About this file

This is a Domestic Products Procurement Act (Buy American) Preference Form (Form MO 300-1102N) required for bidding on a Missouri Department of Transportation (MoDOT) Central District contract for manufactured sand. The contract involves the supply and delivery of manufactured sand meeting Central District Specification 6B to various locations, with a contract period extending from notice to proceed through November 16, 2026. Bidders are required to disclose the point of manufacture for each product being bid to determine eligibility for the domestic products preference, with documentation potentially required to verify compliance.

The form establishes four certification pathways for bidders: declaring that all products are manufactured or produced in the United States and eligible for preference; declaring that all products are foreign-manufactured and ineligible for preference; providing item-by-item certifications for mixed sourcing; or identifying products that qualify under international trade treaties, laws, agreements, or regulations, or that represent the only U.S.-manufactured option available. Bidders must complete the applicable certification tables, listing item numbers and either the U.S. city and state or foreign country of manufacture. Products manufactured in the United States receive preference, while foreign-manufactured products qualify for preference only if covered by applicable trade agreements that allow duty- and tariff-free entry or if they represent a sole U.S. manufacturer's product. Bidders must certify under penalty of class A misdemeanor that all information provided is accurate and compliant with Missouri Revised Statutes sections 34.350 to 34.359.

The bidder may be required to provide supporting documentation indicating proof of compliance.

Qualifying for the Domestic Products Preference:

A product qualifies for the preference if one of the following circumstances exist:
