DESCRIPTIVE DATA:
The Contractor shall furnish all labor, materials, ancillaries, incidentals and equipment to perform all work hereunder in accordance with technical provisions (Specifications) as listed in Section J, and drawings listed in Clause 252.236-7001 for the below listed CLIN for Project No. WWCX 07-1017.
The scope of this project requires the contractor to furnish all supervision, plant, labor, materials, tools, and equipment to repair/replace the fire suppression system at Detachment 3 to include the fire water tank and the service lines connecting the tank to Building 1824. Fire alarms valves will be replaced as required. Piping in the sprinkler system will be replaced as required and all sprinkler heads will be replaced. The work includes, but is not limited to providing a fully functional fire suppression system to protect this primary mission facility at Thule Air Base. All requirements stated in the National Fire Code and in Unified Facilities Criteria 3-600-1 Fire Protection Engineering for Facilities must be met. Outdoor installations must be duly protected from the harsh arctic environment at Thule Air Base. Building #1824 has a gross square footage of 26,293 SF, distributed on 2 floors. The existing fire suppression system covers all 26,293 SF, divided into 5 zones. The major components of the fire suppression system area: a) An outdoor 90,000 gallon fire water tank with underground service lines connecting to building #1824, b) An electric motor driven fire pump and a diesel engine driven fire pump, including fire pump controllers, c) 5 fire alarm valves controlling 3 dry pipe zones and 2 wet pipe zones, d) 2 air compressors to pressurize the dry pipe systems and a jockey pump to pressurize the wet pipe systems, e) Piping and sprinkler heads for the 5 zones. The location of Thule Air Base limits exterior work to the months of June through September, although work is sometimes possible in May or October. Additionally, Thule Air Base's location demands that all supplies/personnel must be shipped/transported in/out via air/sealift. Thule Air Base is not a commercial air/sea port and there is no other access.
Shipping schedules are dictated by Defense contracts, and materials and labor are not available locally. CONTRACTOR’S
MUST PROVIDE THEIR OWN ESCORTS HAVING PROPER SECURITY CLEARANCE FOR WORK IN
RESTRICTED AREAS.

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.
(a) Weather and storm conditions are listed in the project specifications. Contractor shall take into consideration the typical weather conditions depicted therein in planning the work to be performed under this contract. Typically, exterior work (or work outside) may commence on or about 15 June and continue through 15 September; give or take a few weeks.
Contractors shall take this into consideration in planning the work even though the contract may allow a performance period well into October.
(b) Sealift:
(1) Thule Air Base’s seaport is not a commercial port and therefore does not operate in accordance with typical commercial practices. Operation and support services are contracted out and are performed by the Base Maintenance Contract (BMC) contractor, Greenland Contractors. Due to the base’s location, its operation is limited to 30 calendar days, during the months of July and August. Ice is a frequent condition and should be expected. Additionally, the depth of the bay varies significantly with mean depth and tide, and is known to be shallow. While cargo and tanker vessels frequent the port annually without incident, larger vessels may find the port too shallow for berthing. There are no recent official depth calculations and contractors should exercise caution to ensure the size vessel contemplated is compatible with existing and current conditions, including ice, water depth, etc.
(2) The U.S. Government contracts for charter sealift to Thule from both the USA and Denmark, and return. Contractors may either subcontract their own sealift, or utilize the Government chartered sealift in accordance with the stipulations of this contract. Government furnished sealift provides the following:
(i) Sealift of contractor materials, equipment, tools, and supplies directly attributable to the performance of this contract from Norfolk,Virginia and/or from Aalborg, Denmark to Thule Air Base and reverse at no cost to the Contractor, but only up to the volume and/or the cost stipulated under this contract. Such transportation will occur only on scheduled Military Sealift Command (MSC) and/or Danish ships. Shipment will be in accordance with published summer shipping schedules of MSC and/or that issued by the Danish Shipping firm. Transportation to Norfolk, Virginia and/or to Denmark shall be at the Contractor’s expense. The Contractor is responsible for the direct coordination with the Military Ocean Terminal, Norfolk, Virginia and/or the Danish shipper to determine deadline date(s) for delivery of cargo to the terminal for shipment, as well as prior booking, proper markings and documentation and all other requirements necessary for acceptance of cargo for shipment.
Note that while this sealift is “free”, it’s estimated cost is considered in determining total price (see contract clause 52.247-60, Guaranteed Shipping Characteristics).
(ii) The Government shall provide transportation, at no cost to the Contractor, of Contractor’s equipment, tools, materials, and supplies from the ship to designated storage areas on the base and retrograde equipment and tools from the same storage areas to the ship. This transportation shall include off-loading and loading of ships. Items will be shipped containerized to the maximum extent possible. Full containers shall be delivered to the Contractor’s storage area, and it is the Contractor’s responsibility to unload these containers. All non-contractor owned shipping containers are required to be emptied within 36 hours of delivery and made available for transport back to the Sealift carrier. Arrangements to keep the containers for a longer period of time should be coordinated directly with the Sealift carrier.
(iii) The contractor is required to provide similar packing, marking and documentation with retrograde shipments as with shipments headed to Thule AB. Retrograde shipments shall be properly packed for sealift transportation; the contract number shall be clearly marked on all items; and a list of items shall be provided to the shipping contractor. These items are required not only for the safety of the goods being transported, but are required in order to transport the goods via our Sealift carrier. Items not properly packaged, marked and identified will not be accepted by the Sealift carrier.
(iv) Although sealift transportation is provided by the Government at no cost to the contractor, it's use is not mandatory. Additionally, the Government shall not assume responsibility for any equipment, materials, or property until such is integrated into the final work product at Thule Air Base, and paid for under the clause at 52.232-5. Any damage claims and settlement shall be handled directly between the transportation carrier(s) and the construction contractor(s); however, the Contracting Officer shall be notified of any damage within 72 hours of discovery.
(v) The Contractor shall furnish its own drivers who are required to have a valid driver’s license.
(vi) Contact Information:
(A) For MSC (shipments originating from/to the US): Ms. Libby S. Bishop, Pacer Goose Coordinator, Commercial Phone: (757) 444-3032 or 444-4714, DSN: 564-3032, Fax Ext: (757) 444-8953, E-Mail:
libby.bishop@navy.mil. Request all transportation problems relating to Pacer Goose (the US cargo vessel used for transportation) be directed to the above numbers or mailed to: Fleet and Industrial Supply Center, (N45631), Attn: Code
302 (Attn: Ms. Libby S. Bishop), 9248 Virginia Ave, Bldg. CEP-201, Norfolk, VA 23511. (NOTE: Do NOT deliver cargo to the above address!)
(B) For shipments originating from/to Denmark: Ms. Helle Christensen, Transportation Assistant, Commercial Phone: (45) 99 30 32 26, Fax: (45) 99 30 30 90, E-Mail: hch@ral.dk. Delivery Address of cargo: Royal Arctic Line, Gronlandshavnen. P.O. Box 8100, 9220 Aalborg Ost
(vii) All other transportation not covered in this clause is the Contractor’s responsibility at the Contractor’s expense.
(3) Should the contractor prefer, or requirements of the work require, furnishing their own sealift, the following applies.
(i) Private vessels must meet port entrance requirements.
(ii) To limit scheduling conflicts as much as possible, private vessels must coordinate arrival/departure dates/times with port operations well in advance.
(iii) With the exception of on/off-loading of ships, the services in paragraphs b(2)(ii) above apply. The contractor shall load/unload their vessel(s). Additionally, cargo shall be containerized to the maximum extent possible.
Optionally, the contractor may arrange for the port operations contractor (GC) to perform loading and/or unloading services;
however, such would be an agreement between contractors and cannot interrupt or take precedence over Government Contract requirements.
(c) Airlift:
(1) Contractors are cautioned that there are no commercial flights in or out of Thule Air Base.
Furthermore, there are no commercial airports within any reasonable proximity of the base, nor any roads or other routes with which to reach Thule Air Base. The US Government provides a four weekly charter service from Copenhagen, Denmark to Thule Air Base, Greenland, as well as a bi-weekly charter service between Kangerlussuaq, Greenland and Thule Air Base, Greenland. Additionally, there are military flights from McGuire Air Force Base, NJ and or Baltimore- Washington International Airport, Baltimore MD on a scheduled basis. These flights are principally for US Government and BMC contractor personnel. Other contractors (i.e., construction contractors, etc) are allowed to utilize these charter flights on a “space-available” basis. Contractors are put on notice that during peak-travel (summer and holiday) seasons, contractors may find the need to charter their own airlift in order to meet contract deadlines. The US Government does not provide charter arrangements for non-BMC contractor personnel and thus is not liable for delays should sufficient space not be available to meet your airlift requirements.
(2) All personnel travel is the Contractor’s responsibility and at the Contractor’s expense to include all costs associated with any site visit. Information on costs and availability for flights originating from or returning to Denmark are available through the Contracting Officer while flights originating from or returning to the US are available through the Air Mobility Command (AMC) focal point at: AMC Passenger Service (609) 724-3078. Contractors shall establish an account with AMC through Scott Air Force Base, phone (618) 256-4909 for further details. Should the contractor utilize government contract seat reservations originating from or returning to Denmark, post-award seat reservations will be monitored by both the contractor and government and will be reimbursed to the government upon completion/acceptance of the project by check payable to the U.S. Treasury. Charges for seat reservations originating from or returning to the US will be billed by and paid to AMC directly. Contractors shall contact the contracting officer for up to date information on Theater Clearances for all passengers traveling to Thule Air Base. At a minimum, the contractor is required to submit a list of names, social security numbers/labor numbers, passport number and dates of travel, no later than 14 days prior to arrival. Danish Contractor personnel shall pass "Medium Screening" by the Danish Ministry of Foreign Affairs.

52.246-21 WARRANTY OF CONSTRUCTION MAR 1994
(IAW FAR 46.710(e)(1))
(a) In addition to any other warranties in this contract, the Contractor warrants, except as provided in paragraph (i) of this clause, that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the Contractor or any subcontractor or supplier at any tier.
(b) This warranty shall continue for a period of 1 year from the date of final acceptance of the work. If the Government takes possession of any part of the work before final acceptance, this warranty shall continue for a period of 1 year from the date the Government takes possession. Items delivered to port of debarkation for shipment to Greenland shall not be warranted until actually incorporated into the work at the work site at Thule Air Base.
(c) The Contractor shall remedy at the Contractor’s expense any failure to conform, or any defect. In addition, the Contractor shall remedy at the Contractor’s expense any damage to Government-owned or controlled real or personal property, when that damage is the result of --
(1) The Contractor’s failure to conform to contract requirements; or
(2) Any defect of equipment, material, workmanship, or design furnished.
(d) The Contractor shall restore any work damaged in fulfilling the terms and conditions of this clause. The Contractor’s warranty with respect to work repaired or replaced will run for 1 year from the date of repair or replacement.
(e) The Contracting Officer shall notify the Contractor, in writing, within a reasonable time after the discovery of any failure, defect, or damage.
(f) If the Contractor fails to remedy any failure, defect, or damage within a reasonable time after receipt of notice, the Government shall have the right to replace, repair, or otherwise remedy the failure, defect, or damage at the Contractor’s expense. The location of Thule Air Base and the associated weather and shipping constraints shall have no bearing on "reasonable time" as an excuse to prompt compliance with any warranty requirement. The term "reasonable time" shall be determined solely at the Contracting Officer's discretion based on the circumstances.
(g) With respect to all warranties, express or implied, from subcontractors, manufacturers, or suppliers for work performed and materials furnished under this contract, the Contractor shall --

(i) Unless a defect is caused by the negligence of the Contractor or subcontractor or supplier at any tier, the Contractor shall not be liable for the repair of any defects of material or design furnished by the Government nor for the repair of any damage that results from any defect in Government-furnished material or design.
(j) This warranty shall not limit the Government’s rights under the Inspection and Acceptance clause of this contract with respect to latent defects, gross mistakes, or fraud.

(IAW AFFARS 5301-9103)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
(c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsman, Colonel Harold J.
