents, and broken or inoperable parts at all times. The contractor shall provide replacement containers to take the place of the container being painted. The contractor shall paint containers with the approved colors unless otherwise directed by the Government.

1.4.3. Cleaning Requirements. The contractor shall be responsible for the cleaning and deodorizing of all contractor-furnished containers and compactors per industry standard in order to maintain good public health. The contractor shall ensure the compactor is totally operational after servicing or cleaning.

1.4.4. Signage Requirements. All containers shall be marked with signs, which comply with Federal, State, Base, and local regulations and requirements The contractor shall maintain a list of all containers and update as required. Listing shall be available to the Government COR upon request. The following specific signs shall also be permanently affixed to each contractor-owned and/or Government-furnished containers. The contractor shall comply with any and all changes to signage requirements upon notification of the Government COR.

1.4.4.1. As a minimum, all front load containers shall have five (5) signs stating:

NO CONSTRUCTION OR YARD WASTE MATERIAL; DO NOT PARK WITHIN 15 FEET;

NO CARDBOARD; NO HAZARDOUS WASTE; and KEEP DOORS CLOSED.

All signage shall be at least 6x9 inches or larger. The contractor shall ensure proper signage is legible and readable at all times. The contractor shall replace any missing or damaged signage within two (2) workdays of notification of Government COR or immediately upon discovery by contractor personnel.

1.4.4.2. Cardboard Recycling Containers. Cardboard containers shall be eight (8) cubic yard containers, with self-closing lids and slot cut in top front for insertion of flattened cardboard. Location and frequency of collection are specified in Appendix B. Containers shall be painted green (color to be approved by the Government) and clearly marked “CARDBOARD RECYCLING ONLY”. All signage requirements as stated above apply to recycling containers.

1.4.4.3. Sawdust Collectors. The contractor shall provide containers for the collection of sawdust as required. The container shall be modified to fit the collection system and shall be marked with the words

“SAWDUST ONLY”.

1.5. REPORTS AND RECORDS. The contractor shall provide a monthly report (invoice) detailing total tonnage of solid waste and C&D collected, landfill tipping fees and weight tickets. Format will be coordinated with the COR. The monthly invoice shall be submitted to the Government COR no later than three (3) workdays following the month of service using electronic means of submission, i.e. Wide Area Work Flow (WAWF). The contractor will be informed if changes to the submittal process are required. The contractor shall provide monthly landfill or transfer station report listing all transactions for the month. Report shall contain the load/ticket number, date, and time, and total weight. The contractor shall supply this information for all types of refuse to include normal refuse, construction and debris matter, composting material, and metal. Recyclable material delivered to the Eglin Recycling Center will be tracked and recorded by the Government.

1.5.1. The contractor shall submit completed copy of the roll-off call log with tonnage for each call and landfill location. Separate receipts for compactor tonnage shall also be required.

1.6. VARIATION IN WORKLOAD. Workload estimates in Appendix A are provided as a guide to the contractor in estimating manpower workload and scheduling requirements. Variations can be expected for all types of services to include special events and unscheduled services.

Variations/deviations in workload data shall not constitute grounds for a claim against the Government.

In accordance with Appendix A, Estimated Workload, the Government reserves the right to increase/reduce services to meet changing requirements and/or budget constraints. The contractor will be notified of any changes to contract requirements.

SECTION 2

2. SERVICE SUMMARY (SS). The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. Unless indicated elsewhere these performance objectives will be measured monthly. The performance threshold describes the minimum acceptable levels of service required for each mission critical objective. The SS and the contractor’s Quality Control Plan (QCP) provide information on contract requirements, the expected level of contractor performance and the expected method of Government surveillance and confirmation of services provided. These thresholds are critical to mission success.

2.1. Quality Control. The contractor shall develop and maintain a quality control program to ensure ISWM practices are performed IAW commonly accepted commercial practices and services identified in this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-performance and continual repeat of defective service does not occur. As a minimum, the contractor shall develop quality control procedures addressing the areas identified in paragraph 2, Service Summary.

