The Consultant's responsibilities encompass furnishing benches and plaques, coordinating site verification with County staff, delivering materials to designated locations, performing complete turnkey installation including labor and equipment, site preparation, ADA accessibility compliance, utility clearance coordination, warranty provision, and restoration of disturbed improvements. The contract term is five years from the execution date, with no specified renewal options. The contract acknowledges this is non-exclusive and does not guarantee minimum compensation.
The maximum contract amount is $100,000 for the five-year term, with payment made on a job-by-job basis upon completion of satisfactory performance as invoiced by the Consultant. The Consultant must provide itemized monthly invoices in arrears within twenty days of the month's end, and the County shall remit payment within sixty working days of invoice receipt or resolution of billing disputes. The Consultant is required to accept payment via electronic funds transfer. The contract requires the Consultant to maintain a valid California State license in one of the following classifications: A-General Engineering Contractor, B-General Building Contractor, C-27-Landscaping Contractor, or D-34-Prefabricated Equipment Contractor. Extensive insurance requirements are mandated, including Workers' Compensation with $250,000 employer's liability limits, General Liability with $1,000,000 combined single limit, Automobile Liability with $1,000,000 combined single limit, Professional Liability or Errors and Omissions with $1,000,000 per claim and $2,000,000 aggregate limits, and Cyber Liability Insurance with $1,000,000 per occurrence and $2,000,000 annual aggregate. All policies except Workers' Compensation must name the County as an additional insured. If the contract value exceeds $1,000,000, Iran Contracting Act compliance is required. Prevailing wage laws apply if the services constitute a public works project exceeding $1,000 in total compensation, with detailed payroll record-keeping, apprenticeship ratio compliance, and Department of Industrial Relations registration requirements.
