About this file
This document is an addendum to a Request for Quotes (RFQ) issued by the Florida Department of Corrections (Department) for outpatient substance use disorder treatment and aftercare services for Offenders in Judicial Circuits 1, 2, 4, 9, 10, 13, 17, 18, and 20. The addendum includes written answers to questions received as well as a revised Attachment I that specifies the preferred service site locations within each judicial circuit. Vendors must have a current or proposed service location within the designated areas to submit a quote for a particular judicial circuit. The Department is seeking Vendors with a minimum of two years' experience in providing these community-based services to the criminal justice population. Quotes are due by February 24, 2022, and the estimated contract start dates range from within 30 days of award to December 1, 2022, depending on the judicial circuit.
The addendum clarifies that the Department will not provide client recruitment, and referrals will be made by the supervising probation officer. It also states that there will not be any stop-gap threshold reimbursement for vendors, and the Department may request additional budget detail from vendors after reviewing their quotes. The addendum indicates the Department will consider negotiating waiting times based on verifiable workforce issues and that vendors are not required to have two years' experience providing aftercare services specifically.

FDC RFQ-21-046
Outpatient Substance Use Disorder and Aftercare Services for Judicial Circuits 1, 2, 4, 9, 10, 13, 17, 18, and 20
Question Number
Question Answer
What is the total number of offenders receiving substance use treatment, in Circuit 4, last year?
Approximately 1,800 Offenders located in Duval County, Florida, participated in Circuit 4 substance use treatment in 2021.
Approximately 1,703 Offenders received outpatient services and approximately 97 Offenders received residential services.
Does the Department refer all offenders needing substance use or aftercare screening and assessment to the contracted provider?
Yes. Offenders who need services will be referred by the Department by completing Section I of the Community Supervision Program Referral Form, DC5-404, for each Offender it approves for Program participation.
How many offenders in Circuit 4 are receiving substance use treatment or aftercare services from a provider other than the contracted provider?
Approximately 935 Offenders located in Duval County, Florida, participated in substance use treatment with a non-contracted provider in 2021.
Approximately 839 Offenders received outpatient services and approximately 96 Offenders received residential services.
There are a variety of different formats to document clinical progress notes (e.g., SOAP, DAP, DARP, SBAR, and CAPS) is the Department requiring DAP format and if so the rationale behind using this format and can other formats be used?
The Department requires the Data Assessment Plan (DAP) format for consistency in services statewide.
On page 20 for Judicial Circuit 10 it states Polk County and that services must be located within the city limit of Lakeland. We are in Hardee County and are included in Circuit 10, as is Highlands County. Are we excluded from this RFQ?
Please see Revised Attachment I – PREFERRED SERVICE
LOCATIONS.
Regarding capacity, we are trying to determine whether there will be a single provider in each of the circuits included in the RFQ, or whether the Department is looking
The Department requires one (1) Vendor for each location.
Question Number
Question Answer to add capacity (i.e. supplemental contract) and therefore, multiple vendors may exist. If there are multiple vendors, will there be client recruitment involved or will the referral sources be determining which vendor the client receives services from?
The Florida Department of Corrections Website, Offender Restoration Information & Outreach Network (ORION), provides the number of Offenders located in each Judicial Circuit: http://fdc.myflorida.com/pub/qlik/index.html
The Department will not provide client recruitment. The Supervising Probation Officer will refer Offenders to the location most convenient to the Offender.
Is the Department's goal to establish contracts for services with a single provider in each of these locations?
If so, will the existing provider be required to provide clinical records as a part of the transition of the contract?
Please see the answer to Question 6.
Existing Vendor(s) are required to cooperate with the new Vendor(s) to transition the clinical documentation (psychosocial, Individualized Treatment Plan, Treatment Plan reviews, discharge summary) for each Offender.
Is there a publically accessible data source that could provide us with the number of eligible clients in each circuit and/or can the Department provide that information?
Yes. Please see the link provided in Question 6.
Is the Department stipulating a new location in Collier county within the city limits of Immokalee?
Please see the answer to Question 5.
I am currently a vendor, outpatient substance abuse treatment provider, must I resubmit to the Department all the information that it currently has in regard to my company's current licensure, accreditation, Staff resumes, office locations, etc?
Yes. All interested Vendors must submit licensure and accreditation in accordance with Section 2.15 and Section 3 of the RFQ.
I will be submitting quote responses for several locations, will I be required to submit a full response for each location (Sections 1, 2, 3, 4, 5 and 6) or can I make one full response and then for each subsequent response just the sections specific to each individual location?