2.2. Performance Evaluation. Performance of a service shall be evaluated to determine whether or not it meets the performance requirements of this contract. Re-performance of unacceptable services at no additional cost is the preferred course of action when appropriate. In the case of issued Corrective Action Reports (CARs), the Contracting Officer shall take appropriate measures according to FAR 52.212-4(a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance.

2.3. Performance Assessment.

2.3.1. Periodic Validation. This method requires the COR to employ a “spot check” style of evaluation based on the contractor’s vehicle routes and collection schedule. Periodic surveillances will be conducted on a minimum of 10% of the serviced refuse dumpsters at least once each year; and may be adjusted, based on quality trends.

Any unsatisfactory inspection (defect) result shall be recorded, and the Contractor shall re-perform the service after notification by the COR.

Exceeding the performance threshold for any performance objectives may result in a warning or letter of concern from the Contracting Officer.

Exceeding the performance threshold of these performance objectives for any two, or more consecutive or non-consecutive months during a contract period may constitute an immediate Progress Meeting with the Multi-functional Team. All remedies shall be in accordance with the FAR 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance.

2.3.2. Customer Complaints. Customer complaints may be submitted by any form of communication, including fax and electronic mail to the COR. The COR will investigate the complaint and determine if the complaint is valid. If the complaint is valid, the COR will notify the Contract Project Manager and provide a copy of the complaint for his/her information and action. The Contract Project Manager shall provide written documentation to include date, time, and action taken to correct the defect. The COR will retain the documented complaint record in the contract surveillance files. Customer complaint forms become a permanent part of the COR surveillance records.

Failing to meet the performance threshold as outlined in the SS of these performance objective in any combination for any two, or more consecutive or non-consecutive months during a contract period shall constitute an immediate Progress Meeting with the Multi-functional Team. All remedies shall be in accordance with the FAR 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance.

2.4. Periodic Progress Meetings. The Contracting Officer, COR, other Government personnel as appropriate, and the contractor shall periodically meet as needed to discuss the contractor’s performance.

The following issues should be discussed; opportunities to improve the contract, any modifications required of the contract, unsatisfactory inspections and valid customer complaints against each performance objective observed and steps taken by the Contractor to prevent occurrences in the future.

The contractor shall provide a summation of unsatisfactory inspections and customer complaints and provide insight into any identified trends.

Contracting will put the minutes in writing, signed by the CO and any other signatures as deemed appropriate, distributed to the functional area and the contractor and a copy placed in the official contract file. Should the contractor not concur with the minutes, the contractor will provide a written notification to the Contracting Office identifying areas of non-concurrence for resolution.

SECTION 3

3. GOVERNMENT FURNISHED PROPERTY. The Government will not provide any facilities or storage space for the contractor’s use under this contract.

3.1. Security, Fire and Medical Services. The Government will provide police and fire protection. In the event of a medical emergency, base ambulance service for transporting an injured employee to a local hospital is available on a cost reimbursement basis. Security Police/Fire Department telephone extension is 911 for emergencies. Security Police extension for routine calls is 850-882-2502 and Fire Department is 850-882-5856. The Government assumes no non-contractual, i.e. tort or other theory, liability, via its provision of these services.

3.2. Contractor-Furnished Property, Equipment and Services. The contractor shall furnish all personnel, vehicles, and equipment required to perform all contract requirements.

3.2.1. Telephone Service. The contractor shall maintain at his own expense an operating business telephone at all times. The contractor shall provide a point of contact and phone number at contract start.

3.2.2. Personnel.

The contractor shall furnish identification badges, clothing and equipment to contractor personnel as required for job performance. All personnel requirements in Section 4 shall apply.

SECTION 4

4. GENERAL INFORMATION.

4.1. Quality Control. The contractor shall develop and maintain a “Quality Control Plan” to ensure integrated solid waste management are performed in accordance with commonly accepted commercial practices and standards. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. As a minimum the contractor shall develop quality control procedures addressing the areas identified in paragraph 2, Service Summary. Contractor records shall be kept and made available to the Government throughout the contract performance period. The Quality Control Plan shall be approved prior to contract start date and revised, as required, through the life of the contract.

4.1.1. Quality Control Manager. The contractor shall also appoint an individual as the Quality Control Manager. The Quality Control Manager shall ensure daily operations are on schedule and completed within specified timelines. Contractor quality control procedures and practices shall be independent from the Government quality control surveillance/inspections. The Quality Control Plan and name of appointed Manager shall be approved prior to contract start date. The Quality Control Manager or alternate shall have full authority to act on all contract matters relating to the daily operation of the contract.

4.2. Quality Assurance. The Government will appoint a Contracting Officer Representative (COR) to inspect and evaluate the contractor’s performance to ensure services are received IAW contract requirements. The Government COR will evaluate the contractor’s performance through intermittent on-site inspections of the contractor’s quality control program, validating actual work performance, physically checking an attribute of the completed task, checking a management information report, and investigating customer complaints. The Government may alter the frequency of surveillance inspections at any time during the course of the contract.

4.2.1. All customer complaints will be addressed to the Government COR. The COR will verify and validate each customer complaint. All valid complaints will be documented and the contractor will have four (4) work hours after notification to correct the discrepancy. Services that were not or cannot be re-performed in an acceptable manner will count against the performance threshold per Section 2, Service Summary.

4.2.2. Government Observations. Government personnel, other than Contacting Officers and Inspectors, may from time-to-time with CO coordination, observe or inspect contractor operations.

However, these personnel may not interfere with contractor’s performance.

4.3. Government Remedies. Procedures as set forth in the FAR 52.212-4(a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies.

4.4. Hours of Operation. Hours of operation shall normally be between the hours of 0500 to 1800 Monday through Friday, Saturday 0600-1500. Specific exceptions to these hours are listed in paragraphs 1.1.5., 4.4.2. and 4.4.3. The Government reserves the right to change hours of operation or restrict contractor access. Work outside these hours is prohibited without Contracting Officer approval.

Approval for extended hours during exercises or mission changes will not be unreasonably withheld.

4.4.1. Recognized Holidays. The contractor shall provide regular scheduled collection service on all Federal holidays except for as stated in paragraph 1.1.5. Collections scheduled for Thanksgiving Day, Christmas Day, and New Year’s Day shall be completed the following workday. Completion of collection schedule for these days shall have no bearing or impact on the contractor’s responsibility to complete all regularly scheduled collections/service.

4.4.2. Hours of Operation Other Than Normal. The contractor shall work whatever hours necessary to resolve an emergency occurring within his or her area of responsibility. There are numerous mission situations that may require the contractor to work other than normal hours. Some of these situations include but are not limited to: military exercises, contingency operations, weather emergencies, or other special events such as open house, change of commands, distinguished visitor support, inspection, fire power demonstrations, etc.

4.4.3. Emergency Services. Emergency services include accident and rescue operations, civil disturbances, natural disasters, and unanticipated/unscheduled military peacetime and wartime contingency operations and exercises.

4.4.3.1. During emergency situations, i.e. hurricanes, etc. or as directed by the Contracting Officer, the contractor shall move and secure containers to a holding area. The contractor may also be required to relocate containers to support mission exercises. Any emergency service requirements shall begin within two (2) hours of notification, and shall be completed as expeditiously as possible.

4.4.3.2. The contractor shall use the priorities established by the Contracting Officer if the activation or exercise of multiple contingency plans generates conflicting support requirements. The Government may elect to augment surge requirements to ensure accomplishment of mission.

4.4.3.3. When access to a work area conflicts with an Air Force mission requirement, the contractor shall schedule his or her work to minimize the disruption. Such scheduling may require work to be accomplished at times other than normal duty hours.

