Break areas specified for contractor use are the responsibility of the contractor if or when appliances need to be replaced during the life of the contract

We could not find any documentation indicating which rooms are specified for contractor use and what appliances are in those areas. Is the government able to provide those details?

The CBA has certain requirements on the break areas for union personnel. The Government is not involved in how many break rooms are established or what items will be in each. If there is an open area and the contractor would like a break room or break area established for their personnel, they can do so. Currently there are contractor-established break rooms in the following areas: 2 areas in the Power Plant, one on each floor; 1 on the 4th floor of the PAR Bldg in TMRC;

and 1 in Bldg 730 (Industrial Building). These areas have refrigerators, and food preparation items that contractor personnel has donated and/or has requested from the contractor. There are several other break areas, such as in the MST area, Comm Center, Contractor Main Office, and Evironmental Office that also may have a smaller fridge, coffee pots, and items like a toaster or microwave. All items in the different areas have been there for many years (assume out of warranty) and appliance maintenance and replacement within those areas have been managed by the contractor personnel working in those areas.

Would you please provide which procedures authorized additional work at Level 1, and provide copies of those documents if they are not already in the Bidders’ Library?

Level 1 maintenance requirements found in the local work cards/procedures are equivalent to the Level 1 Maintenance requirements identified in the Technical Orders (TOs) in the Bidder's Library.

The TO's have been provided in the Bidder's Library.

Reference Documents that outline ISSM Level 1 responsibilities are AFMAN17-1303, Paragraphs 3.2.2.2, 3.2.2.3.

The answer provided for the question on CSL responsibilities does not completely clarify the requirement. AFMAN 17-1303 3.2.2 defines three levels of IAM certification rather than three levels of ISSM. The Base or Wing ISSM requires IAM Level II, which according to DoD 8570.1-M, is a step higher in certification requirements than for the ISSO and other PWS-required cybersecurity appointments (IAT II). Also, a previous answer (page 3) clarified that the ISSM is a government position.

PWS Paragraph 5.5.3.1 CSL Certification responsibilities are to perform ISSM Level 1 requirements. The ISSM requirements are equivalent to IAM Level 1 requirements and are outlined in DoD 8570 Baseline Certifications (Security + certification fills this requirement).

For clarification - PWS Paragraph 5.5.2 JWICS ISSO. The ISSM for JWICS is a government position. ISSO is a contractor position.

Question request: Please also allow requests for equitable adjustment to be made upon CBA labor rate change for base year or any option year.

Answer:

See changes in RFP Amendment 001, Section L paragraph D.3.a.3. "For those positions covered by CBA, the contractor must meet the minimum requirements of the CBA and shall also propose the negotiated CBA labor rate effective 1 May 2022 for the Phase In Period.

Offerors shall propose the negotiated labor rate that will be effective 1 May 2023 IAW the current CBA for the base period and all other contract periods of performance years."

The second request in the first question on that page was not addressed.

Section L.3.a.3 allows wage increase adjustments to be made in the option years but does not state whether equitable adjustments can be made for the Base period. If the incoming contractor re-negotiates the CBA under different conditions or rates starting in the base year, will wage increase adjustments be allowed for the base year? We do no believe that the Union is obligated to accept the same rates as negotiated with the incumbent contractor.

The paragraph quoted in the question further states:

"Wage increase adjustments for subsequent option years will be made as authorized and in accordance with FAR 52.222-43 “Fair Labor Standards Act and Service Contract Labor Standards – Price Adjustment (Multiple Year and Option Contracts)” if and when labor rates of the applicable CBA change. If the "applicable CBA" is newly negotiated (such as in the Base Period), the contractor may submit an REA at that time, if all applicable FAR clause requirements have been met.

Further: "At that time, the contractor will be authorized to submit requests for equitable adjustments for subsequent option year increases if all applicable FAR clause requirements have been met."

In this paragraph, "subsequent option year increases" refers to years beyond a current period of performance. Therefore, if the labor rates change for Option Period 1, a contractor's request for equitable adjustment may include within the request that those changes be carried forward into Option Periods 2 - 5 labor rates if all applicable FAR clause requirements have been met.

Q&A Based on some answers received on 10 February 2022 to contractor questions, [the vendor] respectfully requests an extension of two weeks to the proposal due date to evaluate and adjust our pricing and technical approach in light of these answers, and allow time for final internal bid approvals once changes are made. Specific items that require more processing time include:

1. A significant amount of additional information was provided, both in the bidders’ library and in the answers to questions. We request additional time to evaluate additional Bidders’ Library documents. For example:

a. Supplemental file containing Computer Inventory (Ch 3) – requires review and evaluation for impact to pricing/staffing already developed

b. R-14 Fire Trucks – requires evaluation of pricing, including whether maintenance for these trucks can be self performed or need to be contracted to an outside source

1. The solicitation period will not be extended. IAW the RFP, proposals are due no later than 1000 Mountain Standard Time on 28 February 2022. The requested information provided in the Bidders Library Supplemental Files does not justify an extension of the solicitation period.

1a. Additional documents were provided to the Bidder's Library for documents located on my.af.mil, gunter,af.mil, tinker.af.mil and wpafb.af.mil, in response to the statement/question received. Our response included the Bidders Library Supplemental Files posted to SAM.gov under FA251822R0001 and FA251821R0024 for documents with the my.af.mil, gunter.af.mil, tinker.af.mil and wpafb.af.mil file extensions.

In addition, the government provided copies of AFI, DAFI, and AFMANs pertaining to Chapter 5 (Comm) since we are aware that these regulatory documents are in the process of being updated.

Although these appear to add significant quantity of information, these were provided as a courtesty, as they are publicly available at http://www.e-publishing.af.mil. As stated in our initial response, every effort has been made to include in the Bidders Library (as supplemented at the time of Amendment 001 to the RFP) those materials necessary to prepare a competitive proposal.

The PWS as of 19 November 2021 was a snapshot in time of the current guidance documents, as is the PWS as of 1 February 2022 that was included as Attachment 1a with Amendment 001.

1b, During the site visit and industry days in September 2021, Industry was briefed on the expectation that the fire trucks would be included in the PWS prior to release of the final RFP.

Opportunities were given to ask questions following those meetings and the information being posted to sam.gov, as well as after initial release of the final RFP, which did include the Fire Trucks requirement.

Q&A Page 1 Question:

If Offerors have questions concerning the terms of the CBA, would the Government forward them to the IBEW and obtain & publish the answers?

Answer:

The Government is not a party to the CBA. Offerors may send questions regarding the CBA directly to the IBEW.

The government allowed bidders to contact the IBEW with any questions regarding the CBA. However, upon application to the IBEW on 2/14/22, the Union representatives stated that they had not received communication from the Contracting Office or other government entity authorizing them to answer questions. Questions, including those specifically asked in the Q&A, have a pricing impact. If the government is going to allow the IBEW points of contact to answer questions, we request extra time for them to answer questions, with a further period of time for bidders to evaluate and adjust their proposals accordingly. Will the government also please authorize the IBEW POCs to answer our questions?

The Government has no contractual relationship with the union, and therefore does not have authority over any communication between the union and potential offerors. The requirements for this contract are that the contractor must pay wages and fringe benefits at least equal to those agreed upon in the existing CBA, per FAR 22.1008-2. See the Bidders Library for the current CBA. The solicitation period will not be extended.
