About this file

This document is a Pre-Award Request for Information (RFI) for a Snap-On Tools project. The RFI contains four key contractor inquiries and corresponding government responses related to tool product specifications, part number updates, and compliance questions. The primary focus is on clarifying non-Snap-On tool products, including specific line items for ratchet sets, pliers, battery packs, and other tools. The solicitation is a small business set-aside, which exempts the contractor from the non-manufacturer rule.

Key compliance considerations include verifying tool manufacturers, updating discontinued part numbers, and addressing potential Berry Amendment implications. The government confirms that the Berry Amendment applies only to purchases above $150,000 and provides guidance on using tools from various origins, including TAA-compliant and some Chinese items. The RFI demonstrates a collaborative approach to resolving pre-award technical and regulatory questions before formal solicitation.

PRE-AWARD RFI

PROJECT TITLE: Snap-On Tools

CONTRACTOR RFI GOVERNMENT RESPONSE

1. Clarification on Non-Snap-On tool products.

o Line 133 – CER891427 (Pass

Thru Ratchet Set) o Line 128 – KDT3705 (Panel

Clip Plier) o Line 108 – OTC6511 (Fuel Line

Disconnect Tool) o Line 79 – HRR59 (Universal

Hose Clamp Pliers) o Lines 65–70: CTB8187, 18V

5Ah Li-Ion Battery Black o Lines 71–76: CTB8174, 14.4V

2.5Ah Battery Black

- The tools listed below are not made by Snap-on. I have listed the companies that make these tools. The Universal Hose Clamp Pliers part number should be HR59.

All other part numbers are valid.

2. YA1175 - the 15' retractable test leads are no longer made. There is a 30' retractable with two leads (Part #:

AEM1130)

CDRR761DB is discontinued. The new part number is CDRR861DB, please advise.

- The equivalent product is acceptable

3. Can you expand on how we are able to provide a response with Snap-On items and not have an issue with the nonmanufacturer rule?

- It is a small business set-aside and therefore the non-manufacturer does not apply

4. The second point is the list appears to be largely made up of federal supply code 51 and 52 tools. We understand these fall under the Berry amendment.

Given the majority of the list provided shows countries of origin that are TAA compliant with some Chinese items, and that simple assembly does not constitute significant transformation such that BAA may be invoked, are we legally clear to provide a quote for these items?

- The Berry Amendment applies to buys that are above $150K