4.5. SECURITY REQUIREMENTS.

4.5.1. Contractor/Employee Base Pass and Identification, Special Clearances and Vehicle Passes.

The contractor shall comply with all requirements and procedures IAW FAR 5352.242-9000, Contractor Access to Air Force Installations. All documentation shall be submitted at the pre-performance conference. The contractor shall also comply with all requirements and procedures IAW EAFBI 31- 101, Installation Access. The contractor shall ensure all employees requiring access to the installation to include all ranges and sites have completed all requirements and obtained authorization from the contracting office. All vehicles shall be operated IAW Base traffic rules and regulations. Vehicle operators that will service aircraft shall complete the Eglin Base Operations Flight Line Driving Orientation prior to operating on any portion of the active flight line. The Government reserves the right to limit or deny access to the installation as required.

4.5.2. The contractor shall retrieve all identification media, including vehicle decals, from employees who depart for any reason before the contract expires, e.g. termination, retirement. Vehicles are subject to inspection by the COR, Base Safety Office, and Security Forces.

4.5.3. Restricted Areas. During the course of the contract, certain areas/sites may be restricted or closed to contractor personnel. The contractor shall comply with requirements for entry to include signing in or securing an entry badge. The contractor may have to work outside of normal work hours as stated in paragraph 4.4. to accomplish service in a restricted area.

4.5.4. Physical Security.

4.5.4.1. Government and Personal Property. The contractor shall be responsible for safeguarding all Government property. The contractor shall conduct work so that property, personnel, and work areas shall be protected at all times from inconvenience, damage, or injury. In the event of damage of any nature, caused by contractor operations or employees, due to improper protection, precaution, or safety measures, such damages shall be repaired or replaced by the contractor at his expense.

4.5.4.2. Key Control. The contractor shall establish and implement methods of ensuring that all keys/key cards issued to the contractor by the Government are not lost or misplaced and not used by unauthorized persons. No keys issued to the contractor by the Government shall be duplicated except as authorized. The contractor shall include key control procedures in his Quality Control Plan.

Procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. At the close of each work period Government facilities, property, and material shall be secured.

The contractor shall immediately report any occurrences of lost, unauthorized use or unauthorized duplication of keys to the Contracting Officer and/or Government COR.

4.5.4.3. Lock Combinations. The contractor shall establish and implement methods of ensuring that all lock combinations (including range gates) are not revealed to unauthorized persons.

4.6. PERFORMANCE OF SERVICES DURING CRISES DECLARED BY THE NATIONAL

COMMAND AUTHORITY. IAW DFARS 237.76 and aforementioned Air Force implementation, unless otherwise directed by an authorized Government representative, it is determined that services as identified in this Performance Work Statement (PWS) are essential for performance during a crisis.

4.7. SPECIAL QUALIFICATIONS.

4.7.1. Contract Manager. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and alternate shall be designated in writing to the Contracting Officer prior to the contract start date. Changes to personnel shall be submitted to the Government within five (5) workdays of the changes. The contract manager or alternate shall have full authority to act on all contract matters relating to the daily operation of the contract. The contract manager or alternate shall be available to speak/meet with the CO or COR within one (1) hour of request within normal operating hours and two (2) hours after normal operating hours.

4.7.2. Contractor Employees. The selection, assignment, and management of contractor employees is the responsibility of the contractor; however, the contactor shall not employ any individual who is identified as a potential threat to the health, safety, security, and general well-being, or operation of the installation’s mission or personnel. The contractor is fully responsible for the performance and conduct of his/her employees at all times. The contractor shall not allow any employee to perform work under this contract while under the influence of alcohol, drugs, or any other incapacitating agent. Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. This shall be accomplished by the wearing of distinctive clothing bearing the name of the company or by possessing the appropriate badges containing the company’s name and employee picture.

