About this file

This is a Single Source Solicitation (SS25-15) issued by the City of Winter Park, Florida, for ExtremeScreen Windscreens. The document outlines a procurement process for windscreen products from Ball Fabrics, with a release date of October 24, 2024, and a response deadline of November 14, 2024, at 10:00 am. The solicitation is specifically for ExtremeScreen Windscreens to be used at the city's Tennis Center and Ball Fields, with an estimated fiscal year spending of $10,000 - $20,000.

The procurement is being pursued as a single source acquisition, with Ball Fabrics identified as the sole manufacturer of this specific type of windscreen. The city justifies this approach based on the product's unique characteristics, including reduced maintenance requirements, longer-lasting performance, and a 7-year warranty. The document emphasizes that this purchase will not obligate the city to future purchases from this vendor, and the procurement is based on the city's positive experience with these windscreens over the past 5-6 years. The solicitation follows Florida Statute 287.057 and allows for potential alternative vendors to submit qualifications if they believe they can provide equivalent products.

2. Notice

It is the policy of the City of Winter Park to consistently purchase goods and services by full and open competition. The taxpayers of Winter Park are best served when we make sound business decisions based on competitive bids or proposals. Early acquisition planning, including the Procurement Division, can help to avoid delays and facilitate effective market research. However, there may be instances in which a method other than full and open competition can be justified. If a user department determines that a method alternative to full and open competition is necessary or in the best interest of the City of Winter Park, appropriate justification for that course of action must be submitted to the Procurement Division for approval in order to waive the competitive procurement process.

Single Source (use for single purchases only): The supply of a product or service is so uniquely* qualified that is only available from a solitary source.

*Definition of Uniquely:

A. Being the only one of its kind

B. Without an equal or equivalent; unparalleled

C. Unusual; extraordinary

D. Characteristic of a particular category, condition or locality

Product: ExtremeScreen Windscreens

Proposed Vendor: Ball Fabrics

Fiscal Year: 2025

Estimated FY Spending: $10,000 - $20,000

1. Explain why the product/service requested is the only product/service that can satisfy your requirements.

Be specific with regard to specifications, features, characteristics, requirements, capabilities and compatibility. Describe what steps have been taken to make this determination:

This screen cuts down on maintenance and breaking of zip ties. It also comes with a 7-year warranty instead of a 5-year.

2. Explain why this service provider, supplier or manufacturer is the unique available source from which to obtain this product/service. Describe the efforts that were made to verify and confirm the validity of a distributor’s claim to be the only available source. (Obtain and include a signed letter from the manufacturer confirming claims made by distributors of exclusive distributorship):

They are the sole manufacturer that makes this type of screen.

3. Will this purchase obligate the City to a particular vendor for future purchases? (Either in terms of maintenance that only this vendor will be able to perform and/or if we purchase this item, will we need more “like” items in the future to match this one?):

No

4. Please describe your market research and the results thereof, including a description of other similar sources or products available and why they are not acceptable:

Over the last 5-6 years we have bought windscreens for the Tennis Center and Ball Fields and have found these have lasted the longest and required the least work.

I certify that the above statements are true and correct to the best of my knowledge, and that prices obtained are fair and reasonable. I also certify that neither I, nor my family members, will gain or receive any additional benefit because I have recommended that this acquisition be obtained solely from a designated vendor or contractor.
