About this file
This document is an Exhibit G acknowledgement form for the Energy Policy Act of 2005 Section 179D allocation related to design professional services for Project No. J-467-DP at Kennesaw State University in Marietta, Georgia. The exhibit addresses the potential tax deduction allocation available to designers under Section 179D of the Internal Revenue Code, which encourages energy-efficient commercial building design and construction. The form requires proposers to indicate their intention regarding pursuit of Section 179D deductions derived from the project through an allocation agreement with the owner.
The form presents two mutually exclusive options for proposers to select: either to negotiate and seek any Section 179D deduction allocation from the owner pursuant to an allocation agreement, or to decline pursuit of such allocation. The owner reserves the right to retain a third-party consultant to manage and administer the allocation process if deductions are pursued. The document requires completion with the firm name, authorized signature, and date, and serves as formal acknowledgement of the proposer's position on this tax incentive opportunity related to the energy-efficient renovations project.
