About this file
This document is an Export Control Determination notice for a potential procurement of Millennia EV 25 and Matisse CX lasers and accessories under requisition PR362904. The export control review, issued by Oak Ridge National Laboratory (ORNL), classifies the item under Department of Commerce jurisdiction with an ECCN EAR99 classification. The determination requires all parties to comply with U.S. export control laws and regulations, with specific emphasis on monitoring technology transfers, especially involving foreign nationals. The Principal Investigator is responsible for tracking project performance and maintaining awareness of potential export control implications throughout the project lifecycle.
The document outlines regulatory requirements referencing multiple federal agencies including the Department of Commerce, Department of State, Nuclear Regulatory Commission, and Department of Energy. It notes that if there are material changes in the project scope or identified end-point performance, a re-determination of export controls will be necessary. EXPORT CONTROL DETERMINATION NUMBER: PROC-2025-135651
April 08, 2025
Introduction Export Control has made the following export control determination on request to review requisition PR362904 (ERP ID 3400576704).
Technology/Item Classification Based on the available information provided and/or in discussions with the cited parties, the standard export control clause is sufficient for assigning export control responsibilities to the appropriate contractual members. It is the responsibility of the Project Managers/Project Leads to ensure any export controlled items/technology are appropriately addressed prior to such actions taken.
The export jurisdiction for PR362904 is the Department of Commerce. The ECCN EAR99.
History/ Item Classification: MKS, Marino
Regulatory Requirements This determination is issued in accordance with the Department of Commerce (DOC) under 15 CFR Parts 730-774, or Department of State (DOS) under 22 CFR Parts 120-130, or Nuclear Regulatory Commission (NRC) under 10 CFR Part 110, or Department of Energy (DOE) 10 CFR Part 810, along with other applicable laws and regulations related to export control.
Other Considerations If any agreements are entered into, all parties must agree to be responsible for their own Export Control Compliance of U.S. laws and regulations as they relate to the work being undertaken. It should be noted, if there is a material change in the scope of work or if an end-point performance/application is identified, a re-determination will be required.
The Principal Investigator on this project is responsible for monitoring the performance achievements of the project and keeping export control requirements in mind. These agreements can run for years and export control laws and regulations can change. Also, it should also be noted that "deemed exports" includes the transfer of technology to foreign nationals in the United States.