A single response for all locations is acceptable provided the Vendor completes and submits a separate Attachment II, Price Sheet, for each service location.
Do you require multiple copies of each Quote Response, or will one per location be acceptable?
Please see the answer to Question 11.
13 1.0 Overview, pg2 There are no Providers for Judicial Circuit 1 and Judicial Circuit 2.
http://fdc.myflorida.com/pub/qlik/index.html
Question Answer
Who are the current providers within each of these circuits or are any of these locations new as a part of this RFQ solicitation?
Circuit 4 – Chemical Dependency Counseling, Inc.
Circuit 9 – Specialized Treatment Education and Preventions Services, Inc., and The Transition House, Inc.
Circuit 10 – Behavioral Choices, Inc. and Halcyon Management Group, Inc., dba Lighthouse Addiction Services
Circuit 13 – Phoenix House
Circuit 17 – South Florida Therapeutic Solutions
Circuit 18 - Specialized Treatment Education and Preventions Services, Inc
Circuit 20 – Halcyon Management Group, Inc. dba Lighthouse Addiction Services
1.1 Background, pg2
If Drug Court exists in any of these counties, could they be referred to Aftercare at our location or would they complete Aftercare through the Drug Court directly?
An Offender should complete aftercare services as referred to and directed by the Drug Court.
2.0 Program Services, pg6
Telehealth
• Is telehealth currently being offered in any of the listed locations? If yes, what locations and what percentage of the service delivery is delivered via telehealth vs. in-person care?
• What is the anticipated percentage of services that can be telehealth vs. in-person?
• Is there a maximum amount of service delivery via telehealth?
Yes, Judicial Circuits 4, 9, 10, and 18 are providing a combination of in-person and Telehealth Services.
Telehealth Services are provided approximately 25% of the time and in-person services are provided approximately 75% of the time.
Judicial Circuit 13 provides in-person services only.
Judicial Circuit 17 provides group counseling via Telehealth Services approximately 35% of the time with in-person services delivered approximately 65% of the time.
Question Answer
Judicial Circuit 20 provides a combination of in-person and Telehealth Services. Telehealth Services for group counseling are provided approximately five-percent (5%) of the time with the remaining 95% provided in-person.
Rule 65D-30.004(20(c)) limits telehealth delivery to clinical screenings, assessments, medication management, and counseling. Telehealth Services must be delivered by a “Qualified Professional” as defined in Subsection 397.311(34), Florida Statutes (F.S.).
40% of the five (5) reimbursable services are required to be delivered in-person (Treatment Plan Review and Aftercare Plan Review). The remaining 60% can be delivered via telehealth by a Qualified Professional. The Department prefers in-person services.
All Telehealth Services must be provided in accordance with Rule 65D-30.002(82) and 65D-30.004(20), Florida Administrative Code (F.A.C.).
2.0 Program Services, pg6
Please describe all sources for client referrals (e.g. will these be continuum of care from other levels or direct admissions?)
Offenders may be referred through court order or by their Supervising Probation Officer.
2.13.1, Staff Background/Criminal Records Check, pg15 References appear contradictory, are counselors for these services required to pass Level II background screening or just Level I?
The Department requires a Level 1 FCIC/NCIC background check for all of the Vendor’s staff.
2.1.16, Offender Payments, pg8 For each location, can you identify the number of clients that are fully funded services by the Department's contract and the percentage that are self-pay and sliding scale?
If a client who is required to pay a portion of services fails
The Department cannot accurately identify the number of clients in each payment status by location. This number varies based on an Offender’s income, the sources of funding available to the provider, and other dynamic factors.
Question Answer to do so, will the Department fully reimburse the vendor for those services at the bid rate?
No. The Department will not reimburse a Vendor for services if an Offender fails to pay.
2.15 Licensure and Accreditation Maintenance, pg16
Does the service level included in these contracts qualify vendors for the exemption from accreditation as outlined in 397.403? The language is as follows, “This subsection does not apply to any inmate substance abuse program operated by or under an exclusive contract with the jail or the Department of Corrections."
The services sought through this solicitation are not inmate substance abuse programs. They are community-based substance use disorder services for Offenders on community supervision. They do not qualify for the exemption from accreditation as outlined in Chapter 397.403, Florida Statutes (F.S.).
2.3 Outpatient Substance Use Disorder Treatment
Services, pg9
2.4 Aftercare Services, pg11
What is the anticipated length of stay for Outpatient treatment and Aftercare treatment?
The length of stay is individualized based on the clinical assessment of each Offender receiving services. The Department does not maintain information related to the average length of stay.
