Vendors Question/Statement:

Question 1

In "Response to Questions 01Sept15" paragraph 2. Requirements, the government adds to the specification by stating operating capabilities and building standards as well as verification of a minimum of 2 years production of the proposed craft with at least 20 previous hulls having been delivered. The response to question 3 reinforces the Specification, Page 1, that calls for "...exclusive stringer system with angled transverse framing." This is, so far as we are aware, a unique construction technique particular to one builder. The government acknowledges this by the use of the descriptor "exclusive." This amounts to a sole source procurement when combined with experience requirements cited in paragraph 2 of the questions. Mandating a particular construction detail unique to one builder rather than a defined standard and prior experience is arbitrary and capricious. Is the use of an "...exclusive stringer system with angled transverse framing" a requirement for a responsive proposal?

Answer 1:

This question has been previously answered as noted below, the term that this vendor used “exclusive” is not reflected in the Governments answer to previous questions. The term “exclusive” that this vendor used was placed in the specification to describe a stinger system the Government requires to be built. It appears that the vendor is making statements based on an opinion and is not reflected within the technical documentation provided. The Government does not concur with the vendor’s assumption Previous answer provided:

The requirement will not be revised; However the speed shoe performance wing design and stringer system of all manufacturers will be evaluated provided their proposal meets the requirement that the hull structure shall be comprised of an angled stringer system to protect against failure. As specified all of the ribs will tie into the bottom of the hull to the centerline keel at an angle, (opposed to perpendicular) then into the stringers, chines, and transom.

Clarification:

Within the specification the Governments definition of an exclusive stringer system is that of any manufacturer that meets the specified requirement and has been delivered on a production basis as defined by the Government. Any vendor that builds or has built this type of structured system should submit their proposal. All manufacturers will be evaluated provided their proposal meets the requirements.

Question 2: Positions 1 and 2 - SHOXS Seats, SHOX-6800 shock mitigating seats fitted for 12" adjustment with adjustable height folding footrest, fore/aft and height adjustments. We traditionally use the 2000 Series SHOXS Seats with great results. This is the same as the configuration used by USCBP. Please see the attached spec sheet of SHOXS 2150.

Utilizing a 2000 Series SHOXS Seat will also allow for additional storage in the aluminum seat box that it mounts to.

Would a 2000 Series SHOXS Seat be considered as a suitable replacement or "as equal" for this line item in the specification?

Answer: Provided the SHOXS 2150 seats offer the same level of crew fatigue reduction, adjustment and safety the seats will be considered suitable replacements.