4.7.3. Contractor Manpower Reporting Application (eCMRA)

The Contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract via the secure data collection site (i.e.

Contract Manpower Reporting Application). The contractor is required to completely fill in all required data fields using the following web address http://www.ecmra.mil. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the above eCMRA help desk.

4.8. RESERVED.

4.9. CONTRACTING OFFICER AND CONTRACTING OFFICER REPRESENTATIVE.

(QUALITY ASSURANCE PERSONNEL) The Contracting Officer will appoint a primary and alternate representative for management of the day to day activities of the contract. The identity, title, and authority of this representative will be provided in writing to the contractor after contract award.

4.10. SAFETY REQUIREMENTS AND REPORTS. The contractor shall perform work in a safe manner as required by Eglin AFB and in accordance with all Occupations Safety and Health Act (OSHA) standards and AFOSH. All requirements as specified in Appendix D, Safety Requirements shall apply to the contractor and any and all subcontractors performing work under this contract. The contractor shall provide a verbal report to the CO/COR within four (4) hours for each occurrence of damage to Government property or an accident resulting in death, injury, occupational disease, or adverse environmental impact. The contractor shall provide a completed copy of required Accident Investigation Reports to the CO within three (3) calendar days of each occurrence.

4.10.1. Include a clause in all subcontracts to require subcontractors to comply with the safety provisions of this contract to include cooperation and assistance in accident/mishap reporting and investigation.

4.11. ENVIRONMENTAL REQUIREMENTS.

4.11.1. Compliance with Laws and Regulations. The contractor shall be knowledgeable of and comply with all applicable Federal, State, Interstate, and local laws, regulations, and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this contract, the contractor is required to comply as such laws come into effect.

4.11.2. Notification of Environmental Spills. If the contractor spills or releases any substance contained in 40 CFR 302 into the environment, Table 302.4 List of Hazardous Substances and Reportable Quantities, the contractor shall immediately report the incident to the Unit Environmental Coordinator (UEC) at 882-6969, and Contracting Officer or designated COR. The contractor shall have and maintain a spill kit on each vehicle large enough to contain 110% of the maximum volume of chemicals carried on that vehicle. The liability for the spill or release rests solely with the contractor.

The contractor is responsible for all costs associated with clean-up and restoration including any applicable fines and/or penalties. The Government reserves the right to initiate and complete all cleanup actions. However, the Government’s actions will not alter or amend the contractor’s liability for site cleanup.

4.11.3. Hazardous Waste/Used Oil. The contractor shall comply with AACI 32-7003 Hazardous Waste Management and AAC Plan 32-7 Integrated Solid Waste Management for the management, reuse, recycling and disposal of hazardous waste and used oil.

4.11.4. Contractor-Furnished/Operated Vehicles. Vehicles shall be maintained in good operating order and meet all Federal, State, local, and base requirements. This includes but is not limited to:

compliance with environmental laws, weight restrictions, and safety requirements. The contractor shall not perform vehicle maintenance or repair on Government property unless classified as an emergency or as approved by the Contracting Officer.

APPENDICES

5.0 APPENDICES. The Government will make all publications, forms, references and report formats listed available. Publications can be accessed on-line at http://www.e-publishing.af.mil/. Supplements or amendments to listed publication from any organizational level may be issued during the life of the contract. The contractor shall immediately implement those changes in publications, which result in a decrease, or no change in the contract price. Prior to implementing any such revision, supplement, or amendment that will result in an increase in contract price, the contractor shall submit to the CO a price proposal and obtain prior approval. Price proposals shall be submitted within 15 calendar days from the date the Contractor receives notice of the revision, supplement, or amendment giving rise to the increase in cost of performance. Changes in the contract price due to supplements and amendments shall be considered under the FAR 52.212-4, Contract Terms and Conditions - Commercial Items clause. Failure of the contractor to submit a price proposal within 15 calendar days from the date of receipt of any change, shall entitle the Government to performance in accordance with such change, at no increase in contract price.