2.3.3 Group Counseling, pg10
Is there a limit to the number of reimbursable service hours per week (or per month)?
No. There is not a limit to the number of reimbursable service hours per week or per month, but there are service limitations per Offender.
ATTACHMENT I: PREFERRED SERVICE SITE
LOCATIONS, pg18 The RFQ indicates that you can bid for one or more "service locations." Is a service location an entire judicial circuit or one service site within that circuit?
Service Locations are the individual sites listed in each Judicial Circuit. Vendors may submit a quote for one (1) or more Service Locations within the Judicial Circuit(s) in which services are sought.
ATTACHMENT I: PREFERRED SERVICE SITE
LOCATIONS, pg18 Would the Department consider allowing a vendor to utilize Probation office space to conduct groups?
Yes, the Department would consider it based on available space and staffing at a Department’s Probation Office.
ATTACHMENT II: PRICE SHEET, pg28 Will there be any stop-gap threshold reimbursement for these levels of care? (i.e. similar to the 70% reimbursement for residential levels of care)
No. There will not be any stop-gap threshold reimbursement for Vendors who provide services.
ATTACHMENT II: PRICE SHEET, pg28 Does the Department require any budget detail to be presented in addition to the Attachment II Form for each service location bid?
The Department may request additional budget detail after reviewing Vendor Quotes.
Question Answer
If a vendor is allowed to refuse services to an offender for failure to pay how does that impact the expected 52% successful completion threshold?
Vendors who refuse services based on non-payment shall provide written justification of the lower percentage rate associated with Offender discharge for refusal to pay for service.
Vendor is expected to provide available times convenient to offender - is there an expectation that available times include weekends and/or holidays?
Yes. Vendors shall provide services daily, including weekends and holidays.
Is there potential for financial incentives attached to achievement of higher successful discharge rates?
No.
Regarding the condition that there be no waiting list for services, Is this condition taking into consideration the fact that there are serious workforce issues across many industries in our economy including substance abuse and mental health services? Is there room in this RFQ to negotiate waiting times based on verifiable workforce issues?
The Department will consider negotiating waiting times based on verifiable workforce issues.
The RFQ states that the vendor should have a minimum of 2 years of experience providing the services, what if a provider has been doing outpatient but not Aftercare? It is our intention to add Aftercare licenses to our facilities but we won’t have the minimum experience for those services, is that allowable?
The Department does not require two (2) years of experience providing Aftercare services.
The RFQ states that the Department will indicate whether each offender referred will be Department funded, self pay or 50 % self pay and 50% Dept funded. Will that that be told to the vendor at time of referral? Will the offender be aware of the payment responsibility at the time of referral?
Yes. The Department’s referral form outlines the payment status of each Offender receiving services. Please see the answer to Question 18.
Yes. The Offender will be aware of their payment responsibility at the time he/she is referred by his/her Supervising Probation Officer.
The RFQ states that the vendor should be able to provide up to 40 hours of substance abuse disorder treatment training annually to Department staff. Is this per circuit?
How many Staff will we need to be able to train? Can the training be done virtually?
Yes, the Department requires the Vendor to provide training for each Judicial Circuit. Vendors may provide training in-person or virtually. The number of Department staff receiving training from the Vendor will be determined in collaboration
Question Answer between the Contract’s Representative and the Contract Manager.
Will the Department pay for ancillary services that are provided to offenders (psychiatric services)?
No. The Department will not pay for ancillary services.
Are Group counseling sessions required to be face to face or can they be done via Zoom?
All Telehealth Services delivery shall be in accordance with Rule 65D.30.004(20) and 65D-30.002(82), F.A.C., and follow all applicable federal confidentiality regulations.
Are Drug screens a mandatory component of the program?
No. Drug screens are not a mandatory component of the Program.
Can a vendor operate an Outpatient Treatment Service Site on a company owned facility that also houses a Florida Department of Corrections Contract Community Based Residential Treatment program (non-secure) and/or a company owned facility that houses a Community Reentry Center (secure)?
Yes, if the segregation requirements of populations can be maintained. The Vendor must meet zoning, licensing and local ordinance permits for operating outpatient treatment services.
Can a vendor operate an Outpatient Service Site on a State-owned facility that houses a Community Reentry Center (secure)?
The Department may allow on-site services to be provided only to Offenders assigned by the Department at the Department’s facility.
Will clients remanded to the Outpatient Program face consequences for failure to meet program standards, violation of program rules, and/or consequences for substandard performance?
Yes. The Department will assess each case and determine the appropriate action for each Offender who fails to meet the Program standards, violates Program rules, or has substandard performance in the Program.
