About this file

This is a Sole Source (Including Brand Name) Justification document from the 50th Contracting Squadron at Schriever Space Force Base for the renewal of Oracle Premier Care License maintenance subscriptions. The requirement is for a firm-fixed-price renewal to support existing Oracle hardware and software systems, with a period of performance from February 1, 2025 to January 31, 2026 using 3410 funds.

The justification explains that Oracle has proprietary rights for its systems and only authorized resellers can provide the maintenance subscriptions. A sources sought notice (FA255025Q0007) was posted on SAM.gov from January 3-8, 2025, which yielded four interested vendors, though only one was an authorized Oracle reseller. The acquisition strategy is to solicit the brand-name requirement through full and open competition on GPE since the subscriptions are not available on GSA, ESI, 2GIT, or CCS-3. The document notes that switching to different systems would require complete redesigns, new hardware estimated at minimum servers, and extensive software engineering work estimated at man-hours, making alternative solutions impractical. The contracting officer expects pricing to be fair and reasonable based on competition among authorized resellers.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

A sources sought was posted to SAM.gov, Announcement # FA255025Q0007, from 3 January 2025 to 8 January 2025 to determine market capability and interest in this requirement. The list of items with quantities the Oracle Premier Care License maintenance subscriptions will support was attached to this sources sought. The sources sought instructed interested vendors to respond if they are capable of supplying the required Oracle Premier Care License maintenance subscriptions to support the items on the list or could supply the Government non-Oracle maintenance subscriptions that are capable of supporting the existing items as listed. In response to the sources sought, vendors declared their interest. Only of the companies who indicated interest is on the Oracle Partner Finder Website as an authorized reseller. No substitute solutions were identified, nor vendors indicating interest with availability of substitute solutions. With multiple interested and capable vendors identified, the acquisition strategy to solicit a brand-name requirement for the Oracle Premier Care License maintenance subscriptions with full and open competition through the Governmentwide Point of Entry (GPE) will be utilized.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer expects to find the cost to be considered fair and reasonable based on anticipated adequate competition via multiple quotes from certified/authorized resellers.

Reasonableness may also be determined using a comparison of the proposed prices with prices found fair and reasonable on previous purchase, comparing the proposal with the IGE, and utilizing current price lists/catalogs.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Oracle Premier Care License maintenance subscriptions are considered commercial. The sources sought posted to SAM.gov on 3 January 2025, as well as review of the Oracle website's PartnerNetwork and the Oracle Marketplace website, revealed that there are multiple authorized vendors and interested vendors who are capable of fulfilling this requirement. The sources sought yielded four interested vendors. Of the sources sought respondents, only able to provide the Oracle Premier Care License maintenance subscriptions as an authorized reseller.

The market research did not identify any alternate solutions capable of meeting the requirements for the without significant risk, modification, or cost and time. Oracle Premier Care License maintenance subscriptions are proprietary and integral to maintaining system integrity and functionality, making alternate solutions unsuitable.

The market research supports findings of multiple vendors able to provide the Oracle Premier Care License maintenance subscriptions but does not demonstrate ability to set aside for small business. By soliciting under full and open competition on the GPE, a mix of both large and small businesses will be able to submit quotes for this requirement, promoting healthy competition with the brand name limitation.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

This is a recurring need for the mission partner to renew its Oracle Premier Care License maintenance subscriptions. The nature of the Oracle Premier Care License maintenance subscriptions is such that they are updated annually; therefore, a multi-year contract is not feasible. The Oracle Premier Care License maintenance subscriptions to support the specific Oracle items listed in their entirety in paragraph III of this document are not available on GSA, ESI, 2GIT, or CCS-3.

X. List of any sources that expressed, in writing, an interest in the acquisition.

Respondents to the Sources Sought posted on 3 January 2025 were and

- Companies who expressed interest under FA255024P0005 were and

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

Oracle has proprietary rights and copyrights on the Oracle Premier Care License maintenance subscriptions to satisfy this requirement, and these can only be provided by Oracle and/or its authorized partners/resellers without voiding Oracle rights, copyrights, and warranties. The agency cannot remove or overcome the barriers for proprietary maintenance subscriptions.

The sole source justification (SSJ) approved for the previous Oracle Premier Care License maintenance subscriptions purchase under FA255024P0005 stated the Government would take the following actions: "Continued searches for commercially available hardware products of this kind (through market research and requests for information posts) to determine if the capabilities are able to meet the Government's requirements. Technical publications, trend guidelines, Air Force regulations and instructions as well as conferring with industry so that future actions may be solicited without a brand name restriction will be made if possible. As new trends formulate within production, the Government will continue to inquire about these devices, and research ways to develop, test and integrate them if possible."

The sources sought announcement # FA255025Q0007 revealed no alternate solutions to the brand-name Oracle Premier Care License maintenance subscriptions that would satisfy the requirement and not void the Oracle warranties without requiring a total replacement of hardware and software, as well as re-writes of applications and drivers, to allow the ISCS and MUOS systems to function. No other technology was identified as a result of the sources sought.
